To either of the Constables of the Town of Reading, Greetings: In the name of the Commonwealth of Massachusetts you are hereby required to notify and warn the inhabitants of the Town of Reading qualified to vote in elections and town affairs to meet at the Reading Memorial High School, 62 Oakland Road in said Reading, on Monday, November 9, 1981, at eight o'clock in the evening to act on the following articles: ARTICLE 1. To hear and act on the reports of the Board of Selectmen, Town Accountant, Treasurer, Collector of Taxes, Board of Assessors, Board of Public Works, Town Clerk, Tree Warden, Board of Health, School Committee, Contributory Retirement Board, Library Trustees, Municipal Light Board, Finance Committee, Cemetery Trustees, Planning Board, and any other Board or Special Committees. Board of Selectmen ARTICLE 2. To choose all other necessary Town Officers and Special Committees and determine what instructions shall be given Town Officers and Special Committees. Board of Selectmen ARTICLE 3. To see if the Town will vote to amend "Schedule A - Classification Plan" of Article XXIV of the By -Laws of the Town under non - exempt positions, G. Custodial Class, by deleting "Janitor, pay grade 4" and inserting "Custodian, pay grade 5 ", or what it will do in respect thereto. Board of Selectmen ARTICLE 4. To see if the Town will vote to amend "Schedule A - Classification Plan" of Article XXIV of the By -Laws of the Town under Exempt Positions, D. General Government Class, by deleting "Executive Secretary, Pay Grade 11" and inserting "Executive Secretary, Pay Grade 12 ", or what it will do in respect thereto. Board of Selectmen ARTICLE 5. To see what sum the Town will raise by borrowing or transfer from available funds or otherwise and appropriate for the Town's membership in the Massachusetts Municipal Association, said funds to be expended under the direction of the Board of Selectmen or take any other action with respect thereto. Board of Selectmen ARTICLE 6. To see if the Town will authorize the Board of Cemetery Trustees to sell or exchange, or otherwise dispose of, upon such terms and conditions as they may determine, One (1) 1965 Dodge Truck Chassis, and to see what sum the Town will raise from transfer of available funds, or otherwise and appropriate, for the purchase of One (1) 2 -Ton Truck Chassis, said vehicle to be used by the Board of Cemetery Trustees, or take any action in respect thereto. Board of Cemetery Trustees ARTICLE 7. To see if the Town will adopt Chapter 90, Section 20A or Section 20A -%Z of the Massachusetts General Laws or take any other action with respect thereto. Board of Selectmen ARTICLE 8. To see what sum the Town will raise by borrowing or transfer from available funds or otherwise and appropriate for the purpose of implementing Chapter 90, Section 20A or Section 20A %z of the Mass. General Laws or take any other action with "`- respect thereto. Board of Selectmen ARTICLE 9. To see if the Town will establish a committee to be appointed by the Board of Selectmen, but which will include a member of the Board of Selectmen, the Board of Library Trustees, the Recreation Committee, and the Board of Public Works for the purpose of producing plans and costs for converting the Highland School property for the Town's use as a library and other Town department functions, and to expand the present Town Hall's use through renovation and the annexing and conversion of the present Library for municipal offices, and to see what sum the Town will raise by borrowing, or transfer from available funds, or otherwise and appropriate to be expended by the committee to hire consulting engineers, architectural services, plans and surveys and other expenses needed to accomplish the committee's purpose, or take any other action with respect thereto. Board of Selectmen 346 Subsequent Town Meeting Warrant November 9, 1981 ARTICLE 10. To see if the Town will vote to reorganize the Advisory Committee on Hazardous Waste authorized by vote under Article 37 of the Warrant for the 1980 Annual Town Meeting so that the Committee shall be composed of not less than eleven citizens of the Town of Reading to be appointed by the Board of Selectmen on or before June 30, 1982. The Advisory Committee shall advise the Selectmen regarding all aspects of the continuing development and removal of hazardous waste at the Industri -Plex 128 site in Woburn, and advise the Selectmen on other hazardous waste issues which may affect the Town of Reading, or take any other action with respect thereto. Board of Selectmen ARTICLE 11. To see what sum the Town will vote to raise, borrow or transfer from available funds or otherwise and appropriate for the purpose of purchasing Ballot Counting Equipment for the Town Clerk, or take any other action with respect thereto. Town Clerk ARTICLE 12. To see if the Town will vote to increase the membership of the Board of Selectmen of the Town of Reading from three to five members, or what it will do in relation thereto. By Petition ARTICLE 13. To see what sum the Town will vote to borrow, transfer from available funds or otherwise and appropriate for the purchase and /or lease and /or lease purchase of computer equipment and /or related services for the various Town departments or take any other action with respect thereto. Board of Selectmen ARTICLE 14. To see what sum the Town will vote to raise by borrowing, or from the Tax Levy, or transfer from available funds, or otherwise, and appropriate for the refurbishing of the Reading Memorial High School Varsity Football Field and for the conversion of the existing cinder track to an all- weather resilient - surface track and field events area, with appropriate crowd control fencing, drainage and maintenance systems, and including all engineering fees and preparation costs, or take any other action with respect thereto. School Committee ARTICLE 15 To see what sum the Town will raise and appropriate by borrowing, or from the tax levy, or transfer from available funds, or otherwise for an athletic field at RMHS entailing an all weather resilient track and field events area, football field refurbishment, fencing for crowd control including engineering and preparation or what the Town will do in relation thereto. By Petition ARTICLE 16. To see what sum the Town will raise by borrowing, or transfer from available funds, or otherwise; and appropriate for the purpose of renovations and improvements on the Ethel Grant Municipal Pool. All monies to be expended under the direction of the Recreation Committee or take any other action with respect thereto. Recreation Committee ARTICLE 17. To see if the Town will vote to accept the report of the Board of Public Works upon the relocation or alteration of the Public Highway on the Northerly side of Franklin Street at Collins Avenue under the provision of law authorizing the assessment of betterments, such relocation and alteration being laid out in accordance with plan duly approved by the Board of Public Works and filed in the Office of the Town Clerk in accordance with the statutory requirements and to see if the Town will accept the relocation and alteration of Franklin Street laid out by the Board of Public Works and to see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds or otherwise, and appropriate for the construction of said relocation or alteration, or what it will do in relation thereto. Board of Public Works ARTICLE 18. To see if the Town will vote to accept the report of the Board of Public Works upon the relocation or alteration of the Public Highway on the Westerly side of Pearl Street opposite number 651 Pearl Street under the provisions of law authorizing the assessment of betterments, such relocation and alteration being laid out in accordance with plan duly approved by the Board of Public Works and filed in the Office of the Town Clerk in accordance with the statutory requirements and to see if the Town will accept the relocation and alteration of Pearl Street laid out by the Board of Public Works and to see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds or otherwise, and appropriate for the construction of said relocation or alteration, or what it will do in relation thereto. Board of Public Works ARTICLE 19. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purpose of improving Subsequent Town Meeting Warrant November 9, 1981 347, and reconstructing Town Public Ways, such sums to be spent by and under the direction of the Board of Public Works and in such locations as the Board of Public Works may deem advisable, or take any other action with respect thereto. Board of Public Works ARTICLE 20. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purpose of making improvements to the water system, including the engineering services, construction and reconstruction of the water distribution systems, the installation of pipe, fittings, equipment and related facilities, or take any other action with respect thereto. Board of Public Works ARTICLE 21. To see what sum the Town will raise by borrowing, or from the tax levy, aum or transfer from available funds, or otherwise, and appropriate for the purpose of maintaining, improving and constructing facilities in the Parks and Playgrounds, or take any other action with respect thereto. Board of Public Works ARTICLE 22. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purpose of constructing and reconstructing drainage facilities, such sums to be spent by and under the direction of the Board of Public Works and in such locations as the Board of Public Works may deem advisable, or take any other action with respect thereto. Board of Public Works ARTICLE 23. To see whether the Town under and pursuant to authority granted in General Laws Chapter 40D, Section 21 (g), as amended, will authorize the Board of Public Works to enter into a contract with the operator of solid waste disposal facilities to be established in the Town of North Andover for the use of by- products resulting from the operation of such facilities, which contract will: (1) Be for a term of twenty years, more or less; (2) Include provisions for the delivery of minimum amounts of refuse, garbage and waste and payments for the use of the facilities to be based thereon; (3) Provide for unit prices that will be graduated and for adjustments thereof and for the use of steam, electricity and other by- products resulting from the use of OW— the facilities and for credits or payments of the Town resulting therefrom; (4) The use by the Town or other municipalities of the uncommitted capacity of such facilities; (5) Contain other provisions incidental and related to the foregoing general matters; and (6) Be generally in the form of proposed contract negotiated by representatives of the member communities of the Northeast Solid Waste Committee (NESWC) with such changes therein as may be approved by said Board of Public Works or take any other action with respect thereto. Board of Public Works ARTICLE 24. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purpose of improving, constructing and reconstructing Town Public Way in accordance with Chapter 351 of the Acts of 1981 such sums to be spent by and under the direction of the Board of Public Works and in such locations as the Board of Public Works may deem advisable, or take any other action with respect thereto. Board of Public Works ARTICLE 25. To see if the Town will vote to amend the Zoning By -laws by adding the following requirements under Section 4.3.2. - Accessory Uses, as 4.3.2.8.: 4.3.2.8. All swimming pools, wading pools, racquet courts and similar home recreational uses shall be located in the rear yard and shall be subject to the following restrictions and prohibitions: a) No such structure shall be closer than twenty (20) feet to a side or rear lot line; b) No appurtenance thereto shall be closer than ten (10) feet to any street line; c) No such structure shall occupy more than twenty -five (25 %) per cent of the required rear yard area; d) No such structure shall be closer than twenty (20) feet to any street line; and e) Any illumination shall be installed in such a way as not to shine into any near -by housing. Planning Board 348 Subsequent Town Meeting Warrant November 9, 1981 ARTICLE 26. To see if the Town will vote to amend the Zoning By -laws by adding the following under Section 2.0 - Definitions, as items 2.2.26. and 2.2.27. and 2.2.29. and renumbering the present 2.2.26. as 2.2.28. and all following numbers in correct sequential order: 2.2.26. Pool, Swimming: Means and includes every artificial pool of water having a depth of two (2) feet or more at any point and used for swimming or bathing, open or enclosed, together with bath - houses, equipment and /or appurtenances. 2.2.27. Pool, Wading: Means an artificial pool of water in a basin having a maximum depth of less than two (2) feet and intended chiefly as a wading place for children. 2.2.29. Racquet Court: Fixed playing area such as tennis court or racquet ball platform. or take any other action with respect thereto. Planning Board ARTICLE 27. To see if the Town will vote to amend the Zoning By -Laws of the Town by adding the following paragraphs thereto, or take any other action with respect thereto: 4.4A. National Flood Insurance Flood Plain District 4.4A.1. Applicability of National Flood Insurance Flood Plain District Notwithstanding the boundaries of the Flood Plain Overlay District (F) to the contrary, there shall exist a separate National Flood Insurance Flood Plain District (NF) which shall apply to any land defined herein as within the National Flood Insurance Flood Plain District only when the land in question is being improved, developed, or financed pursuant to and in accordance with the provisions of the National Flood Insurance Program and not otherwise. If the National Flood Insurance Program is not involved as aforesaid, then the provisions of this Paragraph 4.4A. will not apply. 4.4A.2 Boundaries of the National Flood Insurance Flood Plain District The boundaries of the National Flood Insurance Flood Plain District shall include all land shown on Exhibits 1, 2, 3, and 4 to the Zoning Map as being withinthe 100 year flood boundary. 4.4A.3. Uses Permitted in the National Flood Insurance Flood Plain District When this paragraph 4.4A. applies, then all otherwise applicable provision of Sections 4.4. and Section 4.5. will also apply except as to any land which is shown as within the National Flood Insurance Flood Plain District but not within the Flood Plain Overlay District (F) otherwise shown on the Zoning Map. With regard to such land not included in the Flood Plain Overlay District (F) but in the National Flood Insurance Flood Plain District any uses otherwise permitted in the zoning district will be permitted provided that all activity complies with the applicable section of the Massachusetts State Building Code which relates to design requirements and construction in Floodplains and Costal High Hazard Areas and provided that no work will be performed in any regulatory floodway, as defined and delineated in "Town of Reading, Massachusetts, Middlesex County, Flood Insurance Study" dated January 2, 1981, a copy of which is on file in the Building Inspector's office. Board of Selectmen ARTICLE 28. To see if the Town will vote to amend the Zoning Map of the Town of Reading by adopting as Exhibits 1, 2, 3 and 4 thereto the plans entitled "Flood Insurance Rate Map, Town of Reading, Massachusetts, Middlesex County" with an effective date of July 2, 1981 consisting of Panel 1 of 4, Panel 2 of 4, Panel 3 of 4 and Panel 4 of 4, copies of which maps are on file with the Town Clerk; and to see if the Town will vote to amend Section 3.2. of the Zoning By -Laws by adding at the end thereof the following language; or take any other action with respect thereto: There shall be appended to the "Reading Zoning Map" as Exhibits 1, 2, 3 and 4 the maps entitled "Flood Insurance Rate Map, Town of Reading, Massachusetts Middlesex County" with an effective date of July 2, 1981 consisting of Panel 1 of 4, Panel 2 of 4, Panel 3 of 4 and Panel 4 of 4. Board of Selectmen ARTICLE 29. To see if the Town will vote to amend Section 3.1. of the Zoning By- Laws by adding under the appropriate columns the following District; or take any other action with respect thereto: Subsequent Town Meeting Warrant November 9, 1981 Type Full Name Short Name Overlay National Flood Insurance Flood Plain District NF Board of Selectmen ARTICLE 30. To see if the Town will vote to amend Section 4.5.2. of the Zoning By- laws of the Town of Reading by deleting that section in its entirety and substituting therefor the following, or take any other action with respect thereto: "The Wetlands Protection District shall be considered as overlying other districts established by this By -law. Any uses permitted in the portion of the districts so overlaid shall be permitted except that no new building or structure shall be erected or constructed, and no dumping or filling or relocation of earth materials shall be permitted other than as specified in paragraphs 4.5.2.7., 8., 9., below, if approved by the Conservation Commission under the provisions of General Laws, Chapter 131, Section 40 and Town of Reading General By -laws, Article 32:" Conservation Commission ARTICLE 31. To see if the Town will vote to amend Section 5.3.2.1. of the Zoning By- laws of the Town of Reading by deleting that section in its entirety and substituting therefor the following, or take any other action with respect thereto: "Any portion of a lot within a Wetlands Protection District or Flood Plain District may be credited to the minimum lot area requirements if the portion outside of the Wetland Protection District or Flood Plain District contains at least the following areas: Underlvin2 District Minimum area outside of Overlav District Single Family 10 8,000 square feet Single Family 20 12,000 square feet Single Family 40 20,000 square feet" Conservation Commission ARTICLE 32. To see if the Town will vote to amend the Capital Outlay Plan, as provided for in Article III, Section 11 of the By -laws of the Town, as adopted at the subsequent Town Meeting of November, 1980, and amended at the Annual Town Meeting of April 1981, or take any other action with respect thereto. Finance Committee ARTICLE 33. To see if the Town will vote to adopt a five year Capital Outlay Plan as provided for in Article III, Section 11 of the By -Laws of the Town, or take any other action with respect thereto. Finance Committee And you are directed to serve this Warrant by posting an attested copy thereof in at least three (3) public places in each precinct of the Town not less than fourteen (14) days prior to November 9, 1981, the date set for the meeting in said Warrant, and to publish this Warrant in a newspaper published in the Town or by mailing an attested copy of said Warrant to each Town Meeting Member at least fourteen (14) days prior to the time of holding said meeting. Hereof fail not and make due return of this Warrant with your doings thereon to the Town Clerk at or before the time appointed for said meeting.
