Case # 15 -01
The Zoning Board of Appeals held a Public Hearing on the petition of MBA Building
Group /Allen Carpenella, who seeks a Special Permit under Section 6.3.8 of the zoning bylaws in
order to construct a new single family dwelling on a non - conforming lot in an S -20 district on
the property located at 92 Curtis Street in Reading, Massachusetts.
The Board questioned the address. The agenda stated 92 Chute Street. Mr. Carpenella confirmed
it was 92 Curtis Street.
Mr. Sullivan represented the petitioner. The proposed dwelling will be a four bedroom, 1-1/2
story with a 2 car garage. It will conform to the zoning bylaw. It meets the setbacks, matches
the existing location, and the existing curb cut will be used.
Mr. Peter Sulkins of 84 Curtis Street questioned why he wasn't notified. After investigating, it
was noted the property owner was notified correctly.
Mr. Redmond stated this project is a typical tear down and rebuild. It conforms in all aspects for
a Special Permit. He reminded the Board that the Attorney General still needs to approve the
zoning changes. Once the Attorney General approves, the Building Inspector will be able to
approve.
Mr. Redfern questioned if the older dwelling had been demolished. Mr. Redmond stated yes, a
demolition permit was issued. The contractor was going to build on the same lot when the

building permit is issued. Mr. Sullivan commented that the petitioner realized they took a risk in
demolishing the older dwelling before he was issued a permit to rebuild.
Mr. Traniello and Ms. Hackett had no questions.
Mr. Jarema questioned the rear of the lot and if fill would need to be brought in. Mr. Redmond
answered Engineering will need to approve any grade change.
Mr. Jarema questioned the height of the roof area. Mr. Sullivan stated there is a new plan. The
pitch changed from 12 to a 10 pitch.
Mr. Jarema commented the neighborhood homes are small Cape Cods. Mr. Sullivan answered
the proposed dwelling will match the neighborhood from the front. The height will be in the back
of the property.
Mr. Caouette commented the project is straight forward.
Mr. Redfern said he had no issues with the dwelling. The dwelling will fit into the
neighborhood.
Mr. Sulkins of 84 Curtis Street questioned the proposed dwelling. Mr. Carpenella gave him a
copy of the plan. Mr. Sulkins had no further concerns.
Mr. Redfern closed the public comment section of the meeting.
On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals moved to
grant the Applicant a Special Permit in order to construct a new single family dwelling on a legal
non - conforming lot located in an 5 -20 zoning district on the property as depicted on the
referenced Certified Plot Plan and Architectural Drawings.
The Special Permit is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
3. As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
Vote was 5 -0 -0 (Redfern, Caouette, Jarema, Hackett, Traniello).
Case #15 -02
The Zoning Board of Appeals held a Public Hearing on the petition of Carolyn A. Parker who
seeks a Variance under Section 6.3.3/6.2.5.e of the zoning bylaws in order to remove 6 manual
pump toppers and to install 6 LED pump toppers with "Smart Pay" alternator on the property
located at 303 Salem Street in Reading, Massachusetts.

Ms. Parker represented the petitioner. She said Cumberland Farms would like to advertise to the
customers that if they were a member of the Smart Pay Program they would get a $.10 discount
off of the cost of the gas. Ms. Parker said they would like to install LED pump toppers. The
advertisement is meant for the customer and will not be seen from the road. The brightness can
be changed. She stated that other towns are allowing a layer of film to be installed to diminish
the brightness. She also commented that the pump toppers allow the employee in the office to
change the price of the gas.
Mr. Jarema stated for clarification, the agenda should have stated Section 6.2.3 and not 6.3.3. He
also questioned if the petitioner should have gone to the CPDC for a Certificate of
Appropriateness before meeting with the Building Inspector. Mr. Jarema read Section 6.2.6.4.1
of the zoning bylaw specified for the Business B District.
Mr. Redmond apologized for overlooking this section of the bylaw. He agreed that CPDC needs
to approve the design. He said the petitioner will still need relief from the ZBA; CPDC will not
issue a variance.
Mr. Redfern questioned if the new bylaws will revamp the signage bylaw. Mr. Traniello stated
none of the articles spoke about signs at the November town meeting.
Mr. Redfern explained the options available to Ms. Parker.
Mr. Anthony D'Arezzo of 130 John Street questioned if the LED signs will have commercials
with sound. Ms. Parker answered there will be no messages or sounds. The LED signs will just
be for prices.
Ms. Parker asked for a continuation of the hearing until February 5, 2015.
On a motion by Mr. Traniello, seconded by Mr. Jarema, the Zoning Board of Appeals approved
the continuation of Case #15 -02 to February 5, 2015 to allow Ms. Parker time to get the approval
of CPDC before returning to the ZBA.
The vote was 5 -0 -0 (Redfern, Caouette, Jarema, Hackett, Traniello).

On a motion made by Mr. Caouette, seconded by Mr. Hackett, the Zoning Board of Appeals
moved to accept the minutes of December 4, 2014 as amended.
Vote was 5 -0 -0 ( Redfem, Jarema, Caouette, Hackett, Trardello).
ZAC Report
Mr. Tramello stated the ZAC charter expires February 28, 2015. The final meeting will be
January 28, 2015.
