CALL TO ORDER, OLDINEW BUSINESS - 7:00
Enforcement Order, 5 Johnston Circle, Melkonian, Contractor requested to attend the meeting
Ms. Scanlon talked with Mr. Pacy regarding the enforcement order issued to him for 5 Johnston Circle. Mr.
Pacy explained his position on why he cut down the tree. She asked if he was willing to take a webinar to make
him aware of the importance of the wetlands. Mr. Maughan asked if arbodsts are licensed and how could the
Commission contact the contractors on the list. He will forward the website to Mr. Tirone. He stated he will
look into the webinar and follow up with the Commission if he will take the class.
RDA 14 -12: 112 Colonial Drive, Map 40, Lot 147, Mirogiannis
The applicant questioned if all 8 items that he would like to do could be fled under one RDA? He staled the
pool and decking would be the first of the projects. The Commission discussed the different projects. The
Commission talked about Ms. Scanlon's concern on the design of the wall between house and pool. Mr. Finch
asked the detailed plans of this wall be forwarded to the Commission, if they are needed by the building
inspector. Mr. Tirone will sign off on the drainage plan if needed.
Motion made by Mr. Maughan to issue a negative determination for RDA 14.12. Mr. Sullivan seconded.
Vote was 6.0 -0.
The Commission agreed a separate filing would be needed for a wall down gradient from the pool.

Ms. Scanlon opened the public hearing. The applicant stated she would like permission to demolish the
bxisting addition on her house. This addition has no foundation. She would like to build a new 2 story addition
with a foundation and an enclosed porch. Mr. Tirone answered Mr. Maughan's question on why he advised the
applicant to file a NOI even though the project is a smaller footprint and 77' away from the wetlands.
Motion made by Mr. Finch to close the public hearing for NO6270 -0632. Mr. Sullivan seconded. Vote
was 6 -0 -0.
Motion made by Mr. Maughan to Issue an order of conditions that re0ects the application for 7Indiana
Avenue. Mr. Finch seconded. Vote was 6 -0.0.
NOI 270 -0631: 164 Green Street, Map 17, Lot 216, Brenner
Mr. Tirone stated Mr. Manuell will not be here until the end of the meeting.
Motion made by Ms. Scanlon to continue the public hearing until Mr. Manuell arrives. Mr. Sullivan
seconded. Vote was 4.0-0.
Continued NOI 270 -0630: 152 -156 Walnut Street, Map, 4 Lots, 101 8 102, DPW- Engineering Division
Ms. Scanlon reopened the public hearing. Mr. Zambouras stated as the Commission requested from the last
meeting, the current plan shows an open swale. The Commission discussed the new plan. Mrs. Fitzpatrick
had concerns about the open Swale attracting mosquito's and if there was any type of plants that would repel
mosquito's. Ms. Fitzpatrick questioned if the new plan would stop the flooding. She suggested another catch
basin be installed. The elevation and plan design was discussed with the Commission and Mr. Zambouras.
The abutters asked what could be done if the flooding still happens after the Town completes the project. Mr.
Tirone suggested taking pictures and present them to the Town.
Motion made by Mr. Maughan to continue the public hearing for NOI 270.0630. Ms. Scanlon seconded.
Vote was 8 -0 -0.
Motion made by Mr. Maughan to Issue an order of conditions per revised plans dated July 28, 2014.
Ms. Scanlon seconded. Vote was 6 -0 -0
NOI 270 -0631: 164 Green Street, Map 17, Lot 216, Brenner
Ms. Scanlon reopened the public hearing. Mr. Manuell represented the applicant. They would like to construct
a new addition on the left side of their home. He discussed the property, flagging and erosion control. Mr.
Manuell stated he will leave the approved hay bale location up to Mr. Tirone and the contractor. Mr. Maughan
reminded the applicant that no cutting of healthy trees will be allowed between the proposed addition and
wetlands. Mr. Tirone asked that both catch basins in the street to be protected, The fill from the foundation
hole will not be stockpiled it will be hauled away.
Motion made by Mr. Maughan to continue the public hearing for NOI- 270.0631 until August 27, 2014.
Ms. Scanlon seconded. Vote was 6-0-0.
Motion made by Mr. Maughan to issue an order of condition's with regards to the discussion of
stockpiling and excavation material. Ms. Scanlon seconded. Vote was 6 -0 -0.
Continued NOI 270 -0629: 37 James Road, Map 6, Lot 38, Fucarile
Ms. Scanlon reopened the public hearing. Mr. Tirone reviewed the special conditions that Mr. O'Connell
requested for the order of conditions. After a discussion with the applicant, the order of conditions was edited
by the Commission. The Commission discussed why the findings do not mention allowing the project for
accommodations for ADA, They agreed the applicant met all requirements, the accommodations were not
needed.
Motion made by Mr. Maughan to approve the order of condition's as amended. Mr. Sells seconded.
Vote was 6.0.0.
Motion made by Mr. Finch to close the public hearing for 37 James Road. Ms. Scanlon seconded. Vote
was 6 -0.0.
Old /New Business
Emergency Easement Work —Walkers Brook Drive
Mr. Slrazzere talked with the Commission about the emergency road the Town had to install. Two machines
got stuck by the railroad tracks while they were trying to maintain the sewer and water easement. The
Commission discussed the road and what should be done with it now. They agreed removing the stone will
create more of a problem. Mr. Tirone expressed his concern that he was not notified when it happened. Mr.
Zambouras will see if this project falls under the sewer and water work general permit. Mr. Zambouras agreed
to look into swamp mats and other options for this road within the next two months.
Mr. Tirone questioned if the DPW could let him know in advance work that will be done around wetland areas.
He stated there is a meeting next Tuesday with the DPW and this request will be discussed.
Minor Project: 112 Colonial Drive,
Motion made by Ms. Scanlon to refund the $50.00 to the owner. Mr. Finch seconded. Vote was 6 -0 -0.

34 Oak Street Discussion, Conway
Mr. Tirane stated the owner continued this discussion. He will be in at the next meeting.
Timberneck Swamp Conservation land, signage —
The Commission discussed posting a sign in Timberneck Swamp stating no hunting. After a discussion, it was
agreed no action will be taken, they do not have jurisdiction.
Tree service and Arborist letter, Discussion -
The Commission reviewed the list of arbonsts. Mr. Tirone will edit cover letter and do a mailing to them.
Motion made by Mr. Maughan to send the letter to the list of arborists. Mr. Sells seconded. Vote was 6-
0-0.
The Commission discussed an enforcement order policy. Mr. Tirone would like to give property owners and
contractors one if work was done without a permit. Mr. Maughan was.concemed there was not a written policy
and would like to see one before approving.
Aker a discussion, motion made by Mr. Sullivan to authorize an enforcement order to both owner of the
property and contractor if work is being done without authorization. Ms. Scanlon seconded. Vote was
5-1 -0.
29 Gavin Circle restoration enforcement order
Mr. Tirone passed out the order that will be issued for 29 Gavin circle. The Commission discussed and agreed
to add monitoring evasive and to report back within a year to the order.
Motion made by Ms. Scanlon to ratify the enforcement order as amended. Mr. Sells seconded. Vote
was 6 -0-0.
Conflict of Interest and Ethics Online Training -
Mr. Tirone reminded the Commission everyone needs to take this training.
Conservation Land mowing list —
The Commission agreed Lobbs Pond and Bare Meadow should be mowed. If the signs for Castine Field were
posted was questioned. Mr. Maughan suggested not mowing Castine Field this year, if not already done.
Confirmation Vote for deletion of the Wetlands Overlay District In the Zoning Bylaw
Motion made by Ms. Scanlon to confirm the deletion of the Wetlands Overlay District in the Zoning
Bylaw. Mr. Sells seconded. Vote was 5 -0 -1
Peter Sanborn Place follow up, Jacqui Carson
After a discussion, the Commission agreed they would like to do a site visit. They would like the applicant to
submit a plan before the visit. They questioned how the poison ivy would be removed and how close would the
project be to the resource area.
Administrators Report:
Mr. Trone let the Commission know the Town website is still causing havoc. He is working on ways to let the
public know the GIS is not official.
Bills Approved: No Bills
Minutes for approval: July 23, 2014
Motion made by Mr. Maughan to approve the minutes of July 23, 2014. Ms. Scanlon seconded. Vote was 6 -0-
0.
Mr. Maughan requested that in a month the Commission votes for a new chairman and vice chairman. Mr.
Tirone asked if the chair could hold a 2 year seat. He talked about working with the chair and having
consistency.
Mr. Finch stated he met with Mr. Lee regarding the boardwalk. He questioned why the boardwalk design was
changed. He disagreed with the Commission that pipes should be used.
Motion made by Ms. Scanlon to adjourn at 12:00 a.m. Mr. Sullivan seconded. Vote was 5 -0-0
