Mr. Redfern opened the meeting at 7:00 p.m.

181 South Street
The Zoning Board of Appeals held a meeting to determine if the new proposal is a Minor or Major Modification
for a previously granted Special Permit (ZBA Case # 15 -04).
Mr. Wise explained the circumstance why he is presenting a new proposal for his property that is located at 181
South Street. He distributed copies of the stamped Record Conditions Plan of Land dated 09/14/2015. He
went through the plans and talked about the requested changes. He stated the 2nd driveway is removed and
the garage will now be a 3 bay garage. He said he submitted his proposal to the Conservation Commission but
has nothing in writing of their approval of the changes.
Mr. Traniello said there is nothing in the Zoning Bylaws to help make a determination if an amendment is a
major or minor modification. He read the from the PRD and PUD guidelines.
Mr. Jarema said he had concerns regarding the second driveway approval from the Board of Selectmen. He
questioned if the approval goes with the property, and a new owner could request the second driveway. He
stated his concern with not having documentation from Town Counsel, the Building Inspector, or the
Conservation Commission.
Mr. Wise said he is willing to go back to the Board of Selectmen to withdraw his request for the second
driveway. He said the actual accessory apartment is the same square footage as before. The garage is not a
habitable area.
Mr. Caouette commented that tonight's request from Mr. Wise is only to define a major or minor modification.
Mr. Wise disagreed; he stated he was requesting the ZBA to vote on the modification tonight.
Mr. Hagstrom said the proposal will not impact the analysis that the Special Permit was granted under.

Mr. Redfern said there is no guidance in the bylaws to determine a minor or major modification on a Special
Permit. He said the PRD and PUD guidelines have no relevance to this district, and a decision would be a
personal opinion.
Mr. Wise read the draft legal settlement with the abutter who is appealing the Special Permit. The Board
discussed adding conditions to the minor modification.
Mr. Wise agreed the project will not be started until the resolution of the litigation is satisfied.
On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to grant the
petitioner's request for a minor modification as granted by the Board and previously referenced by the plan
revised on September 14, 2015. Conditions were imposed: formal sign off and approval by the Conservation
Commission of the proposed amended plan; and formal notification from the Board of Selectmen relating to the
abandonment of the second curb cut, removed in Exhibit A.
Vote was 5 -0 -0 (Redfern, Traniello, Jarema, Caouette, Hagstrom).
