Executive Session
October 26,2004
For ease of archiving, the order that items appear in these Minutes reflects the order in which
the items appeared on the agenda-for that meeting, and are not necessarily the order in which
any item was taken up by the Board.
The meeting convened at 7:15 p.m. in the Selectmen's Meeting Room, 16 Lowell Street,
Reading, Massachusetts. Present were Chairman Richard Schubert, Vice Chairman
Camille Anthony, Secretary Gail Wood, Selectmen Joe Duffy and George Hines, Town
Manager Peter Hechenbleikner, Paula Schena and Town Counsel Joan Langsam.
Litigation
Joan Langsam noted that the Town received a claim from Mark Ford and that MIIA will
represent the Town. She spoke with Bill McKinnon and he wrote a letter to Ford's attorney. He
will have to prove everything he claims; i.e., the noise level, traffic counts, etc. No suit has been
filed. If they do file a nuisance claim,MIIA will cover it.
Selectman George Hines asked if we should respond to this, and Joan Langsam indicated that if
we don't respond in six months, then they can file suit. We are not liable -- he has to prove his
claim.
Chairman Richard Schubert asked if the Town has to produce a traffic study, and the Town
Manager indicated only if we already had one but we don't.
Chairman Richard Schubert asked if this has any bearing on the Ad Hoc Memorial Park Study
Committee, and Joan Langsam indicated that the cy pres is to reinforce clearly what we can do.
She feels that the Town is better off acting on it rather than not acting on it.
Selectman Gail Wood indicated that the Study Committee was a result of Mark Ford's
complaints in the first place.
Labor Negotiations
The Town Manager updated the Board on the defibs. He noted that the initial offer was to pay
$125.00 in the base pay. They declined and now they want to settle for$130.00 retroactive. The
total amount would be $6,875.43.
Anthony moved and Wood seconded to accept the Reading Patrol Officer Association's
offer of a stipend for $130 per year retroactive for a total not to exceed $6900. Hines
moved and Wood seconded to amend the motion and substitute a $90 stipend instead of
$130. The motion to amend failed on a roll call vote of 0-4-1, with Duffy, Wood, Anthony
and Schubert. voting in the negative and Hines abstaining. The original motion was
approved on a roll call vote of 4-1-0, with Duffy, Wood, Anthony and Schubert voting in
the affirmative and Hines voting in the negative.

A motion by Anthonv seconded by Duffy to adiourn the Executive Session of October 26,
2004 at 7:50 p.m. was approved on a roll call vote with all five members voting in the
affirmative.
