I tr�JSa Zoning Board of Appeals Date: 2016 -04 -21 Time: 7:00 PMZQIb JUL 13 P 37 32, Building: Reading Town Hall Location: Selectmen Meeting Room Address: 16 Lowell Street Purpose: General Business Session: General Session Attendees: Members - Present: Robert Redfern, Chairman; Damase Caouette, John Jarema, David Traniello, Nick Pernice Members - Not Present: Kathleen Hackett, Erik Hagstrom Others Present: Minutes Respectfully Submitted By: Kim Saunders on behalf of Robert Redfern Topics of Discussion: Mr. Redfern opened the meeting at 7:00 p.m. Case # 16 -06 The Zoning Board of Appeals held a public hearing on the petition of Ryan & Erin Patterson who seek a Special Permit under Section 7.3.2 of the zoning bylaws in order to add an addition 18.0' x 30.7' to a non - conforming dwelling on the property located at 9 Glidden Way (also known as 971 Main' Street) in Reading, Massachusetts. The proposed addition does not comply with the required setback of 20'. Ms. Nancy Twomey, architect for the project, described the lot, dwelling and project. She said, the proposed project would not affect the neighbors. Mr. Redfern questioned if Glidden Way was a private road. Ms. Twomey confirmed the Town never accepted the road as a public street. Mr. Traniello had no questions. Mr. Jarema asked for the original site plan from when the dwelling was built in 1966. He questioned what the developer considered to be the property frontage. Ms. Twomey stated she spoke to Mr. Redmond, Zoning Officer, about this concern. She agreed the property is confusing on what should be considered the side, rear or front yard. Mr. Caouette questioned why Mr. Redmond's denial letter stated a Variance would be needed. Mr. Redfern read the email from Mr. Redmond in regards to this case. The email stated he had no concern with the proposal if a Special Permit was issued. Page I 1 Mr. Pernice asked about the location of the third bedroom. Ms. Twomey said the petitioner would like to bring the three bedrooms into the main area of the dwelling. Mr. Redfern agreed the lot is convoluted. He said the dwelling met requirements when dt was built in 1966. He stated the proposal would not be detrimental to the neighborhood. Ms. Twomey clarified Mr. Jarema's question about the height of the addition. Mr. Redfern opened the meeting to the public. Since there were no comments Mr. Redfern closed the public hearing. On a motion by Mr. Caouette, seconded by Mr. Jarema, the Zoning Board of Appeals moved to grant the petitioners a Special Permit under Section 7.3.2. of the zoning bylaws in order to add', an addition to the existing dwelling on the property as shown on the referenced Certified Plot Plan with the usual three conditions. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Permce, Traniello). Case # 16 -08 The Zoning Board of Appeals held a public hearing on the petition of Dan & Rachael McGrat� who seek a Variance under Section 5.5 Accessory Buildings or Structures paragraphs the zoning bylaws in order to construct a two story addition to the rear within 5.3' and 5.6' of an existing garage on the property located at 85 Grand Street in Reading, Massachusetts. The required distance is currently 10.' Mr. Redfern stated the petitioners for Case # 16 -08 has requested a continuation to May 19, 2016. On a motion by Mr. Traniello, seconded by Mr. Caouette, the Zoning Board of Appeals moved to continue ZBA Case #16 -08 to May 19, 2016 at the request of the petitioners. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Pernice, Traniello). Other Business Mr. Redfern commented on the email the Board received earlier from Julie Mercier, Community Development Director. The email stated the applicant for Case #16 -02 has not replied to any correspondence in regards to submitting new material as discussed at their last public hearing.' Mr. Redfern asked the Board their opinions on the upcoming public hearing on May 12, 2016.' He stated he had concerns that if new material was submitted by the applicant at the last moment that the Board, the Town, or peer reviews would not have time to review. Mr. Jarema said the allowed 180 days has gone past the mid point. He said the Board should Mold the public hearing as scheduled because this would allow the applicant to show up. Mr. Traniello asked the Board if the public hearing should be moved to June 16, 2016. He asked if it was necessary to open the public hearing on May 12 and then have to continue. He said the educational presentation that is scheduled could be moved to June 16. Mr. Redfern stated the public hearing on May 12 should be held. He said an extension could be requested if the applicant shows up. He commented that the 40B consultant would like a draft decision started. Mr. Caouette questioned why the applicant is not being responsive and also said he had concerns no progress is being made. He said the Board needs time to look at the plan changes and make a conscious decision. Page 1 2 Mr. Jarema agreed the Board should hold the public hearing on May 12. Mr. Caouette also agreed the Board should hold the public hearing. He stated the concern of not meeting the allowed 180 days can be voiced that night. Mr. Traniello questioned the amount of resources that will be spent on holding the public hearing on May 12. He asked if the peer reviews should go if nothing new is submitted. Mr. Jarema questioned who requested the 40B consultant to do a presentation. Mr. Traniello and Mr. Caouette withdrew their motion to adjourn once Mr. Chris Barcikowski of 27 Woodward Avenue asked the Board for clarification on their decision on his ZBA Case #16- 07. Mr. Traniello recused himself and left the meeting. Mr. Jarema stated the Board ruled on what was presented. The decision was based on Section'. 7.3.2 of the zoning bylaws. Mr. Chris asked the Board if he changed the deck dimensions would they approve. The Board briefly discussed and suggested Mr. Barikowski work with Mr. Redmond. The Board agreed he would need to reapply if relief is needed. Adjournment On a motion by Mr. Jarema, seconded by Mr.Caouette, the Zoning Board of Appeals moved to adjourn the meeting at 8:30 p.m. Vote was 4 -0 -0 (Redfern, Caouette, Jarema, Pernice). Page 1 3
