ZONING BOARD OF APPEALS
Minutes of July 12, 2012

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M.

A Public Hearing on the petition of the Town of Reading who seeks a Variance under Section
5.1.2 / 5.2.1 a / 5.2. Lb/ 5.2.1 c of the 5.2.2 zoning bylaws in order to construct a single family
dwelling on a non - conforming lot on the property located at 50 Lothrop Road in Reading, MA.
Peter Hechenbleikner, Town Manager, and Gary Brackett, Town Counsel, presented the proposal
to the Board. Mr. Hechenbleikner explained the history of the property and how the Town came
to own it. It was originally thought to be land on which to put a water tower but it was never
needed for that purpose. It has been determined that the Town will sell this property along with
some other Town owned parcels. This is the only parcel that would need a Variance in order to
be built upon. The lot will be sold to the highest bidder. Originally, the parcel was in the S -10
zoning district and is now in the 5 -15 zoning district. The other residential lots in the
neighborhood are similar or smaller in lot area and have less than the required frontage for a lot
in an 5 -15 zoning district.
Attorney Brackett reviewed the submitted Variance criteria required in order to obtain a
dimensional Variance. This lot has more than adequate square footage but has a somewhat
reduced frontage that was acceptable when this property was classed as an S -10 lot before the
change for the area to 5 -15. It will be a larger residential lot than others in the area but it will not
be able to be sub - divided. It will not detract from the neighborhood in any way. The lot was
created in July 1958 and it is 34,000 square feet. Proposed building on the lot will meet all
setback requirements of the S -15 zoning district.
The Board members asked some questions that were answered by Mr. Hechenbleikner and
Attorney Brackett. The lot will be used for one single family home only and no Chapter 40B
projects will be allowed to be constructed on this site.

Raymond Rose of 58 Lothrop Road said the property to the right has new owners who probably
did not get any information about what is happening. He wanted the proposed conditions by the
Board of Selectmen to be placed as conditions on the Variance by the Zoning Board of Appeals
as well. Mr. Hechenbleikner said it would be up to the Selectmen to impose any conditions and
Attorney Brackett further explained the process for Mr. Rose. Mr. Hechenbleikner explained the
bidding process will list any conditions imposed by the Selectmen.
The Vice Chairman said the Zoning Board could state on the Variance that the property is to be
for a single family dwelling only.
On a motion by John Miles, seconded by Damase Caouette, the Zoning Board of Appeals moved
to grant the Applicant a Variance from Section 5.1.2 /5.2. la / 5.2. lb / 5.2.1c / 5.2.2 of the Zoning
Bylaws In order to construct a single family dwelling on the property as depicted on the
referenced Certified Plot Plan.
The vote was 5 -0 -0 (Redfern, Miles, Caouette, Traniello, Hackett).

On a motion by John Miles, seconded by Robert Redfern, the Zoning Board of Appeals moved to
nominate Damase Caouette as the Chairman.

On a motion by John Miles, seconded by Robert Redfern, the Zoning Board of Appeals moved to
nominate Robert Redfern as the Vice Chairman.
The vote was 5 -0 -0 (Redfern, Miles, Caouette, Traniello, Hackett).
Minutes
On a motion by Damase Caouette, seconded by John Miles, the Zoning Board of Appeals moved
to approve the minutes of May 10, 2012.
The vote was 3 -0 -0 (Caouette, Miles, Redfern).
On a motion by John Miles, seconded by Damase Caouette, the Zoning Board of Appeals moved
to approve the minutes of May 24, 2012.
The vote was 3 -0 -0 (Caouette, Miles, Redfern).
On a motion by Damase Caouette, seconded by John Miles, the Zoning Board of Appeals moved
to approve the minutes of the Executive Session on May 24, 2012 by a roll call vote.

The vote was 3 -0 -0 (Caouette, Miles, Redfern).
Adjournment
On a motion by Kathleen Hackett, seconded by David Traniello, the Zoning Board of Appeals
moved to adjourn the meeting at 8:30 PM.
