MASS. 313 OCT 23 A 1<31 Location: Selectmen Meeting Room Maureen Knight, Recording Secretary Continuation on the petition of Alice Beltran who seeks a Variance under Section 4.2.1 of the zoning bylaws in order to modify a Variance granted on December 17, 1957 in order to use the existing cottage for the use of a dwelling on the property located at 29 Gardner Road in Reading, Massachusetts. The Applicant's attorney has requested in writing that this case be continued to September 19 in order to do further research. On a motion by John Jarema, seconded by David Traniello, the Zoning Board of Appeals moved to continue the case to September 19, 2013. The vote was 4 -0 -0 (Redfern, Jarema, Traniello, Caouette). CASE # 13 -17 A Public Hearing on the petition of Anthony Bonfilio who seeks a Special Permit under Section 6.3.8 of the zoning bylaws in order to demolish a non - conforming single family dwelling and to construct a new single family dwelling on a non - conforming lot as indicated on plot plan dated March 17, 2013 on the property located at 170 Pearl Street in Reading, Massachusetts. Page I 1 Anthony Bonfilio presented his proposal to the Board. The Building Inspector submitted a letter saying the proposal will meet all of the required setbacks and height restrictions. This was a foreclosed property bought by Mr. Bonfilio as -is on July 1, 2013. The present structure is a rundown ranch and he plans on demolishing it and building a new single story one family dwelling. Mr. Jarema asked about the land and he was told it was flat and is about 1/4 acre. Mr. Redfem mentioned it was a straight one story without any dormers and the proposed dwelling meets the side yard setback and the present dwelling does not. It is an improvement over the current dwelling and is not more detrimental to the neighborhood. The foundation will be slab on grade. The shed in the backyard will be retained and used as storage for yard supplies. It appears to meet the setbacks for sheds. Mr. Caouette said the proposed dwelling looks like it will fit right into the neighborhood. Cathy Driscoll of 191 Pearl Street voiced her concerns about the project and how the traffic will affect her daycare and wanted to know what will be the hours of construction. Susan Sanders of 201 Pearl Street asked about blasting and was told there would not be any. On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals moved to grant the Applicant a Special Permit under Section 6.3.8. lb of the Zoning Bylaws in order to demolish the existing non - conforming single family dwelling and to construct a new, one story single family dwelling on the existing legal, non - conforming lot on the property as shown on the referenced Plot Plan and in general conformance with the architectural plans submitted with the application for the Special Permit. This Special Permit is conditioned upon the. following: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new structure shall be submitted to the Building Inspector, along with the as-built foundation plan(s), prior to the issuance of a Building Permit. 3. As -built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. The vote was 4 -0 -0 (Redfem, Jarema, Traniello, Caouette). OTHER BUSINESS Discuss and appoint a Zoning Board of Appeals member as a representative to the Ad Hoc Zoning Bylaw Advisory Committee and discuss potential improvements to the zoning bylaws. Page 1 2 The Chairman said several memos have been sent and now we know that the Board needs to appoint a representative from the Board to the Ad Hoc Zoning Bylaws Advisory Committee ZAC). It will be a seven - member committee with one ZBA Member. The committee will be meeting a considerable amount of times and it will take some effort and time by the representative. It gives the Board input into what they would like to see changed or modified. It would be in the Board's best interest to appoint someone with a long history in the town and it was suggested that John Jarema who has been a member of the ZBA for almost 35 straight years would be a suitable candidate. Mr. Jarema said Mr. Traniello has been working in this area on the state level and he feels Mr. Traniello could speak on both sides of the issues and be the best representative so Mr. Jarema said he would decline the offer for someone who has a different perspective. If Section 40A changes on the State level as much as it could, there should be someone who can balance the issues. Mr. Traniello spoke about the State update and whether there is any need by the Town to do anything. He discussed the meeting he attended of a review regarding this issue. He said he would devote the time necessary to be the representative on the ad hoe committee. The Chairman said he would like to wait for a vote till we have all the members present so we will hold our scheduled meeting on September 12 to vote for the appointee. The members discussed some of the areas of change they would like to see happen in the zoning bylaws. The Chairman suggested each member bring a short concise fist to the next meeting of the areas of the bylaws they would like to see addressed.
