The Commission did a site visit and the project is more than 50' from the wetland area. Mr. Tirone staled that the project will require staging and a construction site. He felt erosion control should be asked for. At the site visit trees and a porch were discussed. The porch is part of this RDA. The Commission discussed with the applicant and contractor the porch procedure. Mr. Maughan pointed out that this project was on the line between RDA and Minor project and the other commissioners concurred. Motion made by Mr. Hecht to issue a negative determination of applicability with erosion control added as a condition. Ms. Scanlon seconded. Vote was 6-". The applicant will email Mr. Tirone the dimensions on the porch. The Commission discussed the guidelines on deciding what project is a RDA or a minor project permit. Page I 1 Town of Reading - Meeting Minutes 30 Rice Road — The owner talked to the Commission about needing to repair his deck. He was already in front of the Commission when a tree fell on his deck. He stated he has a deadline with the insurance company on the repair of the porch. The contractor stated he came in for a building permit, for him to rebuild the porch it has to be brought up to Town building code. He is not able to use the existing sono -tubes as the foundation and needs to install larger supports to meet current building code. Conservation reviewed the building application and questioned if a RDA should be filed. It is 40' from resource area. The Commission talked about what was originally discussed. The removal of the tree did not require a RDA to be fled. Mr. Maughan stated his opinion that the repair would not have any adverse effect on any resource area and was essentially the repair /replacement of existing structure. Thus the commission's jurisdiction over the action was limited. Motion made by Mr. Hecht that the Commission agrees that the project at 30 Rice Road Is a Ron. jurisdiction permit. Mr. Maughan seconded. Vote was 5.1.0 Reading Rifle and Revolver Club Mr. LoRusso introduced Ms. Martin an environmental specialist. He went over the documents he passed out regarding the material on site. The Commission looked at pictures of the area from 1005 —2010. The following was discussed: • The site • Deed restriction • Parking area and H it was paved or just compacted • Sand hill and how it got there • The type of Seed mix that will be used to restore the wetland. There will be no plugs used • If GPS points can be used to flag the wetlands. Ms. Martin stated the GPS accuracy was within 3 feet. • The berm and retaining wall be repaired • The material and why it should be tested • The fill from the wetland area can be placed on the piles already on site The Commission agreed not to fine but to issue an enforcement order. The Club will have to remove the fill in the resource area. They will have to restore wetland vegetation in the sand area. The Club will maintain the erosion control around the piles. The material will have to be removed by November 301h. Any additional action at the site, including work on the berms will require the fling of a Notice of Intent or RDA. Motion made by Mr. Maughan to Issue an enforcement order to the Reading Rffe 8 Revolver Club to remove the fill under supervision of a wetland scientist. Them will be no fines and the Club will be responsible for erosion control. Mr. Hecht seconded. Vote was 6 -0-0. The Commission told the Club to work with Mr. Tirone to fulfill an enforcement order before November 30, 2103. They should come back with a proposal regarding the asphalt area and a general maintenance plan. The Commission suggested finding out the chain of custody of the material. The enforcement order will be mailed to Mr. LoRusso and Ms. Martin. Minor Project Minor projects were not discussed by the Commission Bills Approved — One bill — NH Department of Corrections — the 'No Mow' signs 6/$103.13. Motion made by Mr. Hecht to approve the bill for NH Department of Connections. Ms. Scanlon seconded. Vote was 6 -0 -0. Conservation sign location discussion This was not discussed Lawn waste dumping in Pinevale Conservation area The Commission discussed and made minor changes to the "No Dumping" letter. It was decided the Conservation chairman will sign the letter. Mr. Tirone will mail to the abutters of the Pinevale Conservation area. Motion made by Mr. Maughan to accept the letter with modest edits. Mr. Hecht seconded. Vote was 6 -0 -0. Minutes for Approval: September 25, 2013 Page 1 2 Town of Reading - Meeting Minutes Motion made by Mr. Hecht to approve the minutes as amended. Ms. Scanlon seconded.. Vote was 5.0-1 (Mr. Maughan absent from the meeting) • Ms. Scanlon discussed her meeting with Ms. Delios and Mr. Tirone. It was stated that Community Services will be hiring another clerk, this will allow the Conservation clerk to have more time. Ms. Delios gave positive feedback regarding the Conservation permits. • Mr. Tirone let the Commission know he is asking all applicants to give an electronic copy with their applications. • The Overlay bylaw will be coming off the bylaws, as requested by the Commission • Artie Development— still meeting with Zoning • Mr. Tirane will be meeting with Engineering and Mr. Manuel regarding the Lowell Street project. The Commission agreed with Mr. Tirone, no building will be allowed in the Wares. • The Forest Acres Engineer has requested a meeting with Mr. Tirone to make sure they have everything to receive a Certificate of Compliance. • The resident on Van Norden Road still has the weed wench. He should be returning soon. His plants are growing fine and will be established for the winter. • Ms. Scanlon asked if the Commission can do a site visit at 25 Collins Avenue. The Commission received an anonymous tip about dumping in the wetlands. She is not sure who should be asked for permission, the house is up for sale • She visits will be done on Sunday at 9:00 a.m. • Perfecto's is starting up again, received their foundation only permit. They should have made a phone call to Conservation, Mr. Tirone will follow up. Motion made by Ms. Scanlon to adjourn at 9 p.m. Mr. Hecht seconded. Vote was 5.0.0. Page 1 3 2013.•.03
