Call to Order, Old/New Business
RDA 13-08, 214 Main Street, Map 7 Lot 249, Anthony's Roast Beef
Mr. Sullivan represented the applicant. The applicant would like to install construct a new 10'x 14' station to the rear of the building.
This addition would hold a prefab cooler. The wolerwill sit on a F concrete slab. The area would still be big enough for a vehicle; for
the dummar will still need to be emptied. Mr. Sullivan went over a previous N01 filed for this property. The following was discussed:
• The rehgerator is an outside cooler; the mof is cwt separate. The applicant is willing to determine g the unit is available with
a gutter to. After a discussion regarding where the water flows, it was stated it was not necessary to have gutters.
• Installing posts was discussed to protect the cooler.
• The planting looks good, it is fuly vegetated
• The grease trap was discussed. The commission had concerns with the grease trap leaking. The applicant answered the
grease spots are from an old grease trap; but he had added a drip pan which would help just in case of an over flow. Mr.
Fishul will follow up the building owner g the grease trap can be moved.
• The abutters concern of missing fence pieces was brought up; they have light coming in their house. Mr. Fishul sees no
reason that the fence cannot be fixed. It was noted, the Commission has no jurisdiction over the fence, and the applicant sbll
needs to go to the CPDC for a review.
The applicant will come back to the Commission once he finds out some answers to their concerns.
RDA 13-21,105 Fairchild, Map 45 Lot 23, Davie
Mc Davie reviewed his application with the Commission. He would like to construct anew 16'x 24' above ground pool equipped with a
non -discharge cerbidge filtration system. The builder, Mr. Henshall stated he flagged the area out. The flagged area includes the pool
and a cantilever deck. The expansion of the foot print to accommodate a larger pool will go up the hill, away from the resource area;

the above ground pool will be located 40' from wetlands. Mr. Maugham asked the homeowner what he is going to do with the gravel
area, by the swing set. The homeowner confirmed he is going to take out the gravel and agreed to plant native shmbbery in the area
Mr. Timne asked that he receives a call once the erosion control in installed.
Motion made by Mr. Maughan to issue a negative determination for above ground pool. Mr. Sullivan seconded. Vole was 5.0-
0.

Mr. Tirane reviewed his question to the Commission, "how much of a lawn would the Commission allow?"
544 Pead Street, O'Connell, replace front steps
Mr. Tirane reviewed the building pent application. It was to reconstruct masonry brick front steps. They will be removing the steps
entirely.

Ms. Scanlon asked it Mere are any final comments regarding the brochure created by Ms. St mean. She will pass on the comment to
site sources.

Mr. Tirane stated the Commission received additional information in the last email they received. He said Mr. Maughan had changes
since the order of conditions were drafted. Mr. Tilton reviewed the revised plans. He said they were needed because of the request of
CPDC to add parking spaces and to show the weir that the Conservation suggested. Mr. Maughan talked about his discussion with Mr.
Zambouas, Town Engineer regarding the weir. He said Mr. Zambouras has agreed to do a hydraulic analysis after a permit is !awed
to the applicanL Engineering will look at drainage from Route 28 and the site; and we the impact with the increase storage from
restoration "a" and "b°. He will let the Commission know if the weir would be necessary in wetland "d. The Order of Conditions would
accommodate what Mr. Zambouras suggested. Mr. Hayes talked to the Commission about the brook by his property. He questioned
why the Town does not clean this out; they have in the past. He asked were the water would go once the building is built. He stated
the water table comes up and water comes into his Muse now, but no damage. Ms. Scanlon let Mr. Hayes know that this project will
improve infiltration; If will sloe the water down. Mr. Latham questioned If this change would invite the DEP to appeal the Omer of
Conditions. Ms. Scanlon had concerns that no new information should be received, the Public Heading was closed. Auer a discussion
with the applicant, it was decided the hydraulic analysis from Engineering could be reflected in the Ober of Conditions.
The Commission reviewed the Order of Conditions. The following was discussed:
• Finding 1 - The data of plans and it they should include the supplement in the conditions. it was agreed to add "discussed
and supplements received through 26 August 2013.. "
• Finding 2- The aquae feet of the building should be 34k -21k is the foot print— both will be added to the findings.
• Finding 2 - The parking spaces should be 41
• Finding 2- Is 2640 the correct square feet of wetlands; it might be reduced by the berm
• Finding 2— additional word corrections were added
• Finding 5— Mr. Latham had concems about additional word corrections were added.
• Finding 6— takeout 21k and just add 'building ". It should say "pavers"
• Finding 7— "plans described in Finding 1" and word changes
• Finding 6 -15 month construction period
• Finding 13— change "proposes" to "committed ". Wording when an environmental monitor is needed was added
• Ms. Scanlon would like an additional finding added — replacement of trees being col and the replacement should be put into
the conditions
A number of additional or modified conditions were discussed and those agreed to are reflected in the Order of Conditions.
Mr. Throne asked Mr. Tilton to reply to the email that he sent to him.
• Revision plan is still needed
• Weir resource impact is 235 square feel
• Mr. Timne questioned it the applicant should recalculate the fees based on the actual work that is going to be done. The
Commission discussed this and agreed the wetland repkcation is an improvement. It has not been the Commission's
practice in the past to include wetland creation area in the calculation of fees; it was also noted, that the applicant was not
looking for a refund of fees for a smaller area of disturbance..
Motion made by Mr. Maughan to issue the order of conditions for DEP 270-0615 - 1090,1100 Main Street Order ofCandiOdns

Mr. Latham let the Commission know the applicant still needs to go to ZBA. The construction might be pushed o6 until next year.

Mr. Tirane reviewed the application. The Commission talked about the wall being taken down and the area graded out. The applicant
will build a small wall if necessary.
Motion made by Mr. Sullivan to approve the order of conditions as drafted. Mr. Sells seconded. Vote was 5-0-0.
CDC 272-0598,198 Forest Street, Map 32, Lot 237, Castiglia
The site visit was talked about. The lawn was good and the area behind the fence looked dean. Ms. Scanlon questioned if mowing
was being done by Mr. Castiglia. After looking at the plan, it was decided it was the neighbors property.
Motion made to issue the Confiscate of Compliance DEP8272 -0598. Mr. Sullivan seconded. Vote was Si
10 Pasture Road discussion of next steps, Rotstein
Mr. Sergio reminded the Commission he is requesting an amendment of mawing frequency on the Conservation area. He would like to
mow It with a tractor monthly during the growing season, Apol through October, for economic reasons. He talked about making an
area, close 0 Pasture Road, a replacement area. He suggested not mowing this area any longer and let nature take over. Mr.
Maughan asked if he is willing to do a bordering buffer zone in this area. The owner agreed; but, stated in the past the shrubs hale
died.
The Commission discussed the procedure on how to change a dead restriction. They asked the applicant to look into a fomtal creation
plan. Because the plan is needed to put into the deed, they suggested he should get professional assistance creating R. He will come
back to the Commission once the plan is done.
Castine Field
Mr. Maughan let the Commission know the Cattails have been cut on the west and of Castine Meadow. He asked why the signs were
never put up that the Commission requested. Mr. Tirone stated he didn't realize he had the okay to buy them. He will contact the DPW
and remind them no cutting. Mr. Sullivan is going to call the sign shop and get a quote.
Conservation sign discussion
Mr. Tirane wanted to know 8 the Commission would like to charge for the'Wedand Conservation Restricted Area' signs. The new
signs vary in cost based on number purchased with the highest cost $2.11. Ms. Scanlon stated this cost to the applicant is not
substantial and would like to charge the applicant. After a discussion, the Commission agreed that the signs encourage the use and will
not charge, Once the existing stock of >100 signs has been depleted and replacement is needed, the Commission will discuss then d
they should charge.
Wetland District Overlay discussion
The Commission discussed the zoning bow 4.5- Wedand District Overlay. it was created in 1970 or early 1980's; ftwas before the
wetland bylaws. If the Commission voted to eliminate it, it would not change any protection; but if not eliminated, it would have to be
enforced. It was stated a public hearing is needed to be able to eliminate. It maybe possible to accomplish through CPDC's Zoning
Bow Public Hearing.
Motion made by Ms. Scanlon to recommend the Commission that CPDC strike 4.5 Weiland District Overlay from the zoning
bylaw. Mr. Maughan seconded. Vote was 5 -0-0.

Motion made by Mr. Maughan to accept the minutes ofAugusf 14, 2013, as amended. Mr. Scott seconded. Vote was 5.0 -0.
