A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts beginning at 7:00 P.M. Also in attendance
was Glen Redmond, Commissioner of Buildings.
Case # 11 -26
A continuation of a Public Hearing on the petition of McNeil Builders LLC who seek a Variance
under Section(s) 5.1.2 of the zoning bylaws in order to construct a deck 10' x 12' that encroaches
into the required side yard setback of 15.0' on the property located at 49 Weston Road in
Reading, MA.
Michael McNeil, agent for the owners /applicants, Stephen & Wendy Gallante, presented the
revisions made to the plot plan and the deck has now been reduced in size to 8.5' x 12' and the
addition reduced by 7inches to meet the required setback so they can request a Special Permit
instead of a Variance.
With the revised plot plan, there are no new non - conformities. The Special Permit should be
requested under Section 6.3.2 of the Zoning By -laws and the Applicant, Mrs. Gallame, requested
that her Special Permit request be done under this section. The Board members agreed that this
was the correct section for the Special Permit and the petition with the revised plot plan appeared
straightforward.
The Building Inspector said the size of the deck was adjusted on the revised plot plan to comply
with the zoning by -laws setback requirements.
On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals moved
to grant the Applicants a Special Permit under Section 6.3.3.2 of the zoning bylaws in order to
demolish the existing deck, construct a new 12' x 8.5' deck and construct a 14' x 11.5' x 12'
addition at the northwesterly comer of the existing dwelling, as depicted on the referenced
revised Plot Plan prepared and stamped by Leo. B. White, R.L.S. and dated December 9, 2011
and, in general conformance with the four page drawing packet submitted by McNeil Builders,
LLC, dated December 21, 2011.
This Special Permit is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The vote was 5 -0 -0 (Perkins, Redfern, Miles, Jarema, Caouette).

On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals
moved to accept the minutes of October 6, 2011.
The vote was 4 -0 -0 (Redfern, Perkins, Jarema, Caouette).
On a motion Robert Redfern, seconded by John Miles, the Zoning Board of Appeals moved to
accept the minutes of October 20, 2011.
The vote was 5 -0 -0 (Perkins, Redfern, Miles, Jarema, Caouette).
On a motion John Jarema, seconded by Jeffrey Perkins, the Zoning Board of Appeals moved to
accept the minutes of November 3, 2011.
The vote was 5 -0 -0 (Perkins, Redfern, Miles, Jarema, Caouette).
On a motion by John Jarema, seconded by Jeffrey Perkins, the Zoning Board of Appeals moved
to accept the minutes of December 1, 2011.
The vote was 5 -0 -0 (Perkins, Redfern, Miles, Jarema, Caouette).
Adjournment
On a motion by Damase Caouette, seconded by John Miles, the Zoning Board of Appeals moved
to adjourn the meeting.
