5b) Move that the Board of Selectmen approve the application.for a Junk
Dealers License for CTC Gold Refinery at 75 Haven Street, Reading
with a term expiring December 31, 2011 and subject to the following
conditions:
1. CTC Gold Refinery shall keep a bound book, or other means
acceptable to the Chief of Police, in which shall be recorded at the
time of each purchase, a description thereof, the name, age and
residence of the person from whom the purchase was made, and
the day and hour when such purchase was made. All items of
precious metal shall be photographed.

2. CTC Gold Refinery shall take and maintain photocopies of a valid
driver's license or passport for any person who.sells or barters an
item of precious metals.
3. CTC Gold Refinery shall submit to the Reading Police
Department within one (1) week of each purchase or acquisition a
list of all purchases and acquisitions including a copy of the valid
identification and the photographs of the items in a manner
promulgated by the police department.
4. The Chief of Police or his designee shall at all times have the
authority to inspect or examine all books or other records kept by
the CTC Gold Refinery for the purchase, sale or barter of junk,
and old and precious metals, and shall have the right to inspect
and examine all precious metals therein.
5. CTC Gold Refinery shall not directly or indirectly purchase or
receive by way of barter or exchange any old and precious metals
from a person under the age of eighteen (18) years:
6. No item purchased or received by a dealer in precious metals
licensed under this bylaw shall be removed from the town, sold, or
otherwise disposed of by CTC Gold Refinery for at least fourteen
(14) days from its date of purchase or acquisition and for at least
seven (7) days from the notification made to the Police
Department unless permission has been obtained from the Chief
of Police or his designee who may request to inspect the item.
7. All weighing or measuring devices used by CTC Gold Refinery in
the conduct of the licensed business shall be tested and sealed by
the Townof Reading Sealer of Weights and Measures prior to
being placed into service. All weighing and measuring devices
shall thereafter be inspected and tested on an annual basis.
8. The licensee shall continuously abide by all rules, regulations,
policies, bylaws and statutes of the Town of Reading and the
Commonwealth of Massachusetts during the term of the license.
8. The license issued hereunder may be suspended or revoked, after
a notice and hearing, for cause or violation of the conditions of
this license.

Administrative matters

What a wonderful TREAT. I am shocked at the level of generosity! I can not wait
to share this info with the members of RCD Inc, and all those that have worked so
hard in both towns of Reading. Your town is remarkable, such a blessing to our
community. "
♦ Town Accountant Gail LaPointe has announced her retirement at the end of June
2012. 1 would suggest that 2 members of the Board of Selectmen work with me and
the HR Administrator to develop a recruiting plan for Gail's replacement. Steve
Goldy is the Board of Selectmen liaison to Accounting. Attached is the memo
submitted to the Board of Selectmen the last time we went through this process.
® Due to Election deadlines The Town Clerk's office only at Town Hall will be open on Friday
November 4th and December 23rd from 9:00 am to 5:00 pm.

Town Construction proiects
♦ Milling of Lowell Street, between Bradford Road and Hartshorn Street will occur
this Wednesday and Thursday (Nov. 2nd 3~d) evening between the hours of 7:000M
and 3:00 AM. The roadway will be open to traffic and one lane of traffic will be
shuffled around the work area. Following milling the contractor will be replacing
approximately 2 dozen casting that are worn and need replacement. Final paving
will occur during daylight hours at a date to be determined once castings work is
completed.
♦ Roadway Reconstruction - reclaimed: Causeway Rd. &Hanscom Avenue.
♦ Roadway Overlay: Done for the year.
♦ Micro-Seal -will not be done this year.
♦ Memorial Park
♦ Haverhill Street Water Main: The contractor will complete installing new water
main up to Rustic Lane by the end of the week. The contractor will then install water
services and activate the section of water main from Franklin to Rustic. It is
anticipated the above work will be completed on or before November 15th. All
remainder contractual work will resume next spring

Blasting Update:
Reading Woods:
Precision Drilling and Blasting is scheduled to begin blasting Monday, November 7, 2011. The
contractor is estimating 45 days of blasting. The hours of blasting will be from 10:00 AM to 2:00 PM.
Phase I will be in East end of the site and will be near homes. The State Police have required the
highway on ramp to be shut down with rolling road blocks for this blasting.
Phase H will be in the in the area where the tower building was located. The State Police have required
the -highway to be shut down with rolling road blocks for this blasting.
MWRA:
Albanese D&S has run into a delay due to an underground duct bank. They estimate they will begin
blasting in Reading on Thursday, November 3, 2011 or Sunday, November 6, 2011. The contractor is
estimating 14 nights of blasting.

MEMORANDUM

RE: Hiring - Town Accountant
As you are aware, the Town Accountant will be retiring in September of 2005. I have provided
in the FY2006 budget some monies for "overlap" to hire his successor before he leaves.
The Town Accountant's duties are described by State law and by the Reading Home Rule
Charter. Attached is a copy of the job description. The position is appointed by the, Board of
Selectmen annually, and reports to the Town Manager for day to day administration.
I• would recommend the establishment of a screening committee, which would review the job
description, advisee the Human Resource Administrator on the advertising and recruitment
process and would screen applicants with the goal of providing between one and three finalists to
the Board of Selectmen for final selection.
I would recommend a screening committee consisting of one or two members of the Board of
Selectmen, a member of the Finance Committee, a member of the School Committee or their
designee and the Town Manager. It is my intent to seek through the Accounting Manager of the
RMLD, any- input from the Light Department that would be valuable in reviewing or revising the
job description, and in screening a candidate.
I would anticipate that by mid-July we would have the screening completed so that the Board of
Selectmen could make a decision by early August. I would anticipate having the candidate. start
work on or about September 1, 2005.

GENERAL PURPOSE
This is a department head level position which performs technical and
administrative work in maintaining the financial records of the Town.
SUPERVISION RECEIVED
Appointed by the Board of Selectmen annually and, works under the general
supervision of the Town Manager. '
SUPERVISION EXERCISED
Supervises accounting and retirement support staff.
ESSENTIAL DUTIES AND RESPONSIBILITIES
Determines work procedures and expedites work flow; studies and standardizes
procedures to improve efficiency and effectiveness of operations.
Responsible for maintaining accurate financial records of the Town and prepares
the annual financial statements of the Town.
Responsible for internal audits of Town Departments.
Prepares a variety, of studies, reports, and related information for decision-
maldrig.
Prepares financial reports and provides financial data as required or requested by
Federal, State, or other governmental jurisdictions, investment, bankers, . and bond rating
services,, educational and research organizations, auditors and actuaries, citizens and-
taxpayers.
Advises Town officers and departments in their day to day financial
administration.
Certifies the accuracy and legality of all financial transactions..
Responsible. for the administration of the Town's retirement system.
PERIPHERAL DUTIES
Serves as a member of various employee committees.
One of five members of the Contributory Retirement Board.
DESIRED MINIMUM QUALIFICATIONS
Education and Ex ep rience:
(A) Graduation from an accredited four-year college or university with a degree
in accounting, business management, finance or a closely related field, and
(B) Minimum of three (3) years of accounting experience (pursuant to the Town
Charter); or
(C) Certification as "Certified Governmental Accountant" desirable;
(D) Certified Public Accountant is desirable.
NecessarKnowledge, Skills and Abilities:
(A) Extensive knowledge of accounting and auditing theory, principles, and
practices.
(B) Considerable knowledge of governmental accounting and financial reporting
standards.
(C) Understanding of Commonwealth of Massachusetts' "Uniform Municipal
Accounting System" manual.
(D) Understanding of Commonwealth of Massachusetts General Laws pertaining
to municipal finance acid to retirement.
(E) Understanding of applicable Federal, State, and Local regulations pertaining
to financial management.
(F) Ability to supervise staff.
SPECIAL REQUIREMENTS
Per Reading Home Rule Charter, the Town Accountant shall have at least three
years of accounting experience before being appointed.

Specific Responsibilities of the Town Accountant
The. Town Accountant maintains the Town's financial retards. At year-end; the financial records
of the Town•need to be closed on a timely basis In order that the town Accountant can:
Prepare and submit a balance sheet and supporting documentation to the Division of Local
Services for the certification of free cash
• Prepare the Annual Financial Statements in. accordance with generally accepted \
accounting principles
■ Complete and submit Schedule A to the Division of Local Services
• Complete and submit the End of Year Pupil and Financial Report to the Department of
Education
The role of the Town Accountant in the development and tracking of the Town's annual
operating budget is to:
■ Create the budget forms
• Distribute forms to each.department with the actual expenditures from prior years and the
estimated expenditures from the'current year budget
• Develop revenue estimates
• Track departmental budgets for compliance and timely expenditure
The Town Accountant completes the Tax Rate Recapitulation form and provides other
supporting documentation required by the Division of Local Services for approval of the Town's
tax rate.
The Town Accountant prepares the invoices and- other supporting documentation of school
construction projects for audit as required under the regulations of the School Building
Assistance Program.

Dear Manager Hechenbleikner:
I am pleased to inform you that the construction bid documents for the Sidewalk Reconstruction and Related Work
(Safe Routes to Parker Middle School) On Sections of Sunnyside Avenue, Washington Street, Temple Street; and
Woburn Street in your community have been completed and bids were solicited on, October 18, 2011. The
Massachusetts Department of Transportation - Highway Division is currently in the process of certifying the low
bidder J. Tropeano Inc.
In general, the Contract primarily consists of new sidewalk and wheelchair ramp construction. Work will include
approximately 500' of new sidewalk along Washington Street, between Woburn Street and Prescott Street. Work
will also include approximately' 650' of new sidewalk along Sunnyside Avenue; between Prescott Street and
Fairview Avenue. New ADA accessible wheelchair ramps will be installed and crosswalk pavement markings will
be applied. The project is expected to complete within 235 Calendar Days from receipt of the Notice to Proceed.
The bid package, including the construction plans and specifications are available for review at the District office. I
encourage you to take advantage of this opportunity to reacquaint yourself with the project and ask that you share
this invitation with the community's emergency services divisions and any other local officials or departments who

As directed by your Office and in accordance with Reading Police Department Policy and
Procedures, I have placed together an executive summary of the application for an Application
for a Junk Dealers License - CTC Gold Refinery.
Officers, directors, stockholders and manager:

Criminal History:
Board of Probation checks, driver's license checks and out of State criminal histories were
run on all person(s) listed above under "Principal Officers". None of them have ever been
convicted of violating any state or federal law.
In the absence of a Town By-Law, the following conditions should.be placed onto the license:
1. Every dealer in precious metals shall keep a bound book in which shall be written at the
time of each purchase, a description thereof, the name, age and residence of the person
from whom the purchase was made, and the day and hour when such purchase was made.
All items shall be photographed, .
2. Every dealer in precious metals shall take and maintain photocopies of a valid driver's
license or passport for any person who sells or barters an item.
3. Every dealer in precious metals shall submit to the Reading Police Department within
one (1) week of such purchase or acquisition a list of all purchases and acquisitions
including a copy of the valid identification and. the photographs of the items in a manner
promulgated by the police department.

4. The Chief of Police or his designee shall at all times have the authority to inspect or
examine all books or other records kept by the dealer or keeper of the shop for the
Purchase, Sale or Barter of Junk, Old and Precious Metals and Secondhand Articles and
shall have the right to inspect and examine all articles and merchandise therein.
5. No dealer in junk, old and precious metals, or secondhand articles or any employee
thereof shall directly or indirectly purchase or receive by way of barter or exchange any
junk, old and precious metals or secondhand articles from a person under the age of
eighteen (18) years.
6. No item purchased or received by dealer in precious metals licensed under this bylaw
shall be removed from the town, sold, or otherwise disposed of for at least fourteen (14)
days from its date of purchase or acquisition and for at least seven (7) days from the
notification made to the Police Department unless permission has been obtained from the
Chief of Police or his designee who may request to inspect the item.
7. All weighing or measuring devices used by a licensee in the conduct of the licensed
business shall be tested and sealed by the Town of Reading Sealer of Weights and
Measures prior to being placed into service. All weighing and measuring devices shall
thereafter be inspected and tested on an annual basis.
Enforcement
Any license issued hereunder may be suspended or revoked, after a notice and hearing,
for cause or violation of the conditions of this license.
Also, a Town by-law should be enacted in the very near future.

4.5.2 Junk
4.5.2.1 No person shall use any building, enclosure or other structure for the storage, sale
or keeping of rags, waste paper stock or other inflammable material without a license
therefore from the Board of Selectmen.
4.5.2.2 The Board of Selectmen may license suitable persons, upon such terms and
conditions as the Board shall determine, to be dealers in and keepers of shops for the
purchase, sale or barter of junk, old metals and second-hand articles, and no person shall
be such a dealer or keeper without such a license.
4.5.2.3 The Board of Selectmen may also license suitable persons as junk collectors, to
collect by purchase or otherwise, junk, old metals'-and second-hand articles from place to
place within the Town, and no person shall engage in such business without such a
license.

Section 3.x - Issuance of Licenses for Dealers in the Purchase, Sale or Barter of
Junk, Old and Precious Metals and Secondhand Articles
Chapter, 140 Section 54 of the Laws of the Commonwealth provide for the
regulation of dealers in the purchase, -sale, or barter of junk, old acid precious metals, and
secondhand articles. Under Section 4.5.2 of the Town of Reading General Bylaws the
Board of Selectmen as Licensing Authority is charged with the responsibility of issuing
these licenses, determining whether a person is suitable for carrying out this business, and
determining conditions for such licenses.
- The following rules and regulations are hereby adopted to guide the Board of
Selectmen in reviewing and ruling upon applications for Dealers in the Purchase, Sale or
Barter of Junk, Old and Precious Metals and Secondhand Articles.
1. Each application will be dealt with on a case by case basis.
2. Each application for a license shall be made in writing to the Board of Selectmen
and shall set forth the name of the party licensed, the nature of the business and
the building or place in which it is to be carried out.
3. Each license for the keeping of a shop for the purchase, sale or barter of junk, old
and precious metals including gold and silver, and/or secondhand articles shall be
issued on a location specific basis
4. The applicant shall provide to the Board of Selectmen a lease or written' approval
of the property owner (if other than the applicant) for the use of the premises for
the license period
5. Licenses will be issued only within a commercial or industrial zoning district
within the Town.
6. The licensee must conform to the Town of Reading Zoning By-Laws.
7. Licenses will be issued for a period of up to one (1) year unless sooner revoked by
the Board of Selectmen, and shall expire on December 31 of each year.
8. The fee for each such license shall be $50 per year.
9. The license shall be clearly and prominently displayed in a suitable and
conspicuous place on the premises.
10. Prior to the issuance of a' license, the Board may require a review by the
Building/Zoning Inspection Division, and the Chief of Police to assist them in
determining that the applicant is a proper person to engage in the business to be
licensed.
11. Every dealer in junk, old and precious metals or secondhand articles shall keep a
book in which shall be written at the time of each purchase, a description thereof,
the name, age and residence of the person from whom the purchase was made,
and the day and hour when such purchase was made.
12. Photocopies of picture identification shall be taken'and maintained for any person
who sells or barters an item.
13. A list of all purchases and acquisitions shall be submitted to the Reading Police
Department within one (1) week'of such purchase or acquisition.
14. The Chief of Police or his designee shall at all times have the authority to inspect
or examine all books kept by the dealer or keeper of the shop and shall have the
right to inspect and examine all articles and merchandise therein.
15. No dealer in junk, old and precious metals, or secondhand articles or any

persons under the age of eighteen (18) years.

this bylaw shall be removed from the town, sold, or otherwise disposed of for at
least fourteen (14) days from its date of purchase or acquisition unless permission
has been obtained from the Chief of Police or his designee who may request to
inspect or photograph the item.
17. All weighing or measuring devices used by a licensee in the conduct of the
licensed business shall be tested and sealed by the Town of Reading Sealer of

measuring devices shall thereafter be inspected and tested on an annual basis.

Re: Early Retiree Reinsurance Program Funds
Dear MIIA member,
As you know, the MIIA Health Benefits Trust has applied for participation in the Early Retiree Reinsurance Program
(ERRP) on behalf of its governmental unit members. The ERRP is a federal program established as part of recent
national health reform legislation, more formally known as the Patient Protection and Affordable Care Act of 2010.
Congress appropriated $5 billion for the temporary program, which is scheduled to end no later than January 1, 2014
or upon the exhaustion of funds. The program was intended to provide financial assistance for health plan sponsors to
help early retirees and their families continue to have access to affordable health coverage. It was designed to
reimburse the employer 80 percent of the cost of an early retiree's health expenses between $15,000 and $90,000.
The Trust has, to date, received a total of $6,139,331 in reimbursements. The claims data that has been submitted for
reimbursement was prepared in a manner that identifies the amount of the reimbursement attributable to each
municipal member's "early retirees." Thus, MIIA will be allocating the reimbursed funds based upon the amounts
attributable to each member's "early retirees." $182,739 is attributable to the claims of the Town of Reading's
retirees.
Unlike reimbursements from the Medicare Retiree Drug Subsidy program, use of monies from the ERRP program is
restricted by regulation. ERRP reimbursements may be used to reduce the Employer's health benefit costs or.
premiums, as well as plan participants' premiums, co-payments, deductibles, co-insurance, or other out-of-pocket
health benefit costs or a combination of these items. Reimbursements may not be used for general revenue. In filing
its application for participation in the Program, the Trust was required to indicate its intended use of the funds. The
Trust stated that it intended to use the ERRP funds to "offset the increases in health benefit costs", thus allowing it to
"reduce the working rates (premium) that it charges the Trust's governmental unit members," and further that, "those
working rates will benefit the governmental units, as well as the employees, retirees and dependents of those
governmental unit members."
While the Trust is hopeful that it will be receiving additional reimbursements in the future (attributable to claims
incurred on and after January 1, 2011), the Trustees and staff feel that members should be given the opportunity to
choose whether their share of the reimbursements already received should be (1) used in its entirety for a one-time
reduction of one month's working rates (2) used to reduce working rates for the remaining months of their current
plan year or (3) used, together with any future additional reimbursements, to reduce working rates for their next plan
year. Please check off your choice of reimbursement option on the attached form and fax it back to us by October 15,
2011. We would be happy to review the feasibility of each of the options with you.
Members will be required to execute a stipulation that the Employer and subscribers will share in the reduced working
rates in accordance with the usual contribution ratios. For that purpose, we have enclosed a brief stipulation that
should be executed by your governing board.
