ZONING BOARD OF APPEALS
Minutes of May 10, 2012
Members Present: Robert Redfern, Vice Chairman

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M. Also in attendance
was Glen Redmond, Commissioner of Buildings.
Case 12 -06
A Public Hearing on the petition of Steven L. Cicatelli who seeks a Variance under Section(s)
5.0 of the zoning bylaws in order to construct a new single family residential dwelling on a
nonconforming lot on the property located at 60 Mount Vernon Street in Reading, MA. This lot
is located in an S -15 District.
The Vice Chairman advised the Applicants that since there were only four members present this
evening, any vote would have to be unanimous by the four members present. If they wanted to
continue the case in order to appear before a full Board they could make such a request.
Attorney Steven Cicatelli requested a continuance to May 24 so that a full board could be
present.
On a motion by Damase Caouette, seconded by John Jarema, the Zoning Board of Appeals
moved to continue the hearing to May 24, 2012.
The vote was 4 -0 -0 (Redfern, Jarema, Caouette, Miles).
Case 12 -07
A Public Hearing on the petition of Edward Newton who seeks a Special Permit under Section(s)
4.3.2.8 of the zoning bylaws in order to create an accessory apartment on the property located at
43 Belmont Street in Reading, MA.

The Vice Chairman advised the Applicants that there were only four members present this
evening and a favorable vote would require three of the four members present. Mr. Newton said
he wished to have his case heard. He outlined his proposal and said there would be no changes
structurally or to the outside of the dwelling. The accessory apartment is for his college graduate
son so he would have a place for himself.
The Building Inspector said it was a typical request and it meets the requirements for an
accessory apartment. Mr. Jarema thought there was supposed to have been a walk - through of the
dwelling prior to the hearing. He also had questions as to the history of the dwelling because the
area of the house involved in the requested accessory apartment was not there in 1982 and
therefore was not occupied prior to 1982 as required. Mr. Newton said part of the apartment is in
the original footprint.
The Vice Chairman said the petition needed to be presented to the Board as a Variance /Special
Permit request and it would have to be a new case.
The Applicant requested that the case be withdrawn without prejudice.
On a motion by John Jarema, seconded by Damase Caouette, the Zoning Board of Appeals
moved to allow the case to be withdrawn without prejudice.
The vote was 4 -0 -0 (Redfern, Jarema, Caouette, Miles).
Case 12 -04
A continuation of a Public Hearing on the petition of Chimney Hill Real Estate LLC, Mark Hall,
who seeks a Special Permit under Section(s) 6.36 & 6.3.8 of the zoning bylaws in order to
demolish an existing single family dwelling & garage and construct a new single family dwelling
on a non - conforming lot as per plans submitted on the property located at 41 Richards Road in
Reading, MA. The house foundation is to remain.
The Vice Chairman advised the Applicants that there were only four members present this
evening and a favorable vote would require three of the four members present. The Applicant
wanted to have the case heard.
Nancy Toomey presented the new proposal as per the plans submitted but there is a possibility,
based on cost that the new buyer may want to add a full front porch.
The Building Inspector said the application was for a typical tear down and rebuild.
The Board members thought the proposed dwelling would fit into the neighborhood. There were
some questions about elevation that were answered by Ms. Toomey. The approximate footprint
of the proposed dwelling is 2,090 square feet without the front porch and, the lot coverage of the
proposed dwelling is approximately 14 %.

On a motion by Damase Caouette, seconded by John Miles, the Zoning Board of Appeals moved
to grant the Applicant's request for a Special Permit under Section 6.3.8 of the Zoning Bylaws in
order to permit the demolition of the existing single family dwelling and to construct a new
single family dwelling on a non - conforming lot on the property as shown on the certified plot
plan and architectural drawings.
This Special Permit is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The vote was 4 -0 -0 (Redfern, Caouette, Jarema, Miles).
Adjournment
On a motion by John Jarema, seconded by John Miles, the Zoning Board of Appeals moved to
adjourn the meeting.
