HomeMy WebLinkAbout1987-10-29 Bylaw Committee Minutest BY -LAW COMMITTEE MINUTES #117 y October 29, 1987 Members present: Ed Murphy, George Theophanis, Nils Nordberg and Dolores Carroll. 7:35 Chairman Murphy called the meeting to order in Room 16, Town Hall. Minutes of meetings dated September 23 and October 15 were reviewed and accepted. 7:45 Chairman Murphy introduced Richard Howard and George Hines of the Community Planning and Development Commission. Mr. Howard mentioned that CPDC would hold a public hearing on November 2 to discuss proposed amendments to Zoning By -Laws. A forum will be held with various boards and committees on November 5 to do the same and to explain why PUD is needed for the landfill area and how it will benefit the Town. He discussed office and hotel space in phased development. In later phase of development, buildings would progress to 12 stories. His feeling is that PUD is best for the developers and the Town. CPDC had a mailing list of 400 residents, chosen at randum, to receive information and give their input. PUD addresses open spaces, buffers, which are not provided for in current Zoning By -Laws. Town to work with developers regarding traffic. Developer would pay for consultants. Mr. Howard feels it's a good product; an option a developer can use; will serve the Town well. Homart is vital to the financial interest of the Town - 8 1/2 Million Dollars worth. A Using the Zoning Map, Mr. Howard pointed out the proposed overlay district along Walker Brook Drive. A U Purchase and Sales Agreement states either PUD approved at Town Meeting, or amend present Zoning By -Laws at Spring Town Meeting. If defeated, back to square one with PUD and landfill. George Hines mentioned that PUD can be used on other pieces of Town property - only under large PUD could 12 story building be built. Is appeal recourse to the court or Board of Appeals? Think it's the court. Additions or Amendments - 65 days first public hearing - can continue - 99 days final. George presented a set of updated Zoning By -Laws to Ed. 8:30 Peter Hechenbleikner discussed how PUD is fairly new to MA; has been around about 15 years. Nils felt there whouldn't be a problem getting approval from the Attorney General's office due to length of time in MA. Peter suggested that it was a possibility for the Bear Hill area. What kind of financing commitments in final approval? No one will give financing until final commitment. The approval is what is financiable, until then look at their plans to see what is reasonable. Mr. Howard explained that height for a hotel is less than 10 feet per floor; non - residential building is 10 -12 feet. Finished floor space in office is more than hotel. Peter - motion under Article 5, Special Town Meeting, if adopted, Articles 6 and 7 are mote. Delegates to Board of Selectmen - the adoption to the Selectmen. Establishes overall philosophy of personnel system. Regarding schedule of fees - Town Meeting approves fees. Those are user fees per Ted Cohen - milk fees. Article 22 deals with establishing a Scholarship Fund - cost of collection could be as much as cost of process. Removes volunteer effort and is not desirable. School Committee will request indefinite postponement. - 2 - n Article 5 covers only 50 -60 employees out of 800. In the old by -laws Selectmen could classify with Town Meeting's approval. 4 -0 in favor of Article 23, Schedule of Fees of the Subsequent Town Meeting. Article 5, Personnel By -Law, Special Town Meeting - Selectmen represent union; Town Meeting non - union. Discussed proper punctuation and capitalization of Article 5. Nils feels Charter is basis for capitalization. Motion under Article 5 is Article XXIV of the Personnel By -Laws. Agreed to hyphenate the word by -law. Voted to recommend Article 5, as redrafted, by a vote of 4 -0. Voted to recommend Motion under Article 6 of the Subsequent Town Meeting (Schedule A, Classification Plan) by a vote of 4 -0. Finished Subsequent Town Meeting; reviewed By -Law changes. Zoning changes to be discussed at our next meeting. No new business.
