A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, beginning at 7:00 P.M.

45 Beacon Street Comprehensive Permit Angelo Salamone
Mr. Salamone said he was planning on presenting a letter from his engineer at this meeting but
the engineer was on vacation this week and unable to draw up the letter. He said the engineer is
in charge of all the drawings and is the key to submitting an application. He said health, fire and
electrical signed off on the previous permit. Engineering would not sign off because the
application was not complete. He said he also needs conservation signoff.
The Building Inspector said there were 26 conditions that need to be met as well as current
building standards and that all need to be met in order to issue a Building Permit. The Building
Inspector also said the plans submitted were what he considered "paper napkin plans" that are
not sufficient either for electrical, plumbing and building.
The Chairman said he wanted some conditions with actual timeframes in place for submission of
a complete building permit application and proof of financing. Mr. Jarema said there were 3
years to put the shovel in the ground for 40b projects but it appears that Mr. Salamone has one
year from now if an extension is granted to obtain a building permit by meeting all the required
conditions. Mr. Jarema said the benchmarks would be set in place to be helpful and function as a
guideline to the Applicant to assist him in the project.
The Chairman said he sees it as more as certain conditions that are required and if the Applicant
fails to meet these conditions a building permit would not be issued. He also did not want the
same issues revisited again.

The Building Inspector said even if the 26 conditions were met, but the Applicant failed to
submit complete plans, then a building permit would not be issued.
The Board members each discussed what their thoughts were on the conditions as well as their
expectations as to what might be expected from the Applicant and whether benchmarks would be
appropriate. It was also brought up that whatever Mr. Salamone presented as plans for the project
must meet all current zoning and building regulations.
The Building Inspector said he has not seen any project team or definitive plans and what he
needs are the 26 original conditions to be met as well as a complete building permit application
that has complete and acceptable plans from the Applicant.
The Board would like Mr. Salamone's engineer and team members to either attend the next
meeting on October 6, 2011 with the required plans or submit this information to the Building
Inspector to be reviewed by him and the Town Engineer prior to the next meeting.
This matter will be continued to October 6, 2011.
20 Locust Street Variance Extension Request — Richard Quaglia
Mr. Quaglia explained with winter coming he needed the extra 6 months to begin his project in
the spring and that would also allow him to retain use of his garage during the colder months.
On a motion by John Jarema, seconded by Damase Caouette, the Zoning Board of Appeals
moved to grant the Applicant a six month extension on the variance.
The vote was 5 -0 -0 (Cataldo, Miles, Perkins, Jarema, Caouette).

Steve Petkevitch did not appear at the hearing.
The Building Inspector said the bylaws state that stairs are exempt from setbacks but it does not
say platforms are exempt. Platforms are not exempt but the Town has allowed a 4' x 4' platform
(which is the minimum required) to encroach in the front -yard setback along with the stairs.
Anything larger would require a Variance as in this case.
The Board members discussed the 4' x 4' platform and the number of non - conforming platforms
throughout the town and the various scenarios that could play out with these structures in terms
of meeting the front -yard setback requirements. There was a discussion if granting this Special
Permit would set a precedent for future similar cases.
On a motion by Damase Caouette, seconded by John Miles, the Zoning Board of Appeals moved
to grant the Applicant a Special Permit under Section 6.3.3/6.3.3.2 of the Zoning Bylaws in order
to remove the existing non - conforming concrete front porches and construct a new farmer's
porch on the property as shown on the referenced Plot Plan of Land and architectural drawings.

This Special Permit is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as -built foundation plan(s), prior to the
issuance of a Building Permit.
3. As -built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The vote was 3 -2 -0 (Cataldo, Perkins, Caouette) (Miles, Jarema).
