MASS. ,Bib SEP 21 A 8: 201 Location: Selectmen Meeting Room Session: General Session Robert Redfern, Chairman; David Traniello, John Jarema, Erik Hagstrom, Nick Pernice Members - Plot Present: Kathleen Hackett, Damase Caouette Others Present: Minutes Respectfully Submitted By: Kim Saunders on behalf of Robert Redfern Topics of Discussion: Mr. Redfern opened the meeting at 7:00 p.m. Case # 16-13 The Zoning Board of Appeals held a Public Hearing on the petition of Steven L. Cicatelli, Esq. who seeks a Variance under Section 6.3 & 7.4 of the zoning bylaws in order to add onto the existing non -conforming 3 family dwelling and to connect it to a detached structure on the property located at 86 Bancroft Avenue in Reading, Massachusetts. The use will remain as a 3 family dwelling. Mr. Cicatelli introduced himself as the Attorney representing Paul Ferazzi of Bancroft Realty Trust, the owner of the property located at 86 Bancroft Avenue. He said he received an email from Glen Redmond, Zoning Enforcement Officer, stating the use of this property as a three family dwelling is not a legal use. Mr. Redmond's letter stated there was a building permit issued on December 29, 1966 to convert the structure from a single family to a two family dwelling. Mr. Cicatelli asked the Board to grant his request to continue the public hearing. He would like time to review the records in the Building Department at the Town Hall. He said the application might be amended after he does the review since the Variance request was for alteration on a legal three family dwelling. On a motion made by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to accept the request of Mr. Cicatelli to continue Case #16-13 to September 1, 2016. Mr. Cicatelli agreed to submit in writing his request to continue the public hearing until September 1, 2016. Vote was 5-0-0 (Redfern, Traniello, Jarema, Pernice, Hagstrom). Page 1 1 LCR K After a resident asked for an explanation on why the hearing was continued, Mr. Redfern recommended the resident go to the Town Hall for clarification. Case # 16-10 The Zoning Board of Appeals continued a Public Hearing on the petition of Jack Sullivan who seeks a Variance under Section 6.2.1(b) Lot Shape of the zoning bylaws in order to create a buildable lot on the property located at 116 Van Norden Road in Reading, Massachusetts. Jack Sullivan, Sullivan Engineering Group, reviewed the Variance request for lot shape relief. He said Town Counsel gave an opinion that the case be heard by the Zoning Board of Appeals and if the Variance is granted, to file an ANR with the Community Planning and Development Commission. Mr. Sullivan informed the Board the Conservation Commission issued an ORAD. The ORAD is approval for the wetland line. He said the updated plan is dated May 31, 2016. Mr. Traniello and Mr. Jarema acknowledged the corrected plan emphasized the enclosure. Mr. Jarema added he felt the requirements were met when originally presented at the May 19, 2016 meeting. Mr. Hagstrom said he was not present at the original meeting but he reviewed the tape. Mr. Hagstrom and Mr. Pernice said they had no comment. On a motion made by Mr. Traniello, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to approve the petitioner's request for a Variance from Section 6.2.1. (b) of the zoning bylaw in order to create a buildable lot (Lot A), on the property located at 116 Van Norden Road in reading, Massachusetts, consistent with the amended plot plan dated May 31, 2016. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). Case # 16-05 The Zoning Board of Appeals continued a Public Hearing on the petition of Thomas & Cynthia Bates who seek a Variance under Sections 5.0, 5. 1, Table 5.1.2 Dimensional Controls of the zoning bylaws in order to construct an addition (garage) 8.1' from the side lot line, rather than the 15.0' required, on the property located at 18 Fairview Avenue in Reading, Massachusetts. Mr. Redfern read an email from Mr. and Mrs. Bates which requested that their application be withdrawn without prejudice. On a motion made by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to grant the applicants' request to withdraw ZBA Case #16-05 without prejudice. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). Other Business Reorganization: Jarema made a motion to nominate Mr. Traniello as chairman for the required one year term. Page 1 2 Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). The Board discussed tabling the nomination for vice-chairman until the members who are absent will be present. After a discussion, Mr. Traniello nominated Mr. Jarema to be vice-chairman for the required one year term. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). Minutes February 18, 2016 On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the minutes dated February 18, 2016 Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). April 7, 2016 On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the minutes dated April 7, 2016 as amended. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). April 21, 2016 On a motion by Mr. Traniello, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to approve the minutes dated April 21, 2016. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). May 19, 2016 On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the minutes dated May 19, 2016. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). June 2, 2016 On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the minutes dated June 2, 2016. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice). Mr. Traniello thanked Mr. Redfern for serving Chair of the Zoning Board for the last two years. The Board briefly discussed the schedule of the upcoming 40B public hearing due to members not being able to attend. Adiournment On a motion by Mr. Jarema, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to adjourn the meeting at 7:47 p.m. Vote 5-0-0 (Redfern, Jarema, Traniello, Hagstrom, Pernice).
