Wise, Trustee, who seeks a Special Permit under Section(s) 5.3.2 & 5.4.7.2 of the zoning bylaws in order to make alterations and construct an addition to the existing single family dwelling and to create an Accessory Apartment on the property located at 181 South Street in Reading, Massachusetts.) The Zoning Board of Appeals held a meeting to re- consider the decision for ZBA Case #15 -04, 181 South Street, that was made on April 16, 2015. The Board discussed why it was requested they re- consider the decision that was made at the April 16, 2015 meeting. The law requires at least 4 members to approve a Special Permit. Mr. Redfern said he has signed the certification in regards to the Mullin Law. He reviewed the tape and is capable of voting on this particular case. On a motion made by Mr. Traniello, seconded by Mr. Caouette, the Zoning Board of Appeals moved to reconsider the vote of April 16, 2015 to correct a procedural defect under the recommendation of Town Counsel. Vote was 5 -0 -0 (Redfern, Jarema, Traniello, Caouette, Hagstrom). On a motion made by Mr. Caouette, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to approve the Special Permit on Case #15 -04 for the accessory apartment at 181 South Street, Reading, MA on the petition of Mr. Wise. Page 1 1 Mr. Jarema explained why he previously voted opposing the accessory apartment. He stated the accessory apartment does not meet all the qualifications under section 5.3.2 of the zoning bylaw. The 2nd unit is not a complete separate housekeeping unit. He proposed a condition on the motion that if the petitioner intends to rent out the unit they would have to come back to the Zoning Board of Appeals for approval. Mr. Traniello said he is not in favor of a condition to limit the property owner on what he can do after issuing a Special Permit. Mr. Hagstrom said he is satisfied with the bylaw. The Special Permit will not transfer to a new owner when the property is sold. Mr. Caouette agreed a condition is not necessary. Mr. Redfern agreed with the majority of the Board. The petitioner has met all requirements for an accessory apartment as written in the Town bylaws. Mr. Jarema questioned if the accessory apartment would qualify for count towards the 10% affordability unit. The Board agreed section 5.4.7 can be referenced in the motion. Mr. Wise stated the new plot plan is for the Building Inspector's requests. Mr. Caouette amended the motion that was previously made to change the reference to only Sections 5.4.7 and 5.3.2. Mr. Hagstrom seconded the motion. Vote was 4 -1 -0 (Redfern, Traniello, Caouette, Hagstrom in agreement, Jarema opposed). Adjournment On a motion made by Mr. Traniello, seconded by Mr. Caouette, the Zoning Board of Appeals moved to adjourn the meeting at 7:40 p.m. Vote was 5 -0 -0 ( Traniello, Jarema, Redfern, Caouette, Hagstrom).
