MINUTES ri Reading Conservation Commission Meeting Selectmen's Meeting Room, 7:00 PM 2011 SEP 21 A 9' 46 Wednesday, July 13, 2011 Present: Bill Hecht, Chairman; Annika Scanlon; Barbara Stewart; Brian Tucker; Jamie Maugham; Thomas Loughlin; Maureen Knight, Recording Secretary. Absent: Brian Sullivan Call to Order The meeting opened at 7:00 PM. Old/New Business 66 Sturges Road, Enforcement Order Steve Osten said he had already given a planting plan to Ms. Fink. Motion made by Ms. Stewart to accept the planting plan. Ms. Scanlon seconded. Vote was 5 -0 -0. A discussion was held by the Commission regarding planting plans and landscape designs and the wetland regulations. The Chairman also discussed the letter being sent by the Town to the last 100 conservation applicants to express their opinion of the process. 129 Howard Street, DEP 270 -556; RGB 2009 -14 Mr. Mancuso distributed a cover letter to the Commission and a letter from the horticulturist along with his planting plan. These plantings were done last May 2010. A site visit was done by the Commission. Motion made by Ms. Stewart to authorize the removal of the leaning tree plus three others and the limbing of several. Ms. Scanlon seconded. Vote was 6 -0 -0. Motion made by Ms. Stewart to allow a minor site plan revision as observed during the site visit. Mr. Tucker seconded. Vote was 6 -0 -0. Motion made by Ms. Stewart to accept the plan as a completed planting plan with the revisions. Ms. Scanlon seconded. Vote was 6 -0 -0. 49 Longwood Road, RGB 2007 -20 A letter was sent in mid June regarding the unconnected drain spout. Mr. Hecht will call the owner and see what response they have. If the response is not positive, fines may be issued. 107 Main Street, DEP 270 - 561,- RGB - 2009 -23 The work is done except for the planting. The Chairman wants the Tree Warden and the Town Manager to review Ms. Fink's memo and approve it. Conservation Commission, July 13, 2011 71 and 73 Track Road, DEP 270 -482, RGB 2006 -30 and Emergency Certification The bank has been stabilized and a letter will be sent to Jeff Zager asking that the soils be stabilized. 140 Charles Street, RGB 2010 -27 The work appears to be complete and stabilized. Motion made by Ms. Stewart to close the case. Ms. Scanlon seconded. Vote was 6 -0 -0. Public Meeting, Request for Determination of Applicability, John DiVecchia, 32 Catherine Avenue, RGB 2011 -13, close septic system, connect to sewer, second floor addition Present: John DiVecchia Mr. DiVecchia distributed plans to the Commission and reviewed his proposal. There will be an engineered 4' retaining wall. The Chairman had drafted a Request for Determination of Applicability that Mr. DiVecchia and the Commission reviewed and some revisions were made. Motion was made by Ms. Stewart to issue a negative Determination of Applicability with conditions. Ms. Scanlon seconded. Vote was 6 -0 -0. Public Meeting, Request for Determination of Applicability, Kevin Emery, 9 Gregory Lane, RGB 2011 -14, Sports court, grading, and retaining wall Present: Kevin Emery Mr. Emery reviewed his history with the Commission and his plans for a sports court for the Commission. There will be basketball and hockey nets. The retaining wall has already been built. The Chairman told Mr. Emery that the plans for the wall, along with specifications, should have been provided to the Commission prior to the construction as well as a hearing before the Commission to seek approval. Mr. Emery said he had spoken to Ms. Fink asking what he needed to do but did not in fact tell her that he had already built the wall. The Commission asked a number of questions as to how the wall had been built and told Mr. Emery how the slope should be built. Ms. Scanlon asked what measures he had taken to keep the weep holes open. He did not use filter fabric but instead used stones. Mr. Emery was told. not to proceed with the project till he received paperwork approval from the Commission He also was told that his fence will require a Building Permit. Motion was made by Ms: Stewart to issue a negative Determination of Applicability with conditions. Ms. Scanlon seconded. Vote was 6 -0 -0. Motion was made by Ms. Scanlon to release the $5,000 bond. Mr. Tucker seconded. Vote was 6 -0- 0. Motion was made by Ms. Stewart to close the Enforcement Order from 2001. Ms. Scanlon seconded. Vote was 6 -0 -0. Conservation Commission, July 13, 2011 40 Sunset Rock Lane Melissa Pucci signed the Conservation Restriction and it was notarized by Maureen Knight. Public Meeting, Request for Determination of Applicability, George Zambouras, Department of Public Works, Birch Meadow Drive and playground parking lot, RGB 2011 -15, widen roadway, relocate curbing and sidewalk, relocate parking lot entrance Present: George Zambouris, Town Engineer Mr. Zambouris distributed the site plan, reviewed the plans for the Commission and explained the drainage system. There was a discussion about if this area was a riverfront or not because orders issued for the high school said it was a riverfront area. Mr. Zambouris said this is a separate project and he does not consider this downward area to be a riverfront area. The Commission would like the project to be set back 10' further due to the safety issue of not being able to see children in the crosswalk area. Mr. Zambouris said that equals one parking space and it would not be an issue. Future plantings for the area were discussed. Motion was made by Ms. Stewart to issue a negative Determination of Applicability with the change of 10' and two additional conditions. Mr. Tucker seconded. Vote was 6 -0 -0. 281 Main Street, DEP 270 -581, RGB 2011 -5 Present: Attorney Brad Latham, Dave Beck, R. J. O'Connell There are three proposed plan changes. One was approved on -site by the Chairman for concrete instead of packed clay. The tank was removed yesterday, witnessed by the Health Administrator, and the permit for the sanitary connection will be applied for. The erosion control plan will keep the filter fabric in place until it stabilizes. The hay bale line has been changed. The handicap ramp has been lengthened. The stockpiled material will be used to construct a berm approved as part of the minor plan change. Any hazardous material will be trucked offsite. Motion was made by Ms. Stewart to approve a minor plan change. Ms. Scanlon seconded. Vote was 6 -0 -0. Causeway Road Present: George Zambouris, Town Engineer Mr. Zambouris thinks they are outside the 100' buffer. If they want another review it can be done. The Commission would like to see a StormSeptor installed. Mr. Zambouris said that could be done. The Chairman will draft a confirmation letter. 285 Main Street, DEP 270 -540, RGB 2008 -34 The Chairman said nothing new has been submitted. Reading Memorial High School, DEP 270 -416, RGB 2003 =51 A proposal will be obtained. A Certificate of Compliance will be requested once the work is complete. Conservation Commission, July 13, 2011 20 Chequessett Road, Enforcement Order Nothing has been heard back from the owner. 0 John Street (between 55 and 87 Walkers Brook Drive), DEP 270 -578, RGB 2011 -2 Nothing new has been submitted. Jacob Way, DEP 270 -579, RGB 2011 -4 Demolition will begin soon and the Commission will do regular inspections. 29 Shackford Road, DEP 270 -507, RGB 2007 -16 A site visit was done and the Chairman approved the infiltration system. Hunt Memorial Park A site visit was done by The Chairman, John Feudo, and Bob Keating. The Town will continue to clean and seed and mulch. The baseball player organization will put up a barrier by the fence for their clay. The Town and Commission will write a joint letter stating to the abutters that no dumping is allowed. End of Line Road, DEP 313 -492 (Wakefield) The Chairman received another letter of complaint today and the Commission will review. Mattera Cabin The rules will be reviewed. Office transition A walkthrough was done in the conservation office and the files were reviewed. The Chairman will do another two weeks of filling in. Two interviews were done for a Conservation Administrator and one person withdrew. Reference checks are being done for the one remaining candidate for the temporary half -time position. Commission membership and officers for FY 12 Tom Loughlin was welcomed as a new member of the Commission. Mr. Hecht will continue his three -year appointment and likely serve out his term. He will serve as Chairman until the current situation is resolved. Mr. Maughan will continue as Vice - Chairman for now. The situation will be reviewed within three to six months. Motion made by Ms. Stewart to nominate the current Chairman and Vice Chairman to continue in their positions for now. Mr. Tucker seconded. Vote was 4 -0 -2. Minutes of June 22, 2011 Motion made by Ms. Stewart to approve the minutes. Mr. Tucker seconded. Vote was 5 -0 -1. Adjournment Motion made by Mr. Maughan to adjourn the meeting at 9:55 PM.
