Repetitive Petition Hearing - 46 West Street
Chairman Rich opened the hearing on the above -named petition at
7:15 P.N. The Clerk read the notice into the meeting record.
T'he Chairman then stated the purpose of the hearing for a
repetitive petition: the Planning Board must decide if there has
been specific and material change to allow the petitioner to
appear before the Board of Appeals before the 2 year time limit
(see Section 16, Chapter 40A), and not to decide on the granting
or not granting of the Special Permit. The granting of the
Special Permit is the sole responsibility of the Zoning Board of
Appeals.
Attorney William C. Wagner, representing Mr. Rice, then presented
the case, displayed a new layout of the interior of the premises
and showed the changes since the first denial by the ZETA. Mr.
Wagner has appeared before the ZBA and they have decided that
there were significant changes to consider rehearing this case.
The ZBA sent them back to the Planning Board for the right of a
repetitive.petition. Attorney Gagner noted the following
changes:
* the owner will now reside in the main part of the house and
will rent the accessory apartment;
* the two rooms that are upstairs will be locked and closed.
Mr. Rice will have the only set of keys;
* a new foyer entrance at both the front and rear of the house
with locking door units for the main portion of the house;

* egress for the upstairs apartment will be through one of the
foyers. Formerly the emergency egress was through the rear
stair area and out through the garage.
After Attorney Wagner's presentation, Mr. Devine read Section 16,
Chapter 40A, M.G.L. for the Board's behalf.
The questions raised were:
* the size of the accessory apartment (535 sq. ft.)
* the size of the upstairs floor area (approximately the same
as that of the downstairs unit).
* adequacy of a locked door to contain the accessory apartment
and exclude the use of the 2 upstairs rooms.
Citizens were given a chance to respond. The main concerns of the citizens were:
* no guarantee that owner would occupy downstairs
* no Guarantee that the accessory apartment would 'not user the 2
upstairs rooms
* adequacy of safety measures, especially fire safety.
The Board then reviewed ti%e changes. Upon a motion duly made and
seconded, the hoard voted 4 -1 -0 to grant Permission to the
petitioner to appear before the Zoning Board of Appeals before
the 2 year time limit because the changes presented were specific
and material changes in the conditions upon which the previous
unfavorable action was based.
According to Section 1e, Chapter 40A, M.C.L., all but one member
of a 5 rtitmber Planning Lear(] must vote in the affirmative in
order for a petition to be reheard. The vote being 4 -1 -0, the
etitioner' may now appear before the Zoning Board of Appeals.

study. A formal list of material needed by MM will be submitted
to the Board for their assistance in obtaining this. Ms.
ncKinney asked that the names of the key contact people,
including their full name, title, department, be forwarded to tier
office.
Chairman Rich stateri that she will try to obtain the McConnell
maps from NAPC so that I :DN can use them in their analysis. These
raps provide aerial views of the area community, including their
zoning uses.
Finances
Chairman Rich informed the Board that an additional $2059 was

Mr. Dolben then called Chairman frith and informed her that he had
provided all. the information to CPw, although he had receive(! no
formal approvals from Reading because Wakefield had to approve
the project first. Ms. Rich then informed Mr. Dolben that Mr.
Fletcher, Superintendent of DPW, had told her in a phone
conversation that he, knew nothing of the project. MS. Rich
eventually spoke with Mr. Fletcher and Ire said that Ms. Rich had
misquoted him and had misunderstood what he had said. Chairman
Rich informed him that she had taken notes during the
conversation and was sure of his response to her. Mr. Dolben
then asked to meet with Chairman Rich. The meeting took place in
the Planning Board office, with the administrative assistant for
the Planning Board and a staff person of Mr. Dolben's present, as
well as Fir. Dolben and Chairman Rich. Mr. Dolben felt that the
Planning Board had deliberately sabotaged his project in
Wakefield. Chairman Rich restated her conversations with
Superintendent Fletcher previous; to the hearing and aEtcr the
hearing. Mr. Dolben was angered by this and stated that the DPF:,
[tr. Bergeron, Mr. Redford and Superintendent Louanis (before his
death) had full knowledge of this project. Mr. Dolben was
angered that 2 years work and money was "sabotaged" in this way.
Ile asked that if anything like this in the future happens again,
that the town /public works /planning board /whomever contact him
and he be given the full courtesy of being informed of such
actions. A brief discussion on plans for the Bear Hill area took
place.
Woburn - Callan /West Street Proposal
Chairman Rich reported on the proceedings at the ::oburn City
Council regarding the zoning of tt:e land off. crest Street on the
easterly side of Rout( I -93 in 4oburn. This land directly abuts
residential land in Leading and is entirely isolated from Pdohurn
by I -93. At the Woburn City Council hearing on Mon(lay, 1.pril 15,
1925, Nis. Rich appeared at that hearing and was told that Woburn
expected cooperation from Reading for services for this area.
They then voted to reconsider the suggested zoning of Of. ice Park
and changeu it to Residential (R -2). On Llednesday, Al: ril 17,
1985, the Woburn City Council met again and reconsidered their
previous action on the zoning of this land. At that meeting, the
City Council voted to rezone the land back to Office Park.
Meanwhile, the Woburn Planning Board had received preliminary
plans for the proposed development. Thev Piave made the 1.1ans
available to both S.ilmington and Peading. These new plz :ns show
the access to the Woburn land primarily over 1:ilrainnton -owned
land (zoned Industrial) and a small portion over residential land
in Reading (zoned 5 -20). 'the roacway narrows as it bends around
4iilminoton land into Reading and thrn into Woburn. The guastion
of the right of access has not been settled in court and Town
Counsel has received no information in this regard. The Board
has received information from Woburn and has forwarded it to the
1.oard of Public Works and Municipal Light Boar(!. Golarn Planning

with the F,oburn Planning Board is June 10, 19l:5.
