Case # 14 -04
A Public Hearing on the petition of Robert K. Ahern who seeks a Special Permit under Section
6.3.8 of the zoning bylaws in order to demolish an existing single family dwelling and to
construct a new single family dwelling on an existing non - conforming lot on the property located
at 51 Libby Avenue in Reading.
Robert Ahern said the existing house is very old and can't be rehabbed so he would like to tear
down and rebuild as per plans submitted.
The Chairman read a memo from the Building Inspector saying that this was a typical tear down
and rebuild and the Building Inspector did not have any issues with the proposal.
Mr. Traniello asked if the proposed dwelling would meet all setbacks and Mr. Ahern said it
would.
Mr. Redfern said this was originally a cottage home area, as is this present dwelling which is
considered legal nonconforming. He did not think the new dwelling would derogate the
neighborhood in any way. He asked if the third floor in the proposed dwelling was living area.
Mr. Ahern said it could be but they do not plan on using it as that but rather for storage.
Thomas Guerino of 12 B Street had questions about the driveway and safety factors.
On a motion by Robert Redfern, seconded by David Traniello, the Zoning Board of Appeals
moved to grant the Applicant a Special Permit under 6.3.8.1 b of the zoning bylaws in order to
demolish the existing non - conforming single family dwelling and to construct a new two -story

single family dwelling on the existing legal non - conforming lot on the property as shown of the
referenced Plot Plan and in general accordance with the architectural plans submitted with the
application.
The Special Permit is conditioned on the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as-built foundation plan(s), prior to the
issuance of a Building Permit.
3. As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The vote was 4 -0 -0 (Caouette, Redfern, Hackett, Traniello).

On a motion by David Traniello, seconded by Robert Redfern, the Zoning Board of Appeals
moved to adjourn the meeting.
