1W f~ CL~~ ~ <br />Town of Reading <br />ZONING BOARD OF APPEALS <br />Minutes of March 3, 2011 <br />Members Present: Clark Petschek, Chairman <br />Robert Redfern <br />John Jarema <br />Jeffrey Perkins <br />Damase Caouette <br />Members Absent: John Miles <br />Kristin Cataldo <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the <br />Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. <br />Case # 11-04 <br />A Public Hearing on the petition of Dennis A. Lee who sought a Special Permit under Section(s) <br />6.3.6 of the zoning bylaws in order to add a second level to a non-conforming structure on the <br />property located at 6 Wood End Lane in Reading, MA. The proposed 2'0" floor overhang <br />encroaches into the left sideline setback. 15'0 is required. <br />Terry Shaw, contractor, spoke on behalf of Mr. & Mrs. Lee. He reviewed the proposed plan for <br />the Board. The proposed addition will not be any closer to the side lot line than the existing <br />structure and the addition is going on the main box of the footprint. They will be extending the <br />existing non-conformity but not increasing the non-conformity or creating a new non- <br />conformity. <br />The Board discussed the recent revisions to the bylaws and how certain new provisions <br />contradict each other. The Board determined that Section 6.3.6 of the bylaws was the provision <br />under which the Lee's petition should be considered. <br />On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals voted <br />unanimously to grant the Applicant's request for a Special Permit under section 6.3.6 of the <br />zoning bylaws to permit the second-story addition to the existing non-conforming dwelling on a <br />non-conforming lot at 6 Wood End Lane, Reading, MA <br />The Special Permit was conditioned upon the following: <br />1. The Applicant's final construction plans for the new second-story addition shall be <br />submitted prior to the issuance of a Building Permit. <br />V <br />ZBA Meeting, March 3, 2011 <br />
