ZONING BOARD OF APPEALS
Minutes of September 13, 2012

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M.

A Public Hearing on the petition of David P. Johnson who seeks a Special Permit under Section
6.3.8 of the zoning bylaws in order to demolish an existing single family dwelling located on a
non - conforming lot and to construct a new single family dwelling as per plans submitted on the
property located at 173 Grove Street in Reading, MA.
David Jobnson presented his proposal to the Board. He is buying the property and he intends to
tear down the single family dwelling that is in bad repair and to replace it with a single family
garrison colonial with a two -car garage under. It will cover 13% of the 7,642 square foot lot. The
new dwelling will meet all setbacks unlike the old dwelling.
Ms. Hackett questioned the height with the garage under and two stories above it and Mr.
Johnson said it meets the requirements and is in fact less than the maximum allowed.
Mr. Jarema asked questions about the grading of the foundation and Mr. Johnson said the grade
in the back is level and he will install a patio on the ground.
The Vice Chair asked about the stone wall on the property and Mr. Johnson said there are a few
railroad ties in the front.
Mr. Jarema said there is some curvature in the front of the property and it looks like the property
is a foot and a quarter over the 75.' Mr. Johnson said it does flare out on the tight hand side.
Mr. Johnson said he was purchasing the property next Tuesday and Fannie Mae gave permission
to present the petition to the Board. His purchase is based on the contingency that his proposal
will be approved by the Board.
The Vice Chair said this is a legal non - conforming lot and the proposed new dwelling meets all
setback requirements for an S -20 zone. The new dwelling is not more detrimental to the
neighborhood than the original dwelling.
Carol Tribou of 167 Grove Street asked a few questions about the garage, the ledge, and trees on
the property that Mr. Johnson responded to.
John Gardner of 177 Grove Street asked about the driveway and Mr. Johnson responded.
Zoning Board Member Mr. Traniello has worked as a private individual for Fannie Mae in the
past and wanted to disclose this.
Mr. Johnson said he would like a vote this evening even though there were only four members
present.
On a motion by John Jarema, seconded by Kathleen Hackett, the Zoning Board of Appeals
moved to grant the Applicant a Special Permit under Section 6.3.8 of the Zoning Bylaws in order
to demolish the existing single family dwelling and detached garage and construct a new two -
story single family dwelling on a non - conforming lot on the property with the following
conditions:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
3. As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The vote was 4 -0 -0 (Redfern, Jarema, Hackett, Traniello)

On a motion by David Traniello, seconded by Kathleen Hackett, the Zoning Board of Appeals
moved to accept the minutes of July 12, 2012 with changes.
The vote was 3 -0 -0 ( Traniello, Redfern, Hackett).
Adjournment
On a motion by John Jarema, seconded by David Traniello, the Zoning Board of Appeals moved
to adjourn the meeting.
The vote was 4 -0 -0 (Redfern, Jarema, Hackett, Traniello).
