HomeMy WebLinkAbout2004-05-05 Retirement Board MinutesN-67.0 The Reading Retirement Board held a meeting on May 5, 2004, in the Accountine and Finance Department Office, Town Hall, Reading, Massachusetts. The meeting was called to order at 6:05 P.M. John Whalen, who worked for the DPW and retired on January 31, 1994, passed away on 4/16/04. He chose Option B at his retirement and has a remaining annuity balance of $4,663.30. However, his beneficiary was his wife who predeceased him by a couple of weeks. In the board's judgment his five children are entitled to the funds but the board wants to check with PERAC that they have the right to do this. Judy Corrigan, attorney at PERAC, confirmed that the board has the right to do this in accordance with M.G.L. c. 32, § 11(2)(b). The board voted unanimously to distribute the funds equally among John Whalen's five children. Attorney Nicholas Poser attended this meeting to discuss the next steps the board should take with regards to Robert Toussaint's accidental disability retirement application. Attorney Poser's suggestion was that the board should hold a hearing in accordance with 840 CMR 10.09. The board requested that Attorney Poser draft a letter pursuant to 840 CMR 10.09, which the board will discuss at the May 26" meeting.
