Executive Session
September 2, 2003
The Executive Session convened at 7:00 p.m. in the Library at the Birch Meadow School, 27
Arthur B. Lord Drive, Reading, Massachusetts. Present were Chairman George Hines, Vice
Chairman Richard Schubert, Secretary Gail Wood, Selectmen Camille Anthony and
Matthew Cummings, Town Counsel Joan Langsam, Town Manager Peter Hechenbleikner and
Paula Schena.
Town Counsel Review of Legal Issues
Town Counsel Joan Langsam noted that she will call Nancy Eatons' Attorney and find out what
is going on with the case. There is nothing new going on with Mohla -- we're trying to work out
a settlement agreement. There is nothing going on with the Beacon Street neighborhood. The
Welch matter has been settled into an agreement, and the Danvers Savings Bank issued the Town
a check for$25,000 for offsite improvements.
Joan Langsam noted that Capobianco has entered into an agreement with the developer which
moves the access to another location. Cumberland Farms has been settled. Discovery has not
commenced in the Fulgoni case. The Tine case has been settled. Selectman Matthew Cummings
noted that Tine is still being charged by the RMLD Counsel.
Joan Langsam noted that the Reading Retirement Board versus the Middlesex County
Retirement Board is trying to recoup some money. The Town Manager will find out how much
we are trying to recoup and how much we have spent trying to recoup.
Vice Chairman Richard Schubert asked about Frugal Fannies, and Town Counsel noted that John
Gannon is filing a claim for Police details.
A motion by Anthony seconded by Wood to adjourn the Executive session of September 2,
2003 at 7:35 p.m. was approved on a roll call vote with all five members voting in the
affirmative.
Respectfully submitted,
`Secretary
