To either of the constables of the Town of Reading,
Greetings:
In the name of the Commonwealth of Massachusetts, you
are hereby required to notify and warn the inhabitants of the
Town of Reading, qualified to vote in elections and Town
affairs, to meet in the following places designated for the
eight precincts in said Town; namely:
Precinct 1- J. Warren Killam School
Precinct 2 - J. Warren Killam School
Precinct 3 - Joshua Eaton School
Precinct 4 - Joshua Eaton School
Precinct - Community Center
Precinct 6 - Alice M. Barrows School
Precinct? - Highland School
Precinct - Memorial High School
on
Tuesday, the Seventeenth Day of April, A.D., 1979
at seven o'clock in the forenoon to act on the following ar-
ticles, viz:
ARTICLE 1. To elect by ballot the following Town Officers:
A Moderator for one year; one member of the Board of
Selectmen for three years; a Treasurer for three years; a
Town Collector for three years; one member of the Board of
Assessors for three years; two members of the Planning
Board for three years; one member of the Planning Board
for one year; one member of the Board of Health for three
years; two members of the School Committee for three
years; one member of the Municipal Light Board for three
years; two members of the Board of Library trustees for
three years; two members of the Board of Public Works for
three years; two members of the Board of Cemetery
Trustees for three years; one member of the Board of
Cemetery Trustees for two years; one member of the
Housing Authority for five years;
Also, in accordance with the provisions of Chapter 7, Acts
of 1943 as amended by Chapter 317, Acts of 1975, in each of the
eight precincts, the number of Town Meeting Members as
hereinafter specified:
Precinct 1 Eight members for three years; one member
for one year to f ill vacancy.
Precinct Eight members for three years;
Precinct 3 Eight members for three years; one member
for two years to fill vacancy; three members for one year to
fill vacancies.
Precinct 4 Eight members for three years; one member
for two years to fill vacancy.
Precinct 5 Eight members for three years; three members
for one year to fill vacancies.
Precinct 6 Eight members for three years; two members
for two years to fill vacancies; two members for one year to
fill vacancies.
Precinct 7 Eight members for three years; one member
for two years to fill vacancy; one member for one year to fill
vacancy.
Precinct 8 Eight members for three years; one member
s for two years to fill vacancy; one member for one year to fill
1 vacancy.
For these purposes the polls will be opened at each of the
eight precincts at seven o'clock A.M. and will close at eight
o'clock P.M.
and to meet at the Memorial High School Auditorium, 62
Oakland Road, in said Reading on
Monday, the Seventh Day of May, A.D. 1979
at eight o'clock in the evening, at which time and place the
following articles are to be acted upon and determined ex-
clusively by Town Meeting Members in accordance with the
provisions of Chapter 7 of the acts of 1943 as amended by
Chapter 317, Acts of 1975.
ARTICLE 2. To hear and act on the reports of the Board of
Selectmen, Town Accountant, Treasurer, Collector of Taxes,
Board of Assessors, Board of Public Works, Town Clerk,
Tree Warden, Board of Health, School Committee, Con-
tributory Retirement Board, Library Trustees, Municipal
Light Board, Finance Committee, Cemetery Trustees,
Planning Board, and any other Boards of Special Com-
mittees.

ARTICLE 3. To choose all ether necessary Town Officers
and Special Committees and determine what instructions
shall be given Town Officers and Special Committees.

ARTICLE 4. To see what sum the Town will raise by
borrowing, or from the tax levy, or transfer from available
funds, or otherwise, and appropriate for the care and lighting
of the Old South Clock, or take any other action with respect
thereto.

ARTICLE 5. To see if the Town will amend "Section 7,
Benefits and Working Conditions" of Article XXIV of the By-
Laws of the Town or take any other action with respect
thereto: "(A) Sick Leave."
Delete the second paragraph and insert in its stead the
following:
"Sick Leave shall be accrued on the basis of 11/4 days per
month of service, beginning on the first day of the month of
employment. Unused sick leave shall be accumulated from
year to year without limitation."
Delete the sixth paragraph.
Delete the last paragraph and insert in its stead the
following:
"Effective 1st January, 1979, upon death or retirement,
any employee will be paid for accumulated unused sick leave
days not exceeding 90 (ninety) at50 percent (fifty percent) of
his daily rate of pay in effectat death or retirement.
Excluded from the right of this benefit at retirement or
death are the following Department Heads and Chief
Executive Officers:

ARTICLE 6. To see if the Town will vote to amend
"Schedule B - Compensation Plan" of Article XXIV of the By-
Laws of the Town or take any other action with respect
thereto.

ARTICLE 7. To see if the town will vote to amend the
Classification Plan of Article XXIV of the By -Laws of the
Town by establishing the position of Laborer, Grade 2, under
non - exempt positions, G, Custodial Class, or take any other
action with respect thereto.

ARTICLE 8. To see if the Town will vote to amend the
classification Plan of Article XXIV of the General By -laws of
the Town, or take any other action with respect thereto:
By establishing the position of Conservation Administrator
at Pay Grade 7 under "No. 1, Exempt Positions, section D.

raise by borrowing, or from the tax levy, or transfer from
available funds, or otherwise, and appropriate for the
operation of the Town and its government, or take any other
action with respect thereto.

borrowing, or from the tax levy, or transfer from available
funds, or otherwise, and appropriate for the purchase of
uniforms for members of the Police Department, or take any

ARTICLE 12. To see if the Town will vote to authorize the
payment during fiscal year 1979 of bills remaining unpaid for
previous fiscal years, for goods and services actually ren-
dered to the Town. or take any other action with respect
thereto.

ARTICLE 13. To see if the Town of Reading will vote to
transfer the balance available from the Bicentennial Com-
mission to the Historical Commission as recommended in the
Final Report submitted by the Bicentennial Commission.

ARTICLE 14. To see what sum the Town will raise by
borrowing, or fromthe tax levy, or by transfer from available
funds or otherwise and appropriate to hire consultants and
other experts for the purpose of combating and eliminating
air pollution in the form of an odor emanating from the City
of Woburn, such consultants' or experts' services to include
participation, if necessary, in Court proceedings relating to
this matter or take any other action with respect thereto.

ARTICLE 15. To see what sum the Town will raise by
borrowing, or transfer from available funds, or otherwise,
and appropriate for the purchase and installation of a closed
circuit television security system at the Police Station or
take any other action with respect thereto.

ARTICLE 16. To see what sum the Town will raise by
borrowing, or transfer from available funds, or otherwise,
and appropriate for the purpose of developing plans, ar-
chitectural services and locating a site for a new fire station
or take any other action with respect thereto.

ARTICLE 17. To see what sum the Town will raise by
borrowing, or from the tax levy, or transfer from available
funds or otherwise, and appropriate for Christmas Lighting
or take any other action with respect thereto.

ARTICLE 18. To see what sum the Town will raise by
borrowing or from the tax levy or transfer from available
funds or otherwise and appropriate for the purpose of
acquiring emergency fuel supplies and the storage of same
or take any other action with respect thereto.

ARTICLE 19. To see what sum the Town will appropriate
for the purpose of providing a public transportation service
for the inhabitants of the Town, to be operated exclusively
within the Town; to authorize the Board of Selectmen to
establish a Reading Transportation Committee or such other
advisory tribunal to aid and assist the Board of Selectmen to
enter into a contract or franchise arrangement or any
combination thereof with a private carrier or qualified in-
dependent contractor to implement such transportation
service over the public ways of the Town upon such terms
and conditions as the Board of Selectmen shall deem to be in
the best interest of the Town; said sum herein appropriated
is to be expended under the supervision and direction of the
Board of Selectmen; the Board of Selectmen is further
authorized to establish revenue charges to riders and the
procedures for collecting or crediting such revenue by or
through the private carrier; the Board of Selectmen is also
further authorized to apply for any additional support
financial assistance and to receive any and all support
financial assistance from any source in the performance of
the duties herein authorized; the Board of Selectmen is also
authorized to make reasonable rules and regulations con-
sistent with the authority granted herein to effectuate and
maintain an efficient local public transportation service;
determine how said sum is to be raised or take any other
action relative thereto.

ARTICLE 20. To see what sum the Town will raise by
borrowing, or from the tax levy, or transfer from available
funds or otherwise and appropriate for the purpose of making
improvements to the water system, including the
engineering and construction of small buildings, the in-
stallation of pipes, fittings, equipment and related facilities,
or what it will do in relation thereto.

ARTICLE 21. To see what action the Town will take
regarding the installation of additional street lights on the
public streets during the year 1979 or what it will do in
relation thereto.

ARTICLE 22. To see if the Town will vote to accept the
policy recommendation of the Planning Board to sell the
property known as the Lowell Street School for a use per-
mitted in a Residential Zoning District, - with priority of
purchase given to a provider of subsidized housing for the
elderly to meet local needs; and to authorize the Board of
Selectmen to effectuate the intent of this Article by taking all
action necessary including conveying the property by deed
upon such terms and conditions as the Selectmen shall
consider proper, or take any other action with respect
thereto.

ARTICLE 23. Move that the Board of Selectmen be and
hereby authorize and instructed to sell at public auction land
and buldings now or formerly known as the Lowell Street
School, and that the sum of One Hundred Dollars ($100) be
raised and appropriated to carry out the purpose of this vote.

ARTICLE 24. Move that the Board of Selectmen be and
hereby authorize and instructed to sell at public auction land
and buildings now or formerly known as the Prospect Street
School, and that the sum of One Hundred Dollars ($100) be

ARTICLE 29. To see if the Town will vote to amend Section
1 of Article XXII of the General By -Laws by deleting the last
sentence in its entirety and substituting therefor the
following, or take any other action with respect thereto:
"The owner or keeper of any such dog that is not so
restrained shall be punishable by a fine as follows:
Twenty Dollars ($20.00) for the first offense within a
calendar year, Thirty Dollars ($30.00) for the second offense
within a calendar year and Fifty Dollars ($50.00) for each
subsequent offense within a calendar year. The Dog Officer
shall enforce this By -Law in the first instance by giving
written notice to the person complained against setting forth
the offense, the amount of the fine and indicating that it can
be paid within ten (10) days to the Dog Officer. In the event
the fine is not paid within ten (10) days then the Dog Officer
shall bring a complaint in the District Court pursuant to
Sections 173A and 174 of Chapter 140 of the General Laws, or
any act in replacement thereof or amendment thereto, and
notwithstanding the provisions said Section 173A the
schedule of fines shall be that set forth in this By -Law.

ARTICLE 30. To see if the Town will vote to amend the first
sentence of Section 4 of Article XXII of the General By -Laws
by deleting "$2.00" and substituting therefor "$4.50 ", or take
any other action with respect thereto.

ARTICLE 31. To see if the Town of Reading will designate
an area of land for the purpose of burying dead animals
picked up on the public ways in the Town of Reading.

ARTICLE 32. To see if the Town will vote to accept Chapter
71, Section 71E, St. 1977, C. 639; an act having to do with
receipts and expenditures of monies by the School Com-
mittee in connection with the conduct of Adult Education and
Continuing Education Programs or what it will do in relation
thereto.

ARTICLE 33. To see if the Town will vote to authorize the
Town's Representative to the General Court from the 21st
Middlesex District to petition the General Court for a special
act authorizing the Town to appoint a Town Treasurer an-
nually for a term of one year, notwithstanding the provisions
of General Laws Chapter 41, Section 1 or any other General
Law or Special Law to the contrary„ and to provide that the
procedure for appointment of such Town Treasurer shall be
established in a General By -Law of the Town to be adopted or
amended by a Town Meeting, or take any other action with
respect thereto.

ARTICLE 34. To see if the Town will vote to authorize the
Board of Selectmen to petition and -or approve the filing of a
petition to the General Court for a special act authorizing the
Town to rescind its acceptance of Section 42 of Chapter 48 of
the General Laws or corresponding provisions of earlier laws
and to authorize the Town to accept the provisions of Section
42A of Chapter 48 of the General Laws and to authorize that
the position of Fire Chief be subject to the civil service law,
General Laws Chapter 31, or take any other action with
respect thereto.

ARTICLE 35. To see if the Town of Reading will vote to
amend Article I and III of the General By -Laws as follows; or
take any other action with respect thereto:
Amend Article I as follows:
1. Delete Section 1 and replace with a new Section 1 which
reads: "The Annual Town Meeting shall be held on the third
Monday preceding the first Monday in May of each year for
the election of Town Officers and for such other matters as
required by law to be determined by ballot."
2. Section 2 -- delete the words "third Monday in March"
and replace with the words "first Monday in May" so that the
first sentence in Section 2 shall read: "All business of the
Annual Town Meeting, except the election of such officers
and the determination of such matters as required by law to
be elected or determined by ballot, shall be considered at an
adjournment of such meeting to be held at 8:00 P.M. on the
first Monday in May except if this day shall fall on a legal
holiday, in which case the meeting shall be held on the
following day, or at a further adjournment thereof."
Amend Article III as follows:
1. Section 10 - change the words "fifteenth day of
November" appearing in the first and third sentences to the
words "thirty -first day of December" so that the first sen-
tence shall read: "The various Town Boards, Officers and
Committees charge with the expenditure of Town money
shall, not later than the thirty -first of December of each year
prepare detailed estimates of the amounts deemed by them
necessary for the administration of their respective Offices
or Departments for the ensuing fiscal year with explanatory
statements of the reason for any substantial changes in the
amounts appropriated for the same purpose in the preceding
year;" and that the third sentence shall read: "Such
estimates and statements shall be filed by said thirty-first
day of December with the Town Accountant who shall im-
mediately deliver copies of the same to the Finance Com-
mittee."

ARTICLE 36. To see if the Town of Reading will vote to
amend Articles I and III of the General By -Laws as follows:
Amend Article I as follows:
1. Section 2 - Replace the word "November" with the word
"October" so that the second sentence of Section 2 reads: A
Subsequent Town Meeting shall be held on the second
Monday in October to consider and act on all business as may
properly come before it, except the adoption of the annual
operating budget, except if this day shall fall on a legal
holiday, in which case the meeting shall be held on the
following day.
2. Section 7 -- Delete the second sentence and substitute a
new sentence which reads: All articles for the Subsequent
Town Meeting shall be submitted to the Board of Selectmen
not later than 8:00 P.M. on the seventh Monday preceding the
Subsequent Town Meeting in which action is to be taken.
Amend Article III as follows:
1. Section 7 -- Delete the first sentence and substitute a new
sentence which reads: The Finance Committee shall make a
written recommendation on all Articles that it has con-
sidered, and the Town Clerk shall mail said written
recommendations to each Town Meeting Member at least
seven (7) days prior to the first adjournment of the Annual
Town Meeting and the first session of the Subsequent Town
Meeting, and four (4) days in advance of any Special Town
Meeting.
2. Section 11- Replace the word "November" with the word
"Subsequent" so that the first sentence in Section 11 reads:
The Finance Committee shall present to each Subsequent
Town Meeting a five year Capital Outlay Plan to be adopted
by Town Meeting with or withcut amendment.

ARTICLE 37. To see if the Town of Reading will vote to
amend Article II, Section 4 of the Town By -Laws by inserting
after the first sentence a new sentence which reads: If
written notice is given to the Town Clerk within twenty -four
(24) hours after the adjournment of such session, then said
written notice must be signed by at least twenty (20) Town
Meeting Members.

ARTICLE 38. To see if the Town will vote to amend the
Zoning By -Laws by adding the following as paragraph
6.3.1.3., or take any other action with respect thereto:
6.3.1.3. The Board of Appeals may grant a Special Permit
to build upon a non- conforming lot for one family use in any
district permitting such use provided:
-at the time of its recording or endorsement, whichever
occurred sooner, the lot conformed to the then existing
requirements;
-the lot has at least five thousand (5,000) square feet of area
and fifty (50) feet of frontage;
-on February 2, 1978 the lot was held in common ownership
with adjoining land, which adjoining land has at least
seventy -five (75) percent of the minimum area and frontage
required in the district;
-all abutting lots, irrespective of ownership, are built upon,
excepting only lots in recreational, public or quasi - public use
and lots located in an overlay district;
-the averages of the areas and the frontages of lots wholly
or partly within 300 feet of the property line on both sides of
the same street are equal to or greater than seventy-five (75)
percent of the minimum lotarea and frontage required in the
district; and
-fifty (50) percent or more of the lots wholly or partly
within 300 feet of the property line on both sides of the same
street are non - conforming both as to lot area and frontage,
exclusive of lots in recreational, public or quasi - public use
and lots located within an overlay district.

ARTICLE 39. To see if the Town will vote to amend the
zoning By -Laws by adding the following as paragraph 6.3.1.3
or take any other action with respect thereto:
6.3.1.3 INTENT
It is the intent of this By -Law change to provide a limited,
controlled and reasonable vehicle for lots which do not
conform to existing standards to be built upon and prevent
unfair or arbitrarily unbalanced sacrifices to be required of a
few individuals when the resulting benefit to the public good
is minimal, and the damage to the public good by providing
an exemption is also minimal.
The Board of Appeals shall grant a Special Permit to build
upon a non - conforming lot for one family use in any district
permitting such use provided the applicant established:
1 - at the time of its recording or endorsement, whichever
occurred sooner, the lot conformed to the then existing
requirements;
2 - the lot was held in common ownership with adjoining
land on February 2, 1978;
3 - the lot has at least five thousand (5,000) square feet of
area and fifty (50) feet of frontage;
4 - the area and frontage of the lot are similar to or greater
than the area and frontage of'a substantial number of built -
upon lots which are located wholly or partly within three
hundred (300) feet of the property line and in the same
district;
5 - all abutting lots, excepting lots in recreational public or
quasi - public use and lots located in an overlay district, are
built upon and such lots have at least five thousand (5,000)
square feet of area and fifty (50) feet of frontage, or the lot
and each abutting vacant lot(s), irrespective of ownership,
has at least eighty (80) percent of the minimum area and
frontage required in the district;
6 - all zoning requirements other than area and frontage
are met.

ARTICLE 40. To see if the town will vote to amend the
Zoning By -Laws by deleting, in paragraph 4.2.2., "Table of
Uses ", the line entitled "Public Buildings" in its entirety, or
take any other action with respect thereto.

ARTICLE 41. To see if the Town will vote pursuant to
General Laws, Chapter 258, Section 9, or otherwise, to in-
demnify Frank A. Smith, Jr., James J. Sullivan, Jr. and
Marvin M. Rosenthal each from personal financial loss and
expenses, including legal fees and costs, if any, by purchase
of insurance or otherwise in an amount to be determined by
Town Meeting arising out of any claim, action, award,
compromise, settlement or judgement by reason of an in-
tentional tort, or by reason of any act or omission which
constitutes a violation of the civil rights of any person under
any federal or state law, or by reason of any other act or
omission for which indemnification may be made, arising out
of said individuals October 3,1978 vote not to grant a common
victualler's license to Sambo's of Massachusetts, Inc. or
arising out of any of said individuals prior or subsequent
actions with regard to Sambo's of Massachusetts, Inc. and its
application for a common victualler's license, or take any
other action with respect thereto.

ARTICLE 42. The Board of Selectmen are instructed to

ARTICLE 43. To see if the Town will vote to accept the
policy recommendations of the Planning Board to
rehabilitate the Community Center building to serve as the
Town Hall, and subsequently construct an addition on the
north side of the Library, retaining intact and utilizing the
exterior facade of the present Town Hall building; and to
instruct the Board of Selectmen, the Finance Committee and
the Board of Library Trustees to include such construction in
the Capital Program and to submit implementing Articles at
appropriate times for consideration by Town Meeting, or
take any other action with respect thereto.

ARTICLE 44. To see whether the Town under and pursuant
to authority granted in General Laws Chapter 40D, Section 21
(g), as amended, will authorize the Board of Public Works to
enter into a contract with the operator of solid waste disposal
facilities to be established in the Town of North Andover for
the use of by- products resulting from the operation of such
facilities, which contract will:
(1) Be for a term of twenty years, more or less;
(2) Include provisions for the delivery of minimum
amounts of refuse, garbage and waste and payments for the
use of the facilities to be based thereon;
(3) Provide for unit prices that will be graduated and for
adjustments thereof and for the use of steam, electricity and
other by- products resulting from the use of the facilities and
for credits or payments of the Town resulting therefrom;
(4) The use by the Town or other municipalities of the
uncommitted capacity of such facilities;
(5) Contain other provisions incidental and related to the
foregoing general matters; and
(6) Be generally in the form of proposed contract
negotiated by representatives of the member communities of
the Northeast Solid Waste Committee (NESWC) with.such
changes therein as may be approved by said Board of Public
Works or take any other action with respect thereto.

ARTICLE 45. To see if the Town will vote to accept the
report of the Board of Public Works upon the Laying out as
Public Ways of the following Private Ways: C Street
Extension, County Road Extension, Countryside Lane
Extension and Pasture Road, under the provision of law
authorizing the assessment of betterments such highways
being laid out in accordance with plans duly approved by the
Board of Survey and filed in the Office of the Town Clerk in
accordance with the statutory requirements and to see if the
Town will vote to accept as Public Ways these Ways laid out
by the Board of Public Works as follows: C Street Extension,
County Road Extension, Countryside Lane Extension and
Pasture Road and to see what sum the Town will raise by
borrowing or from the tax levy, or transfer from available
funds, or otherwise and appropriate for the construction of
said ways, or take any other action with respect thereto.

ARTICLE 46. To see if the Town will vote to rescind the
action taken under Article 2 of the Special Town Meeting
held November 14, 1977, or take any other action with respect
thereto.

And you are directed to serve this Warrant by posting an
attested copy thereof in at least three (3) public places in
each precinct of the Town not less than fourteen (14) days
prior to April 17, 1979, the date set for the meeting in said
Warrant, and to publish this Warrant in a newspaper
published in the Town or by mailing an attested copy of said
Warrant to each Town Meeting Member at least fourteen
(14) days prior to the time of holding said meeting.
Hereof fail not and make due return of this Warrant with
your doings thereon to the Town Clerk at or before the time
appointed for said meeting.
