CBoard - Committee - commission - council: Zoning Board of Appeals 2016 MAR 14 P 2.021 Date: 2016 -01 -07 Time: 7:00 PM Building: Reading Town Hall Location: Selectmen Meeting Room Address: 16 Lowell Street Purpose: General Business Session: General Session Attendees: Members - Present: Robert Redfern, Damase Caouette, John Jarema, David Traniello, Erik Hagstrom Members - Not Present: Kathleen Hackett Others Present: Minutes Respectfully Submitted By: Kim Saunders Topics of Discussion: ® Case # 16 -01 The Zoning Board of Appeals held a public hearing on the petition of Anthony Caturello who seeks a Variance and a Special Permit from Sections 6.3 & 7.3.2 of the zoning bylaws in order to request a Special Permit to expand the front porch 6.6' x 11.6' with platform and stairs and to expand the rear for a two story addition; and to request a Variance to add a single -story detached two -car garage 24' x 25' at the rear on the property located at 57 Federal Street in Reading, Massachusetts. The lot coverage will be 28% rather than the required 25 %. Ms. Twomey introduced herself as the architect of the project for the petitioner Mr. Caturello. She described the project and why a Variance and Special Permit is being requested. She stated the Variance criteria for the project. Mr. Redfern read comments on the petition that were submitted by Mr. Redmond who is the Town Zoning Officer. Mr. Traniello reviewed the parts of the project that fall under the Special Permit and the Variance requests. Mr. Traniello stated his concerns with the criteria presented. After Mr. Jarema and Mr. Caouette described how they interpreted the project, Ms. Twomey clarified where Mr. Caturello will be entering his home. QMr. Redfern explained why Mr. Redmond would consider the platform a structure. Mr. Hagstrom said he had no objection to the Special Permit, but the criteria for the Variance warrants discussion. Page 1 1 Mr. Redfern said he had a concern with the proposed garage and the stated criteria. He suggested the garage be a small double or an oversized single garage. He asked the use of the garage attic. Mrs. Twomey confirmed after construction the existing 3 bedroom will be converted to a large bedroom with an office. The garage attic will be used for storage only; the only access will be a pull down. Mr. Redfern opened the hearing to the public. Mr. Kelly of 59 Federal Street said he is in favor of the project. He had no issue with the proposed garage. Mr. Caturello said he is not against changing the garage structure and tandem parking was discussed. Mr. Jarema suggested eliminating the platform at the side stairs. Ms. Twomey said today's garage needs to be larger due to the oversize of current vehicles. She explained how Mr. Caturello intended to utilize the garage. She said the new bylaw limits detached structures to a single story. Ms. Twomey asked for the Variance request to be withdrawn and this would include the proposed garage and the 4' x 4' platform at the side stairs to the dwelling. • Mr. Redfem closed the public comment. On a motion made by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the request for a withdrawal without prejudice by the petitioner for the portion of the application relating to the Variance request under Section 6.3 of the zoning bylaws as it relates to the exterior platform and the single story detached garage that exceeds the 25% lot coverage. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom). On a motion made by Mr. Traniello, seconded by Mr. Caouette, the Zoning Board of Appeals moved to approve the request for the Special Permit according to Section 7.3.2 of the zoning bylaws in order to expand the front porch and to expand the rear of the structure of the two story addition as well as a 6' x15' rear deck on the property at 57 Federal Street, Reading, MA with the following Standard Conditions: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new structure shall be submitted ® to the Building Inspector, along with the as -built foundation plan(s), prior to the issuance of a Building Permit. As -built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. • Mr. Jarema withdrew the second motion. Mr. Traniello amended the motion to include the set of relevant drawings based on the structures being approved in the Special Permit. Mr. Caouette seconded the amended motion. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom). Minutes October 15, 2015 On a motion made by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to approve the October 15, 2015 minutes as amended. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom). November 5, 2015 On a motion made by Mr. Caouette, seconded by Mr. Traniello, the Zoning Board of Appeals moved to approve the November 5, 2015 minutes as amended. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom). • December 3, 2015 On a motion made by Mr. Traniello, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to approve the December 3, 2015 minutes as amended. Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom) Other Business Mr. Redfern stated he met with Bob LeLacheur, Town Manager; Jean Delios, Assistant Town Manager; and Julie Mercier, Community Development Director to discuss the pending 40B application for Reading Village at 39 -41 Lincoln Street & 2 -12 Prescott Street. He discussed the documentation received from Massachusetts Housing in regards to the proposal. He let the Board know the original application can be viewed at the Town Hall. Mr. Jarema requested that the 40B application be the only item on the agenda for the Zoning Board of Appeals meeting on February 4. Adjournment On a motion by Mr. Jarema, seconded by Mr. Traniello, the Zoning Board of Appeals moved to adjourn the meeting at 8:15 p.m. OVote was 5 -0 -0 (Redfern, Caouette, Jarema, Traniello, Hagstrom).
