Case # 15 -13
Mr. Redfern stated Case #15 -13 has been postponed due to an incorrect legal notice. It is
rescheduled to December 17, 2015.
Case # 15 -14
The Zoning Board of Appeals held a Public Hearing on the petition of Ayoub Engineering Inc.
who seeks a Variance from sign regulations Section 8.0 in order to modify free - standing sign to
include LED, add LED pump topper signs, add canopy sign (illuminated) on the property located
at 87 Walkers Brook Drive in Reading, Massachusetts.
On behalf of Maria Energy Corporation, Mr. Steve Pedro described the upgrades his client is
seeking. He said the CPDC has approved the modification to the signage plan. He stated they
concurred with the LED on the free - standing sign and the LED pump topper signs but they did
not approve the canopy. He requested the Board keep the canopy separate from the LED
request.
Mr. Redfern read the memo from Glen Redmond, Commissioner of Buildings.
Mr. Redfern acknowledged the CPDC approval.
Mr. Traniello questioned why there are different names on the CPDC application compared to
the ZBA application. After Mr. Pedro explained, Mr. Traniello stated the Variance will have to
be issued to 87 Walkers Brook Drive LLC.

Mr. Pedro confirmed the LED will only change when the price is changed and it will not be
flashing. He said the stand alone sign is an existing non - conforming structure but will not be
adding to the non - confirmatory.
Mr. Traniello questioned if the reflective paint on the canopy is for safety reasons. Mr. Pedro
answered the reflective paint is for night motorists so they will be able to spot the service station.
Mr. Pedro read their four criteria for a Variance.
Mr. Jarema questioned the different color signs on the free standing sign. He questioned if the
Dunkin Donuts sign would remain unchanged. He asked if the illumination on the LED could be
adjusted. Mr. Pedro confirmed the brightness could be adjusted if it is a distraction.
Mr. Caouette questioned why there is signage on the canopy. Mr. Pedro answered the canopy is
becoming the standard for the Shell Company.
Mr. Hagstrom stated he is not opposed to the canopy. It is in an industrial area and other
gasoline businesses have them. Mr. Jarema commented the Mutual Gasoline Station canopy is
not painted.
Mr. Redfern questioned the hours of operation. He said he agreed with the Board. He had no
issues with the LED signage on the free standing sign or the pump toppers; but the canopy is not
allowed in Town. Mr. Pedro said the business is open 24 hours a day, 7 days a week.
Mr. Redfern opened the hearing to the public.
Tony D'Arezzo of 130 John Street said the CPDC was reluctant to allow the canopy due to
businesses in residential areas requesting them.
Mr. Darezza said the applicant has never applied for PUDI under the zoning bylaw.
Mr. Darezza asked the Board to review the Mutual Gas Station decision in regards to what was
approved for LED signage.
On a motion by Mr. Caouette, seconded by Mr. Traniello, the Zoning Board of Appeals moved
to grant the petitioner, Aeyob Engineering, 87 Walkers Brook Drive, a Variance under Section
8.0 of the zoning bylaw in order to accomplish three separate requests:
1. Addition of LED lighting to the existing free standing sign as depicted in Sign Plan
drawing SG -1 dated 08 -19 -15 with revisions 1, 2 and 3 dated 09- 02 -15, 09- 22 -15, and
09 -30 -15 respectively, prepared by Ayoub Engineering, 414 Benefit Street, Pawtucket,
RI for Nouria Energy Corporation, 87 Walkers Brook Road, Reading, MA.
2. Addition of LED lighting to pump toppers as depicted in Sign Plan drawing SG -1 dated
08 -19 -15 with revisions 1, 2 and 3 dated 09- 02 -15, and 09 -3015 respectively, prepared by
Ayoub Engineering, 414 Benefit Street, Pawtucket, RI for Nouria Energy Corporation, 87
Walkers Brook Road, Reading, MA.
3. Addition of canopy lighting with two additional internally illuminated Shell pectin signs
as depicted in Canopy Elevations drawing SG -2 dated 09- 30 -15, prepared by Ayoub
Engineering, 414 Benefit Street, Pawtucket, RI for Nouria Energy Corporation, 87
Walkers Brook Road, Reading, MA.
