Acceptance of Minutes Minutes of May 11, 2015 were presented. Meade made motion to approve, seconded by Singer. Motion passed 3:0. Public Hearing - Reading Quick Stop Buzby advised this was the second violation for selling tobacco to a minor within 36 months. The first violation occurred when the minimum age for tobacco sales was 18. When underage compliance checks are performed, all purchasers under the age of 27 years must be carded. She clarified that Donald Dewar is the owner of the establishment, Daniel Dewar, who is present, acts as the manager. Daniel Dewar stated he takes the issue very seriously. Both violations occurred when he was not on duty. He does provide training for new employees. He inquired if there could be any leniency as the 7 day suspension would incur a great loss of revenue. Friedmann stated the regulation does not leave any wiggle room as it states the permit shall be suspended for seven consecutive business days and all tobacco products and nicotine delivery products shall be removed from the establishment upon suspension. Dewar requested if the suspension period could be July 51h -July lit". Meade made a motion to suspend the permit for the period of July 5th -July 110, all tobacco and nicotine delivery products must be removed from the storefront, and the machinery had to be covered. Motion was seconded by Singer; motion passed 3:0. Update to Regulation Section 20 Enforcement and Penalties Erickson presented update. After discussion, Friedmann suggested deleting "and Town of Reading By -laws Section 1.8" from Section 20.2. Meade made motion to update regulation with that change, seconded by Singer. Motion passed 3:0. Page I 1 Open session for topics not reasonably anticipated 48 hours in advance of the meeting. Buzby advised that she met with the school committee to discuss the increasing use of e- cigarettes by adolescents and the concern that most were using e- cigarettes to start smoking, not as part of cessation program. A recent youth survey from Winchester High School Indicated 65% would only try "cigars/e- cigarettes if they were flavored ". Friedmann requested that when Buzby had additional data from Winchester she return for a follow up. Erickson introduced Donna Pierce as the new public health nurse. Singer made motion to appoint Pierce to act as an agent of the Board of Health; seconded by Meade. Motion passed 3:0.
