Variance Request from Calareso's

Calareso's requested a variance from the Food Code section 4- 401.11 through 4 -4 -2.12 to
allow outdoor use of their donut machine. The machine is to be brought inside at night.
After reviewing the food code, Friedmann made a motion to grant the variance, seconded by
Singer. Approved 3:0
Discussion Regarding Board of Selectmen's Meeting
Marsie West stated she had concerns that the revision to the Regulation Restricting the Sale
of Tobacco Products and Nicotine Delivery Products happened too quickly and the Board of
Selectmen were not informed. She did not understand the health benefit to increasing the
age from 18 to 21 to purchase these products. She stated the concerns of the Board of
Selectmen that customers will go to other towns to purchase tobacco and other products
which will affect local businesses.
Clay explained the role of the Board of Health (BOH) is set by state statutes. Public health
hearings are only required for Title V; however, this Board does hold public hearings for all
new and revised regulations and puts a Legal Notice in the newspaper the week in advance.
This public hearing was in the February monthly report, a Legal Notice was published in the
Daily Times Chronicle, a letter was sent to all affected businesses, the agenda was posted at
Town Hall and on the Town website. Singer stated that he was concerned about the tone of
the Selectmen's remarks which he characterized as suspicious. Friedmann also agreed.
Singer stated the BOH reviewed all the relevant health Information provided by RCASA, Dr.
Lester Hartman, MA Association of Health Boards and the director of the Brookline tobacco
collaborative, and had a joint discussion with BOH members of Melrose and Wakefield.
Based on that information, he voted in favor of this change for the protection of the health
and well -being of the residents In the Town of Reading.

Friedmann agreed that his decision was based on science and for the public health
protection of our youth.
Friedmann suggested the appointment of a Board of Selectmen liaison would help with
communication between the Board of Health and Selectmen.
Other business and items not reasonably anticipated at the time of posting:
Clay advised a graduate student from Boston University public health program would be
starting an internship beginning May 13 through the fall and will be working with Dina
McCarron, public health nurse on a tick education program. Marsie West said this is a
program the BOS would be very interested in. Clay reminded her that she was scheduled to
make a presentation to the Board of Selectmen May 27 on this subject.
