March 30, 1988
Members present: Ed Murphy, Nils Nordberg, Dolores Carroll and Phil Pacino.
7:45 Meeting called to order by Chairman Murphy in the Employees Lounge of the
Town Hall.
Minutes of meeting #124 were approved by a vote of 4 -0.
The only business undertaken at the meeting was a discussion of a vote on
Article 21 of the Annual Meeting.
Present to present the reasons to recommend the article was the petitioner
Bud Margosian. Present to argue against recommending the article was Harold
Hulse, Joan Nickerson and Conservation Administrator Beth McKillop. Also
present was Jack Rivers and Town Counsel Ted Cohen.
In summary the argements in favor of the article were that the new article
would better define the requirement of the ConsCom process, would make the
process more open and better understood by the public and would clear up
what is viewed by some as vague rules and regulations of the ConsCom.
In summary the arguments against the article was that the purpose the
petitioner wanted to achieve would not be achieved by this article.
Additionally, it was argued that the article if adopted would weeken the
present Town Bylaw by restricting the application of the Wetlandf,
Protection rules to a small area then now covered by the Bylaw.
During the discussion the original intent of allowing the ConsCom to adopt
rules and regulations under Bylaw Article XXXII was brought up. It was
the feeling of a member of the Bylaw Committee that the original intent
was to facilitate the administration of the Wetland Protection Laws and
not to allow the ConsCom to promegate their own definitions and rules
with respect to the Law.

On a motion ve Phil Pacino and seconded by Nils Nordberg the committee
agreed not to recommend Article 21 by a vote of 2 -2.
