Topics of Discussion: Case # 14 -21 The Zoning Board of Appeals will hold a Public Hearing on the petition of John Comfier who seeks a Variance under Sections 5.0 / 5.1.2 of the zoning bylaws in order to construct an addition (farmers porch) 6.0' x 26.0' to the front of the dwelling with a setback of 17.8' rather than the 20.0' required on the property located at 22 Elliott Street in Reading, Massachusetts. Mr. Traniello questioned if the hearing should be discussed. He stated the posting of the hearing does not meet the Petitioner's request. The Building Inspector overlooked the side yard variance in the legal notice. Mr. Redfern stated he saw the email regarding the Building Inspector's omission, but questioned if the petitioner would need a side yard variance. He commented the case should be heard. Mr. Jarema stated he would like to hear from the immediate abutters who would be impacted by the porch. He commented the setback issue may require a Special Permit. He questioned the increased footage of the lot. Mr. Traniello reiterated his concern with the notice and not giving the Petitioner complete relief Ms. Hackett agreed with Mr. Traniello. Mr. Caouette commented the application does not say anything about extending a non- confirming lot. He would like to look at the application as a whole. Page 1 1 Mr. Hagstrom agreed, the project should be re- advertised and handled all at once After a discussion, the Board asked the Petitioner if he would withdraw his application without prejudice and allow the Town to re- advertise under an entirely new case. This will allow the abutters to be notified correctly. Mr. Cormier stated he will withdraw his application and agreed to be heard at the December 4 meeting. Motion made by Mr. Traniello to accept the petitioners request to withdraw the application without prejudice. Ms. Hackett seconded. Vote was 5 -0 -0 (Redfern, Caouette, Hackett, Jarema, Traniello) Case #14 -20 Continuation of a Public Hearing on the petition of Kieran O'Sullivan who seeks a Variance under Section 5.0 / 5.1.2 of the zoning bylaws in order to add a two car garage to the left side with a proposed setback of 10.3' rather than the 15' required, as per plans submitted, on the property located at 31 Curtis Street in Reading, Massachusetts. Ms. Hackett recused herself. Mr. Hagstrom submitted the paperwork certifying he viewed the video of the last meeting. Mr. Hagstrom said the Board has received a revised plot plan with the reduced dimensions. This complies with what the Board was looking for. Mr. Caouette commented the petitioner did a good job; the garage fits within the neighborhood. Mr. Jarema reviewed the changes made on the plot plan. He commented the petitioner is justified on what he is trying to accomplish. Mr. Traniello had no comment. Mr. Redfern said the plan now agrees with the architectural plan. He commented the petitioner meets all 4 criteria's. The petitioner loses half of the use of his land due to wetlands. On a motion made by Mr. Caouette, seconded by Mr. Hagstrom, the Zoning Board of Appeals moved to grant the petitioner a Variance under Section 5.0/5.1.2 of the Zoning Bylaws in order to add a car garage on the property located at 31 Curtis Street, Vote was 5 -0 -0 (Redfern, Jarema, Caouette, Hagstrom, Traniello). Adjoumment On a motion by Mr. Traniello, seconded by Mr. Caouette the Zoning Board of Appeals moved to adjourn the meeting at 7:40 p.m. Vote was 6 -0 -0 ( Traniello, Jarema, Redfern, Caouette, Hackett, Hagstrom) Page 1 2
