The Reading Contributory Retirement Board held a meeting on February 16, 1999, Conference <br />Room, Town Hall, Reading, Massachusetts. <br />Meeting called to order @ 9:00 A.M. <br />The Board accepted applications for retirement pending approval of PERAC for: <br />Thomas F. Fennelly, Water Department, as of 1-Feb-99, Superannuation Option B. <br />"Tri-party agreement to secure Reading, MA town employees' Federal Credit Union loan to <br />Thomas A. Fennelly" to be approved subject to the approval of Mrs. Fennellys' lawyer. <br />The Board reviewed the following: <br />Joseph Tine v. Reading Retirement Board decision and the Appeals Court decision of <br />DuPont v. Commissioners of Essex County (PERAC Memo #12/1999) with counsel <br />Theodore Cohen. <br />The Retirement Board voted 3 to 0 to file with CRAB for reconsideration regarding the Tine <br />decision. The Board wishes to call CRAB's attention to the DuPont decision, requesting that <br />CRAB review the hearing officer's decision in light of DuPont. The Board's concern is solely <br />whether it has jurisdiction to hold a hearing. <br />Vincent Zaccardi has been contacted and is interested in the open position on the Reading <br />Retirement Board. A letter was sent to Merrill Lynch. <br />The next Reading Retirement Board meeting scheduled for February 25, 1999 at 9:00 A.M. <br />Meeting adjourned at 10:03. <br />Present: Klepeis, Foley, Boissoneau, Cohen and Cotter. <br />r~ <br />Henn .
