Mers present: Ed Murphy, George Theophanis, Nils Nordberg,
Phil Pacino and Dolores Carroll.
7:35 Chairman Ed Murphy called the meeting to order in Room 16 of
Town Hall.
Minutes of meeting No. 127 were reviewed and amended as
follows:
In the last sentence of the next to last paragraph of the first
page, the word "by -law" should be "regulation." The second
last paragraph of page 2 should have included the words, "voted
to recommend by a vote of 3 -1."
Minutes accepted as corrected by a vote of 3 -0.
Nils Nordberg presented committee members with a copy of a
letter he had sent to the Moderator, Paul Dustin, regarding our
By -laws as they pertain to "Conduct of Town Meeting."
Upon recommendation of Ed Murphy, we commenced discussion of
the By -law codification with the following comments:
- Keep a record of issues we want to bring up such as Article
1 which governs Town Meeting.
- George Theophanis feels Town Meeting gives away too much
power with boards, general procedures of regulations and the
local operation of government in general.
- Issues - procedures for adopting and promulgating
regulations.
- Nils Nordberg believes the Moderator should have certain
freedom to maintain order and make rulings, which Town
Meeting can accept or reject. Needs further discussion.
- Discussion on augmenting the Charter provision on removal of
Town Meeting Members with a set of rules. Agreed to make
recommendations to Town Meeting. Can be builgY into By -law
to implement that provision.
- Ed Murphy read and the committee reviewed previous changes
made in Article 1.
- "Amendment" - no changes. Agreed to accept as is.
"Repeal" - Agreed to use first sentence of Andover's By -law
language, but deleate the word "heretofore adopted." Use
the second sentence of our By-Iiw; change the word "the" to
4W "these" and remove word "foregoing."
Town Manager, Peter Hechenbleikner, Town Clerk, Doris Fantasia,
and Nancy Smethurst arrived to discuss format of the Charter
and General By -laws. All agreed that there should be
consistency between the Charter, General By -laws and the Zoning
By -laws.
- After viewing several examples, the Committee agreed to
page -wide format (see Exhibit A), with the use of the
decimal system.
- Peter wants to start printing the Charter, to be followed by
the printing of the By -laws.
- Delete word "section" in Charter.
- Discussed distribution of various documents.
- Peter and Doris Fantasia to provide list of rules and
regulations of all boards and committees.
- Minutes of Town Meeting to be included in the Annual Report [t/ _,d /tk c_I-o�
- Nils suggested Article 2 of the By -laws be included on
inside back cover of Annual Town Meeting.
9:45 Committee adjourned to meet on Wednesday, June 22, 1988 to
discuss reorganization and again on Wednesday, June 29, 1988 to
continue codification.

2.32.010 Term.
The city treasurer shall be elected for a four -year term at the same time the mayor is
elected. If a vacancy occurs in the office of city treasurer it shall be filled by the mayor with the
advice and consent of the city council, the person so appointed to hold office for the
unexpired term of the officer elected. He shall receive such compensation as is set from time
to time by ordinance of the city council; provided however, the compensation may not be
changed during his term of office. (Ord. 12 § 1, 1959)
2.32.020 Bond.
The city treasurer shall give a bond in such sum as may be required by the council, but
the bond shall not be less than the amount required by statute. The bond shall be conditioned
upon the faithful performance by the treasurer of the duties of this office, and to indemnify
the city for any loss due to any neglect of duty or wrongful act on the part of the treasurer.

232.030 Duties generally.
A. The city treasurer shall receive all money paid into the city, either directly from the
person paying it, or from the hands of such other officer as may receive it.
B. He shall keep records showing all money received by him, the source from which it
was received, and the purpose for which it was paid out.
` C. He shall keep a separate account of each fund or appropriation, and the debts and
credits belonging thereto.
D. He shall pay out money only on vouchers or orders properly signed by the city clerk
and the mayor. (Ord. 12 § 3, 1959)
2.32.040 Receipts and warrants.
A. The city treasurer shall receive and safely keep all money which comes into his or her
hands as treasurer, for all of which he or she shall execute triplicate receipts, one to be filed
with the city clerk. He or she shall receive all money due the city and disburse it on warrants
issued by the clerk, countersigned by the mayor, unless the clerk, mayor pro -tern or mayor is
ill, on vacation or deceased, then the deputy clerk shall sign in the absent official's stead, and
not otherwise. He or she shall deliver to the clerk the duplicate receipts for all money received
and all cancelled warrants as evidence of money paid.
B. The treasurer shall sign all treasurer's checks unless ill, on vacation or deceased, then
the city clerk shall sign in the absent treasurer's stead. (Ord. 12 § 4, 1959)
232.050 Bank accounts.
The city treasurer shall be responsible for setting up all bank accounts for the city, shall
make all monetary deposits at the banks and savings and loan associations and shall keep the
books and records of each and every monetary transaction dealing in the funds of the city.
