Topics of Discussion: Case # 15 -02 The Zoning Board of Appeals continued the Public Hearing on the petition of Carolyn A. Parker who seeks a Variance under Section 6.3.3/6.2.5.e of the Zoning Bylaws in order to remove 6 manual pump toppers and to install 6 LED pump toppers with "Smart Pay" alternators on the property located at 303 Salem Street in Reading, Massachusetts. Ms. Parker reviewed her petition. She stated she received approval from the Community Planning and Development Commission and was issued a Certificate of Appropriateness. Mr. Redfern read the CPDC Certificate of Appropriateness conditions. Mr. Redmond explained why he denied Ms. Parker's sign application and requested she seek a Variance. The Board discussed the CPDC decision. Mr. Traniello questioned if the LED lights will have a Christmas light effect. Ms. Parker answered the lights will stay static. Mr. Jarema discussed the State sign regulations. He also commented the Zoning Bylaw was re- codified and the Variance request has changed. Mr. Caouette asked Ms. Parker how many other towns allow Cumberland Farms to have the LED pump toppers with Smart Pay. He commented on gas stations who are allowed to utilize the LED pump toppers. Page I 1 There was no public comment. Ms. Hackett questioned what section should be referenced. After Mr. Traniello read Section 40A, the Board agreed the section from the new Zoning Bylaw should be referenced. On a motion made by Ms. Hackett, seconded by Mr. Traniello, the Zoning Board of Appeals moved to approve the Petitioner's request under Sections 8.2.3 and 8.2.5.3 of the Zoning Bylaws to remove the price and signage and install 6 standard LED pumps that have a non - flashing static display. Vote was 5 -0 -0 to approve the Variance (Traniello, Jarema, Redfern, Caouette, Hackett). Mr. Jarema asked what would happen if Fairhaven, aka Cumberland Farms, sells the property. The Board discussed and agreed a new gas station would have to comply with the Variance. Minutes ZBA Meeting January 15, 2015 On a motion made by Mr. Caouette, seconded by Ms. Hackett, the Zoning Board of Appeals moved to approve the January 15, 2015 minutes as amended. Vote was 5 -0 -0 (Traniello, Jarema, Redfern, Caouette, Hackett). ZBA Meeting March 5, 2015 Motion made by Mr. Traniello, seconded by Mr. Caouette, to approve the March 5, 2015 minutes as amended. Vote was 5 -0 -0 (Traniello, Jarema, Redfern, Caouette, Hackett). Adjournment On a motion made by Mr. Traniello, seconded by Mr. Caouette, the Zoning Board of Appeals moved to adjourn the meeting at 7:40 p.m. Vote was 5 -0 -0 (Traniello, Jarema, Redfern, Caouette, Hackett).
