Also in attendance was Glen <br />Redmond, Commissioner of Buildings. <br />Case # 10-16 <br />A Continuation of a Public Hearing on the petition of Gibraltar Pools Corporation (James <br />Yoshizawa) who seeks a Variance under Section 4.8 / 4.8.6.1.9 / 4.8.6.1.10 of the zoning bylaws <br />in order to install an above-ground pool on the property located at 64 Dividence Road in <br />Reading, MA. This property is located in an Aquifer Protection District. The proposed pool <br />increases the lot coverage from 22.73% to 26.07%0. Maximum lot coverage of 20% is allowed if <br />an acceptable recharge system is installed. <br />Jack Sullivan of Sullivan Engineering presented a revised plot of land including two proposed <br />recharge systems to bring the installation into compliance with the requirements for effective lot <br />coverage. He also addressed the criteria for the granting of a Variance. A,memo from the Town <br />Engineer was submitted recommending any relief from the zoning regulations should include the <br />requirements stated in his memo. Letter from two abutters were submitted stating their approval <br />of the proposed pool. <br />On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals <br />moved to grant the Applicant a Variance from Section 4.8.6.1 of the zoning bylaws in order to <br />permit the installation of an above-ground pool on the property conditioned upon the following: <br />1. During installation of the proposed recharge system, should the underlying soils be <br />determined to differ than those indicated in the soil test pits, the system shall be <br />redesigned and submitted to the Engineering Division for review and approval. <br />2. An as-built of the completed recharge system shall be submitted to the Engineering <br />Division. <br />ZBA Meeting March 17, 2011 <br />
