Case # 15 -05
The Zoning Board of Appeals held a Public Hearing on the petition of David Chuha who seeks a
Variance under Section(s) 5.1.2 /5.2.1(a) / 5.2.1 (b) / 5.2.1 (c) / 5.2.2 of the zoning bylaws in
order to construct a single family dwelling on a non - conforming lot on the property located at 50
Lothrop Road in Reading, Massachusetts. This was a prior Variance Case that has lapsed (see
ZBA Case # 12 -11).
Mr. Caouette reminded the petitioner that due to only having four members present at the
meeting a unanimous vote would be needed to grant the Variance.
Mr. Chuha explained he was unaware that the original permit had expired. Mr. Redmond told
him he would need to come back to the Zoning Board of Appeals for approval. He would like to
get started on the project with the initial variance.
Mr. Caouette read Mr. Redmond's memorandum.
Mr. Hagstrom said the petitioner provided a reasonable response to why the permit lapsed.
Mr. Jarema stated the Zoning Bylaw has changed since the original variance. The sections cited
are now different. Mr. Jarema asked the petitioner to state the four criteria why the variance
should be granted. Mr. Chuha answered that the original justification was done by Mr.
Hechenbleikner and Town Counsel as the Town owned this property when the original variance
was granted. Mr. Chuha bought the property from the Town of Reading. He said he would just
like the same variance as was issued to the Town.

Mr. Caouette stated the current Zoning Bylaw sections that now apply to this petition. He
questioned the wording on the proposed site plan.
Mr. Chuha stated the Architectural plans might change. After a discussion, it was agreed even
though the Architectural plans might change they need to be referenced in the vote.
On a motion made by Ms. Hackett, seconded by Mr. Hagstrom, the Zoning Board of Appeals
moved to approve the Petitioner's request under Sections 6.2.1, 6.22 and 6.3 of the Zoning
Bylaws for the property located at 50 Lothrop Road in Reading as shown on the proposed site
plan to construct a single family dwelling on a non - conforming lot on the property.
The Variance is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
3. As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
Vote was 4 -0 -0 to approve the Variance (Caouette, Jarema, Hackett. Hagstrom).

On a motion made by Mr. Jarema, seconded by Mr. Hagstrom, the Zoning Board of Appeals
moved to approve the April 2, 2015 minutes as amended.
Vote was 4 -0 -0 (Caouette, Jarema, Hackett, Hagstrom).
Other Business
The members agreed to discuss "Robert's Rules of Order" when there was a full Board present.
Adjournment
On a motion made by Mr. Jarema, seconded by Ms. Hackett, the Zoning Board of Appeals
moved to adjourn the meeting at 7:30 p.m.
Vote was 4 -0 -0 (Caouette, Jarema, Hackett, Hagstrom).
