BOARD OF HEALTH <br />March 13, 1992 <br />The Board of Health met at 7:00 pm Thursday, March 12, 1992 in <br />the Berger Room of Town Hall. Present at the meeting were Chair <br />James Nugent, Kathy Baranofsky, Bill Murphy, and staff Ruth <br />Cogan. <br />The minutes of January 27, 1992 were approved by a vote of 3:0:0. <br />(motion by Baranofsky, seconded by Murphy) <br />Cogan recommended the renomination of Regina Benoit and Diane <br />Kurkjian as the Inspectors of Animals. Motion was made Murphy <br />and seconded by Baranofsky to nominate Benoit and Kurkjian. Mo- <br />tion passed unanimously. <br />Site Plan for Main Street, Dunkin Donuts - A presentation was <br />made by the Director and the applicant's attorney, Brad Latham <br />concerning the demolition of the buildings present on the <br />property and the erection of a building with two retail spaces, <br />including Dunkin Donuts. A copy of the plan review form will be sent to the <br />applicant's attorney with instructions for its completion. No <br />construction may begin until there is an approved plan review <br />from this office. <br />Cogan gave an update on the annual Rabies clinic which will be <br />held April 11 at the DPW Garage from 1 - 3 pm. There will be a <br />five dollar fee, same as last year, and the clinic will be held <br />by Dr. Hutchinson. <br />An update was given on the present status of the FY93 budget. <br />The Director gave a report of a request of a homeowner concerning <br />lead paint. The building next to them did not have children un- <br />der 6 living in it, but they have a two year old. Paint chips <br />from the building next door have landed on their property; their <br />child plays outside in the dirt. The Director collected paint <br />chips and had them tested at the State Lab; the white trim was <br />negative and the brown paint was positive. The only enforcement <br />avenue would be through the public health nuisance law. If the <br />owner of the building would refuse to delead the exterior of the <br />building, the only avenues of enforcement would be a $20 a day <br />fine or having the Town do the work and sue the owner for the ex- <br />penses. The Board instructed the Director to ask Town Counsel <br />what alternatives the people would have privately as well as what <br />liability the Town would have if they did not act. <br />
