HomeMy WebLinkAbout2013-06-06 Zoning Board of Appeals Minutes—Tow � Lek( Town of Reading ZONING BOARD OF APPEALS Minutes of June 6, 2013 Members Present: Damase Caouette Robert Redfern Kathleen Hackett David Traniello John Jarema Members Absent: John Miles A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 13 -08 Continuation of a Public Hearing on the petition of Robert Keegan who seeks a Variance under Sections 4.2.2 & 2.2.1 of the zoning bylaws in order to construct an accessory building on a lot without a principal building on the property located at Off Back Bay Court, Map 246023000000, Parcel 2020, in Reading, Massachusetts. The Applicant requested that his petition be withdraw without prejudice. On a motion by Robert Redfern, seconded by David Traniello, the Zoning Board of Appeals moved to accept the withdrawal by the Applicant without prejudice. The vote was 5 -0 -0 ( Caouette, Redfern, Jarema, Hackett, Traniello). Case # 13 -01 A continuation of a Public Hearing on the petition of Artis Senior Living LLC who seeks a Variance, Special Permit under Section(s) 4.3.1.4, 6.3.2.b of the zoning bylaws in order to remove the existing structures and to construct a new two -story 65 bed nursing home as per plans submitted on the property located at 1090 -1100 Main Street in Reading, Massachusetts. Attorney Brad Latham submitted a letter to the Board requesting that the portion of the application that concerned 1090 Main be withdrawn without prejudice. On a motion by David Traniello, seconded by Kathleen Hackett, the Zoning Board of Appeals moved to accept the withdrawal by the Applicant of the portion of the application concerning 1090 Main be withdrawn without prejudice. ZBA Meeting, June 6, 2013 The vote was 5 -0 -0 (Caouette, Redfern, Jarema, Hackett, Traniello). Case # 13 -11 A Public Hearing on the petition of Mark & Kristin Agami who seek a Variance & Special Permit under Sections 5.0 & 6.3.6 of the zoning bylaws in order to remove a structure and to construct a 11.8' x 11.75' two -story addition on a non - conforming lot on a non - conforming dwelling as per plans submitted on the property located at 23 Lee Street in Reading, Massachusetts. Mark Agami presented his proposal to the Board and distributed some slides for them to review. He gave the background of his family and the property. He is requesting a Variance for an addition to the back of his house. His family has outgrown the house, they need more room, and they want to stay in Reading where they have always lived. If they add another bedroom each child will have their own room. The Building Inspector said they need the Variance because they are increasing the rear yard setback. The Chairman said he did not think the Applicant needed a Variance because it is a non- conforming lot now and, even though there would be an increase in non - conformity, it would not be substantially more detrimental to the neighborhood and the Board has the power to just issue a Special Permit. The rest of the Board agreed with the Chairman. Mr. Traniello asked if any neighbors were in disagreement and Mr. Agami had two abutters with him who did not have any issues with the proposal and he said there were none that were not in favor of his proposal. Judy Carlson of 19 Lee Street had no objections to the proposal. On a motion by Kathleen Hackett, seconded by Robert Redfern, the Zoning Board of Appeals moved to grant the Applicant a Special Permit under Section 6.3.6 of the Zoning Bylaws in order to remove an 8' by 11.75' structure and to construct an 11.8' by 11.75' two -story addition on the property as shown on the referenced Plot Plan of Land. This Special Permit is conditioned upon the following: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new structure shall be submitted to the Building Inspector, along with the as -built foundation plan(s), prior to the issuance of a Building Permit. As -built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. The vote was 5 -0 -0 (Caouette, Redfern, Jarema, Hackett, Traniello). Mr. Agami asked to withdraw his request for a Variance with out prejudice. On a motion by John Jarema, seconded by Robert Redfern, the Zoning Board of Appeals moved to accept the Applicant's request to withdraw the variance request without prejudice. The vote was 5 -0 -0 (Caouette, Redfern, Jarema, Hackett, Traniello). Minutes May 9, 2013 On a motion by David Traniello, seconded by Kathleen Hackett, the Zoning Board of Appeals moved to accept the minutes of May 9, 2013. The vote was 5 -0 -0 (Caouette, Redfern, Jarema, Hackett, Traniello). May 16, 2013 On a motion by Robert Redfern, seconded by David Traniello, the Zoning Board of Appeals moved to accept the minutes of May 16, 2013. The vote was 5 -0 -0 (Caouette, Redfern, Jarema, Hackett, Traniello). Adjournment On a motion by Robert Redfern, seconded by Kathleen Hackett, the Zoning Board of Appeals moved to adjourn the meeting.
