DRAFT MOTIONS BOARD OF SELECTMEN MEETING DECEMBER 6, 2011 Anthony, Gelds, Tafoya, Bonazoli, Schubert Hechenbleikner lc) Move that the Board of Selectmen extend the time to serve alcohol and food for all restaurants subject to the Town Manager's approval from 12 midnight to 12:30 a.m., while maintaining the requirement that all patrons be off the premises by 1 am on Sunday, January 1, 2012. 5a) Move that having convened in an open meeting on December 6, 2011, the. Board of Selectmen of the Town of Reading, in accordance with its charter, by-laws, and ordinances, has voted to authorize the Superintendent to submit to the Massachusetts School Building Authority the Statement of Interest Form dated December 2011 for the J. Warren Killam Elementary School located at 333 Charles Street, Reading, Massachusetts which describes and explains the following deficiencies and the priority categories for which an application may be submitted to the Massachusetts School Building Authority in the future: Priority Category 5: Replacement, renovation or modernization of school facility systems, such as roofs, windows, boilers, heating and ventilation systems, to increase energy conservation and decrease energy related costs in a school facility. Deficiency: The current windows are a single pane, non-insulated, glass and transite panels which are in poor condition offering little protection from air infiltration and allowing water to leak into the space: The building is not handicap accessible and, therefore, not compliant with 521CMR regulations. The building lacks sprinkler protection and is thereby not compliant with MGL c. 148, s. 26G. The goal of the project is to replace all windows with high efficiency windows offering better property protection and operability, and to make all necessary improvements to ensure the building is fully compliant with all state and local regulations and requirements, and to provide for a full range of educational programs within the building. 0 The Board of Selectmen of the Town of Reading hereby further specifically acknowledges that by submitting this Statement of Interest Form, the Massachusetts School Building Authority in no way guarantees the acceptance or the approval of an application, the awarding of a grant or any other funding commitment from the Massachusetts School Building Authority, or commits the Town of Reading to filing an application for funding with the Massachusetts School Building Authority. 5e) Move that the Board of Selectmen approve applications by: ♦ SammyJo's Bakery at 2 haven Street 0 Dunkin Donuts and West Street Mobil, 4 West Street ♦ Starbucks Coffee, 24 Walkers Brook Drive ♦ Starbucks Coffee, 288 Main Street to open at 5:00 a.m., Monday through Friday, effective January 1, 2012, and excluding State designated holidays. This approval will expire December 31, 2012. The Board of Selectmen finds that in accordance with Section 5.10.4 of the General Bylaws: • It is in the interest of the public health, safety and welfare or that public necessity or convenience will be served by permitting such operation; and • There is no detrimental effect of such operation on the Town or the immediately abutting neighbors. Move that.the Board of Selectmen approve an application by: ♦ J.K.'s Market, 212 Main Street to open at 5:45 a.m., Monday through Friday, effective January 1, 2012, and excluding State designated holidays. This approval will expire December 31, 2012. The Board of Selectmen finds that in accordance with Section 5.10.4 of the General Bylaws: • It is in the interest of the public health, safety and welfare or that public necessity or convenience will be served by permitting such operation; and • There is no detrimental effect of such operation on the Town or the immediately abutting neighbors. 5f) Move that the Board of Selectmen approve the application for 24 hour sales by 87 Walkers Brook Drive, LLC and Leigh D Enterprises, Ltd. d/b/a Reading Shell Station at 87 Walkers Brook Drive. The Board finds that in accordance with Section 5.10.4 of the General Bylaws: • It is in the interest of the public health, safety and welfare, or that public necessity or convenience will be served by permitting such operation; and • There is no detrimental effect of such operation on the Town or the immediately abutting neighbors. • The Board determined that in accordance with Section 5.10.5 that no public hearing will be required for this application. The approval of this application is subject to the following conditions: 1. This approval expires at midnight, December 31, 2012; 2. All signs shall conform to the Zoning By-Laws of the Town of Reading; 3. The gasoline service station shall, in fact, be open 24 hours a day, seven days a week; 4. The operator will ensure that there is a supply of gasoline available at the station during all hours that the station is open; 5.. The operator will provide gas cans for motorists who run out of gasoline on the road; 6. The operator will prepare and post a list of local towing and repair shops that are open 24 hours a day for those who need it; 7. Restroom facilities shall be open 24 hours a day, seven days a week. Move that the Board of Selectmen adjourn the meeting at, p.m. 5 Upcoming RMLB Vote on RECs (Renewable Energy Certificates) & Rates Tomorrow evening, December 7, the Reading Light Board will vote on what use to make of the RECs the RMLD receives from its sustainable power contracts. For the years 2011 and 2012 the value of these RECs averages $495,000 per year - with the value increasing to nearly $1.7 million per year for 2013 and after. At its December 5 meeting, the RMLB's Power & Rate Committee voted 2 to 1 not to sell these RECs, but just to hold on to them and let them expire. So I come before the Board of Selectmen these evening to inform you and the community of this upcoming vote in the hope that community pressure may convince the RMLB to overturn the committee's Monday vote and to sell these RECs. The RMLB members who voted not to sell the RECs are Richard Hahn and Gina Snyder. The two other RMLB members who will be voting on Wednesday are Mary Ellen O'Neill and Philip Pacino. Therefore the following guidelines are established by the Board of Selectmen for a youth liaison to the Board of Selectmen. These guidelines will help the Board of Selectmen as well as the youth liaison in understanding the appointment process, and the roles and responsibilities of the youth liaison. . Appointment Process • Length of term - 1 academic year (in the event of 2 outstanding candidates, the year may be split on January 1 between 2 individuals). • Term begins September 1, ends May 31. • Preference is for a High School Junior, so that there may be some continuity in the position, and in consideration of the increasing student workload during their Senior year. • "Nominations" may be by a student (self nominated), other students, teacher(s), Principal, School Administration, community, or the Board of Selectmen. • Selection will be by a committee made up of the Chairman of the Board of Selectmen or designee from the Board of Selectmen, Superintendent of Schools, and RMHS Principal. Role of Youth Liaison • Attend on average 1 Board of Selectmen meeting per month - to be determined by the Chairman of the Board of Selectmen based on the agenda of the meetings. • The Board of Selectmen will try to set the agenda with the attendance of the youth liaison in mind, and trying to make it convenient for the youth liaison to leave the meeting at 9 PM. • The youth liaison will be welcome to attend and fully participate in all activities of the Board of Selectmen except for voting, and the youth liaison will not attend Executive Sessions of the Board of Selectmen. • The youth liaison will be provided with a full packet (except for Executive Session material) ahead of each meeting he/she will be attending, and the youth liaison will be expected to read the packet ahead of the meeting in order to be fully prepared for the meeting. • The youth liaison is welcome to give a liaison report along with the members of the Board of Selectmen, but is not required to do so. It will be helpful for the youth liaison to let the Chairman of the Board of Selectmen know in advance if they will be making a report. • The outgoing youth liaison will, where possible, provide some level of orientation to the incoming youth liaison annually. • The youth liaison role is not to answer questions about School matters, or to report on School Department matters. Hechenbleikner DATE: December 6, 2011 RE: Meeting Re: National Grid On November 30, 2011, Camille Anthony, Chief . Greg Burns, Town Engineer George Zambouras and I met, with the assistance of Senator Katherine Clark's office, with representatives from National Grid. Attached is a list of attendees. The discussion revolved around two issues - the immediate issue of replacement of the gas main on Wilson Street, and the broader issue of gas main replacement within the Town and within the National Grid area. National Grid indicated that they have been able to devote twice the money in 2012 that they spent in 2011 on gas main replacement. The funding that they currently have will replace 130 miles of "leak prone" gas line of the 3000 miles of "leak prone" gas line within the Commonwealth. At this rate of budgeting, it will take 23 years to replace all of that existing stock. The current level of expenditure should be able to be maintained in the long run. In Reading, there is probably 60 miles of gas main in the public streets, and an estimated 26 miles is the old cast iron or uncoated steel line. Not all of that line is currently "leak prone." With regards to the specifics of Wilson Street, the gas company will be starting the construction of the new gas main in January. The Engineering Office will send a letter to Wilson Street residents letting them know of the gas main replacement, and then the road reconstruction next spring/summer. There was further discussion about better coordination of road construction projects with gas main projects. The gas company currently has a program of gas main replacement over the next three years, with specific projects to take place during the coming construction season. Engineering and gas company employees will share information to better coordinate road reconstruction with gas main replacement. As you noted, I was present at the hearing earlier this year and did raise some concerns about the business and property. To me, these concerns highlighted the owner's record of poor follow-through, which might have some bearing on his request to open early. The concerns were: 1) trash trucks arriving earlier than the 6:30 a.m. town ordinance, 2) the dumpster being left open to rodents and seagulls, 3) the fence erected between our properties knocked over and wire mesh not installed to keep trash from blowing onto my property, and 4) landscaping that was to have been implemented to offset the cutting of trees in the wetlands not completed. Since the initial hearing, I have noted improvements in the trash truck arrival times and the dumpster being properly closed. I do not know whether the Board of Health followed up to make sure the businesses were observing its codes. The fence is still knocked down with no wire mesh underneath, and the landscaping remains to be done. However, these two issues are things we need to follow up with the Conservation Commission, since they concern preservation of the wetlands between the business and my property. I therefore have no objection to the business getting its permit renewed, but would request that this renewal process continue to allow abutters to raise any concerns annually, so that there is accountability.
