To either of the constables of the Town of Reading, Greetings: In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Reading, qualified to vote in elections and Town affairs, to meet in the following places designated for the eight precincts in said Town, namely: Precinct 1. J. Warren Killam School Precinct 2. J. Warren Killam School Precinct 3. Joshua Eaton School Precinct 4. Joshua Eaton School Precinct 5. Community Center Precinct 6. Alice M. Barrows School Precinct 7. Highland School Precinct 8. Memorial High School on MONDAY, the TWENTY -THIRD DAY OF MARCH A.D., 1981 at seven o'clock in the forenoon to act on the following articles, viz; ARTICLE 1. To elect by ballot the following Town Officers: a Moderator for one year; a Town Clerk for three years; one member of the Board of Selectmen for three years; one member of the Board of Assessors for three years; two members of the Board of Public Works for three years; one member of the Regional School District Committee for four years; two members of the School Committee for three years; one member of the Planning Board for three years; one member of the Municipal Light Board for three years; two members of the Board of Library Trustees for three years; one member of the Housing Authority for five years; one member of the Board of Health for three years; one member of the Board of Health for two years; one member of the Board of Health for one year; two members of the Board of Cemetery Trustees for three years; two Constables for three years. Also, in accordance with the provisions of Chapter 7, Acts of 1943, as amended by Chapter 317, Acts of 1975, in each of the eight precincts, the number of Town Meeting members, as hereinafter specified. Eight members for three years; one member for two years to fill vacancy. Precinct 4. Eight members for three years. Precinct 5. Eight members for three years; one member for one year to fill vacancy. Eight members for three years. For these purposes the polls will be opened at each of the eight precincts at seven o'clock A.M. and will close at eight o'clock P.M. on and to meet at the Memorial High School Auditorium, 62 Oakland Road in said Reading MONDAY, the THIRTEENTH DAY of APRIL A.D. 1981 at eight o'clock in the evening, at which time and place the following articles are to be acted upon and determined exclusively by Town Meeting Members in accordance with the provisions of Chapter 7 of the Acts of 1943 as amended by Chapter 317, Acts of 1975. 285.. Town Warrant March 23, 1981 ARTICLE 2. To hear and act on the reports of the Board of Selectmen, Town Accountant, Treasurer, Collector of Taxes, Board of Assessors, Board of Public Works, Town Clerk, Tree Warden, Board of Health, School Committee, Contributory Retirement Board, Library Trustees, Municipal Light Board, Finance Committee, Cemetery Trustees, Planning Board, and any other Boards or Special Committees. Board of Selectmen ARTICLE 3. To choose all other necessary Town Officers and Special Committees and determine what instructions shall be given Town Officers and Special Committees. Board of Selectmen ARTICLE 4. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the care and lighting of the Old South Clock, or take any other action with respect thereto. Board of Selectmen ARTICLE 5. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning July 1, 1981, in accordance with the provisions of the General Laws, Chapter 44, Section 4, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with the General Laws, Chapter 44, Section 17, or take any other action with respect thereto. Town Treasurer ARTICLE 6. Move that the Town keep the Highland Elementary School open and operating as the Highland Elementary School. By Petition ARTICLE 7. To see if the Town will vote to amend "Schedule B - Compensation Plan" of Article XXIV of the By -Laws of the Town by deleting the existing Pay Ranges and substituting the following, or take any other action with respect thereto: EFFECTIVE JULY 1, 1981 `NW. To see if the Town will vote to amend "Schedule A - Classification Plan" of Article XXIV of the By -Laws of the Town by deleting "Library Pages - Pay Grade 1" or what it will do in respect thereto. Personnel Board ARTICLE 9. To see if the Town will vote to amend Section 7 (A) "Sick Leave" of Article XXIV of the By -Laws of the Town as revised through September 1980 by deleting the ... first sentence of the last paragraph and insert in its place: "Effective July 1st, 1980, upon termination, (except termination by the Town for just cause) after seven years of employment, at retirement or death, an employee shall be paid for unused sick leave not exceeding 90 (ninety) days at 50% (fifty per cent) of his daily rate of pay in effect at the time of termination. Before re- employment in any department of the Town, an employee shall be required to repay to the Town an amount equal to that received from the Town at the time of his termination." Personnel Board • Town Warrant ARTICLE 10. To see if the Town will amen Compensation Plans" of Article XXIV of the By -Laws of with respect thereto: "Overtime Compensation" Add the following paragraph: March 23, 1981 d "Section 4 Classification and the Town or take any other action Under conditions which shall be defined by the Board of Public Works as an emergency, and administered by the Superintendent of Public Works, the following exempt employees: Supervisors of Highway, Water and Sewer, Pumping Station, Forestry and Parks; also Senior Civil Engineer, Pumping Station Engineer and Assistant Civil Engineer, may be paid overtime if hours actually worked in any regular work week exceeds forty (40). They shall be paid for all hours worked in excess of forty (40) in any work week at an hourly rate which shall be computed at their weekly salary divided by forty, times one and one -half. Board of Public Works ARTICLE 11. To see if the Town will vote to amend the Zoning By -Laws by adding the following requirements after those established for Retail Stores, Offices and Consumer Service Establishments in Section 6.1.1.3., and under the following tables: Principal Use Minimum Number of Off - Street Parking Spaces Required Restaurants One Space for each sixty (60) square feet of dining area or take any other action with respect thereto. Minimum Number of Off - Street Loading and Unloading Spaces Required One space - 0 -2000 square feet of floor area Two spaces - 2001 -4000 square feet of floor area Three spaces - over 4000 square feet of floor area Planning Board ARTICLE 12. To see if the Town will vote to amend the Zoning By -Laws by deleting the existing 6.3.2.4. and inserting in place thereof the following: 6.3.2.4. When a non - conforming use is not used for a period of two (2) or more years, its non - conforming status shall not be reestablished and any future use shall be in conformance with this By -Law. or take any other action with respect thereto. Planning Board ARTICLE 13. To see if the Town will vote to amend the Zoning By -Laws by deleting the existing 5.3.1.3. and inserting in place thereof the following section: 5.3.1.3. As part of all new construction of any building, parking lot, structure, or any extension or addition thereto in a Business C or Industrial District and where such construction abuts within one hundred twenty -five (125) feet of any Residential District, a buffer strip is to be established subject to the following requirements: a) Said buffer strip shall have a twelve (12) foot minimum depth and shall contain a curb to prevent parking within the strip, a six (6) foot high fence which shall be located a maximum of two (2) feet from the abutting Residential /Business C and /or Industrial lot line and shall contain an evergreen hedge on the Business C and /or Industrial side of the fence which is to be at least three (3) feet in height at the time of planting and will provide a year -round dense visual screen and attain a height of at least seven (7) feet within five (5) years of planting; Town Warrant March 23, 1981 29-7- b) Said buffer strip shall be constructed along the full abutting length of any Residential District lots so affected and lie entirely within the Business C and /or Industrial District; c) Said buffer strip screening, fencing and vegetation shall be maintained in good condition at all times by the owners of the Business C and /or Industrial property; and d) Where a roadway separates an abutting Residential district from a Business C and /or Industrial District, dimensional controls for said buffer strip shall be implemented from the existing Business C and /or Industrial lot line along the roadway. or take any other action with respect thereto. Planning Board ARTICLE 14. To see if the Town will amend Reading Zoning By -Law Section 2.2.2. APARTMENT, by deleting existing Section 2.2.2. and substituting the following: 2.2.2.APARTMENT: A dwelling arranged, intended or designed to be occupied by more than two families, which definition is intended to include residential condominiums. By Petition ARTICLE 15. To see if the Town will vote to rezone the property located at 259 Main Street with a total area of 14,850 sq. ft. and shown on Assessors' Map 27 as Parcel 5A, owned by Walter S. French and Eleanor Q. French from A -40 to Business, or take any other action thereto. By Petition ARTICLE 16. To see if the Town will rezone the following described land from Single Family 10 District (S -10) to Apartment 80 District (A -80) and amend Reading Zoning By- Law and the map referred to in Reading Zoning By -Law Section 3.2 as "Reading Zoning Map ", dated September 10, 1978, as amended, to reflect rezoning of the following described land from Single Family 10 District (S -10) to Apartment 80 District (A -80): A parcel or parcels of land located in the Town of Reading, County of Middlesex, Massachusetts, on the south side of Salem Street being further bounded and described as follows: Beginning at a point at the northwesterly corner of said land on the easterly side of Manning Street at land, now or late of the heirs of Richard Wilkins; thence, running easterly by said Wilkins land 132 feet, more or less, to a point; thence, northerly by said Wilkins land and land of others 430.78 feet, more or less, to a point on the southern side of Salem Street; thence, easterly by said Salem Street 180.10 feet, more or less, to a point at land, now or formerly of William G. Also included within the land to be rezoned is so much of that land which lies within Torre Street, a private way within the Town of Reading, as said street runs southwesterly from Harvest Road, southwesterly to the easterly sideline of the land described herein as well as that portion of land shown as Torre Street, on Reading Assessor's Maps 68 and 79 which is not currently a public way. Also included within the land to be rezoned is so much of that land which is shown as Pleasnt Street (Ext.) on Reading Assessor's Maps 78 and 92 as is situated easterly of Manning Street. By Petition ARTICLE 17. To see what action the Town will take regarding the installation of additional street lights on the public streets during the year 1981 or what it will do in relation thereto. Moved: That the subject matter of Article 17 be referred to the Municipal Light Board, and that said Board be, and hereby is, authorized to install such additional street lights as in its judgement are required, and to make such changes in the size, type and location of existing street lights, as it may deem advisable, the expense of the same to be paid from the income of the plant. Board of Selectmen 290 Town Warrant March 23, 1981 ARTICLE 21. To see if the Town will vote to amend the By -Laws of the Town by adding thereto the following as Article XXXIII relating to user fees, or take any other action with respect thereto: "Article XXXIII User Fees Section 1. All Town boards, officers, departments, commissions, and committees are hereby authorized to adopt by appropriate regulation, in accordance with all applicable provisions of law, a schedule of fees to be charged for services provided by said board, officer, department, commission or committee to Town residents, customers and other users of such services. The failure of any person or entity to pay for services provided in accordance with the appropriate schedule of fees shall be considered a violation of this By- Law." Board of Selectmen ARTICLE 22. To see if the Town will amend the Town By -Laws Article XXII by adding thereto, as Section 5, the following or take any other action with respect thereto: The fees for licensing dogs under M.G.L. Chapter 140, Section 139 shall be the fees set forth in that Chapter as the same may be from time to time amended plus one dollar. Said fees are subject to all other conditions as set forth in M.G.L. To see if the Town will establish fees and charges by amendment of the By -Laws or otherwise for responses by the Police Department to false burgler alarms to any establishment or residence that has more than two such calls within each fiscal year or take any other action with respect thereto. To see if the Town will vote to sell or transfer the care, custody and control of Lot 11, Plat 119, 7050 square feet of land located on Causeway Road, to the Reading Municipal Light Department, or take any other action thereto. Municipal Light Board ARTICLE 26. To see if the Town will vote to rescind the action taken under Article 10 of the Special Town Meeting held November 14, 1977, or take any other action thereto. (Note: $500,000 to be rescinded for expansion of MLD facilities p. 115 of 1977 Town Report). Town Treasurer ARTICLE 27. To see if the Town will vote to authorize the payment during fiscal year 1982 of bills remaining unpaid for previous fiscal years for goods and services actually rendered to the Town, or take any other action with respect thereto. Board of Selectmen ARTICLE 28. To see if the Town will vote to amend Section 11 of Article III of the General By -Laws by inserting after the second sentence a new sentence "No funds may be appropriated for any capital item unless such item is included in the Capital Outlay Plan and is scheduled for funding in the fiscal year in which the appropriation is to be made." so that Section 11 shall read in part: Now "Section 11. The Finance Committee shall present to each November Town Meeting a five year Capital Outlay Plan to be adopted by Town Meeting with or without amendment. Adoption of the Plan shall not constitute authorization of the expenditure of any funds. No funds may be appropriated for any capital item unless such item is included in the Capital Outlay Plan and is scheduled for expenditure in the fiscal year in which the appropriation is to be made. The Capital Outlay Plan may be amended by action of any regular or special Town Meeting. The Finance Committee shall - - - -" or take any other action in relation thereto. By -Law Committee 292 Town Warrant March 23, 1981 ARTICLE 29. To see if the Town will vote to amend the Capital Outlay Plan, as provided for in Article III, Section 11 of the By -Laws of the Town, as adopted at the subsequent Town Meeting of November, 1980, or take any other action with respect thereto. Finance Committee ARTICLE 30. To determine how much money the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the operation of the Town and its government, or take any other action with respect thereto. Board of Selectmen ARTICLE 31. To see if the Town will vote to authorize the Board of Assessors to contract with a private outside firm to conduct a Town -wide revaluation of all real estate, personal property and utilities in the Town as mandated by the Courts and being enforced by the Massachusetts Department of Revenue; and to see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for such revaluation, and /or for work necessary to implement and cope with Chapter 580 of the Acts of 1980, cornmonly known as Proposition 2y2, and for the costs and expenses necessary for supervision of such revaluation and /or other work, or take any other action with respect thereto. Board of Assessors ARTICLE 32. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purchase of uniforms for members of the Police Department, or take any other action with respect thereto. Board of Selectmen ARTICLE 33. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purchase of uniforms for members of the Fire Department, or take any other action with respect thereto. Board of Selectmen ARTICLE 34. To see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purchase of protective clothing for members of the Auxiliary Fire Service, or take any other action with respect thereto. Board of Selectmen ARTICLE 35. To see what sum the Town will raise from the tax levy, or by borrowing, or transfer from available funds, or otherwise, and appropriate for Police and Fire Indemnification, or take any other action with respect thereto. Board of Selectmen ARTICLE 36. To see what sum the Town will raise from the tax levy or by borrowing or transfer from available funds, or otherwise and appropriate for the purchase of a ladder and /or pumper ladder truck for the Fire Department and to see if the Town will vote to authorize the Board of Selectmen to sell or exchange or dispose of, upon such trms and conditions as they may determine, a ladder and /or ladder truck in use by the Fire Department, or take any other action with respect thereto. Board of Selectmen ARTICLE 37. To see what sum the Town will raise from the tax levy or by borrowing or transfer from available funds, or otherwise and appropriate for the repair and re- conditioning of the Fire Department Ladder Truck or take any other action with respect thereto. Board of Selectmen ARTICLE 38. To see if the Town will vote to authorize the Board of Selectmen to sell or exchange or dispose of, upon such terms and conditions as they may determine, one car in use by the Police Department, and to see what sum the Town will raise by borrowing, or from the tax levy, or transfer from available funds, or otherwise, and appropriate for the purchase of a new Police car for the Police Department, or take any other action with respect thereto. To see what sum the Town will vote to raise from the tax levy, or by borrowing, or transfer from available funds or otherwise and appropriate for the purchase and /or leasing of computer equipment for various Town Departments or take any other action with respect thereto. Board of Selectmen ARTICLE 40. To see what sum the Town will raise from the tax levy, or by borrowing, or transfer from available funds, or otherwise, and appropriate for the purpose of sending a town employee to school to acquire the necessary education to qualify him to be licensed to maintain and repair the heating systems of the Town buildings, or take any other action with respect thereto. Move that the Reading School Committee be and hereby are requested mom and authorized to turn over to the Board of Selectmen land and buildings now known as the Highland School, said transfer to take place on or before June 30, 1982. By Petition 294 Town Warrant March 23, 1981 ARTICLE 47. Move that the sum of Seventy -five Thousand Dollars ($75,000.00) be transferred from the sale of Real Estate and the sum of Five Thousand Dollars ($5,000.00) be transferred from surplus revenue, said sums totalling Eighty Thousand Dollars ($80,000.00) be expended by the under direction of the Board of Selectmen for architectural fees, renovations, necessary to convert the Highland School to use as a Town Hall. Move that the Board of Selectmen be and hereby are authorized and instructed to sell at public auction land and buildings located on Sanborn Street now or formerly known as the Reading Community Center, said auction shall be held on or before June 30, 1984. A minimum bid of Five Hundred Thousand Dollars ($500,000.00) shall be set, and the sum of Two Thousand Dollars ($2,000.00) be raised and appropriated to carry out the purpose of this vote.
