Ms. Scanlon announced that the applicant for 364 Lowell Street has requested the meeting to be
postponed to July 91h
• Dustin Road, Tree Cutting
The Commission agreed this was taken care of at their site visit to the property

• Eagle Scout Project, Lee
Mr. Lee stated he went to the Trails and Forest Committee in March to get approval to rebuild a
boardwalk in the Town Forest. The Committee's recommended he get approval from the Conservation
Commission as well. Ms. Scanlon asked that he contact the Conservation Administrator; additional
paperwork is needed.
NOI 270 -0629: 37 James Road, Map 6, Lot 38, Fucarile
Ms. Scanlon opened the Public Hearing. Mr. O'Connell representing the applicant, presented existing
condition, grading and drainage plans. The applicant would like to renovate a single family home and
yard to bring it up to ADA compliant. The yard will have a 3 to 1 slope. This will allow the space for the
wheel chair. He acknowledged the Enforcement Order received on May 16`h. Mr. Fucarile stated he
did contact the Town Hall before he bought the house and afterwards to get approval from
Conservation in regards to cutting down the trees. Mr. O'Connell presented a timeline on the project.
He stated the applicant is only asking for a waiver of the fee, not for any other part to the project. Ms.
Scanlon questioned if there was an alternative to move the structure (rock wall) away from the 25' and
closer to the 35'. Mr. Finch agreed with Ms. Scanlon and talked about his concern with the machinery
working so close to the wetlands. Ms. Scanlon asked that the report on the fill be forwarded to the
Administrator.
Mr. Latham represented the owner of 46 South Street. He stated his client has concerns regarding
the tree cutting and grading. The owner lost his privacy and shade. He would like time to review the
plan. Ms. Leasure talked about how the wetlands were created by a previous owner when they cut
down trees and put fill in their yard. Mr. Rubin let the Commission know he was in favor of the project.
Mr. Hecht apologized to the applicant for not letting him know in advance of the site visit; but stated the
contractor was present. Mr. Finch has concerns the fill on top of the trees might kill them. The
Commission agreed they would like to see an alternative or at least a response to the Commission's
request.
Motion made by Ms. Scanlon to continue the Public Hearing for 37 James Street to June 25rn
Mr. Hecht seconded. Vote was 4 -0 -0.
Plan Change, 50 Baystate Road, Tree removal, Carson
Ms. Carson asked the Commission to approve the removal of a couple of evergreen trees. She will
plant in place blueberries, apple trees, sunflowers etc. The Commission discussed if this would be
considered minor plan change or landscape maintenance. The trees are not wetland plants and
should be considered ornamentals. Ms. Scanlon said she will go to the property for a site visit.
29 Gavin Circle, 12 -12 -2013 Enforcement Order Discussion
The homeowners came in and presented a plan to the Commission. The homeowner stated the fill
that was brought in has been removed. He acknowledged the contractor over dug the wetlands. He
would like to put rocks and stones to define the wetland area and smooth out the fill that is there. At a
later date, he would bring in quality loom. He said the Town will not be donating trees as he had
thought. He questioned if a variance would be granted if sought. Ms. Scanlon asked about the planting
plan. She suggested to the homeowner to have John Rockwood help with the plan. The homeowner's
reviewed with the Commission what types of plants would be allowed on the easement. The abutters
shared their concerns. They would like to see the wetlands brought back to what was there previously.
They understand the predicament of the homeowner, but the area is muddy and there is no longer
privacy. Ms. Scanlon cautioned the homeowner DEP has interest in the project. The homeowner
asked to be on the next agenda. At that meeting a planting plan will be available with their variance
request.

Motion made to issue an order of conditions for 303 Salem Street. Mr. Finch seconded. Vote
was 4 -0 -0.
COC 270 -0301, RG131998 -12, Harold Avenue, Mahoney
Ms. Scanlon stated they owners finalized the conservation restriction and is requesting paperwork for a
certificate of compliance. Paperwork is still needed from Mr. Latham. The Commission will sign at the
next meeting.
Bond —Austin Prep
The Commission agreed the transmittal has no impact on what the Conservation Commission
approved.
364 Lowell Street
Mr. & Mrs. Hecht will sign and date the document stating the hearing of the wood frogs. The NHESP
application has been mailed. Mr. Finch will forward a copy to Mr. Tirone.
Minor Project:
1198 Main Street, retaining wall
Motion made by Mr. Hecht to approve a minor project change for 1198 Main Street. Mr. Finch
seconded. Vote was 4 -0 -0.
20 Dean Road, addition
The Commission agreed this was an ideal minor project plan.
Motion made by Mr. Hecht to issue a minor project for 20 Dean Road. Mr. Finch seconded. Vote
was 4 -0 -0.
Administrators Report: Railroad vegetation maintenance notification
Ms. Scanlon stated this notification is informational; nothing to vote on. She contacted the company
regarding the herbicide being used and requested environmentally friendly products.
Open Conservation Commission seats — discussion
Ms. Scanlon let the Commission know she has had a meeting with Mr. LeLacheur and Mr. Zager. She
will be meeting with Ms. Delios next week. She met to establish connections and wanted to
emphasize communication with the Commission before a meeting. She also gave the Town Manager
a write up looking for commission members. She was assured the Selectmen know about the urgency
of needing members.
Bills approved:
Motion made by Mr. Hecht to approve the $16.51 Water and Sewer bill for Pearl Street. Mr.
Finch seconded. Vote was 4 -0 -0.
Motion made by Mr. Hecht to approve the MA CC membership dues for July 1, 2014 -June 30,
2015 of $690. Mr. Finch seconded. Vote was 4 -0 -0.
Ms. Scanlon stated the dues are a fixed fee regardless of the membership count
Donation from Sam Rodda
A donation was made from Mr. Rodda, money left over from his Eagle Scout project. The account now
has $22.47.
Minutes for approval: May 28, 2014
Motion made by Mr. Finch to close without prejudice 306 Main Street. Mr. Hecht seconded.
Vote was 4 -0 -0.
Motion made by Mr. Hecht to approve the minutes from the May 28, 2014 meeting as amended.
Mr. Finch seconded. Vote was 4 -0 -0.
The Commission said good bye to Mr. Hecht and thanked him for his service to the
Conservation Commission.
