Bylaw Committee Minutes #139 <br />October 26, 1988 <br />Members present: Ed Murphy, George Theophanis, Nils Nordberg, Dolores Carroll <br />and Phil Pacino. <br />7:38 Chairman Murphy called the meeting to order in the Employees Lounge of the <br />Town Hall <br />Chairman Murphy received copies of the proposed PRB regulations from CPDC <br />member Dan Ensminger and Town Planner Jonathan Edwards. <br />Mr. Ensminger and Mr. Edwards then reviewed with the committee several articles <br />on the November Town Meeting warrant. The following are the comments, concerns, <br />questions and observations made on the articles reviewed by Mr. Ensminger and <br />Mr. Edwards: <br />Article 40 - Purpose explained by CPDC. Bylaw Committee questioned process <br />and need. <br />Article 42 - same as Art 40 <br />Article 41 - Explained that the article would tighten and clarify existing <br />zoning bylaws. <br />Article 32 - Questioned the need for delegating authority. CPDC asked to <br />reconsider the article. <br />Article 33 - Questioned the definition of the term "principal use". Bylaw <br />committee was particularily concerned with how this would apply <br />to structures in Reading Square. <br />Article 35 - General questions only. <br />Article 36 - Question the purpose of removing use variance power <br />from the Board of Appeals <br />Article 39 - General questions only. <br />The committee then went onto Article 31. Rick Mayberry presented thepetitioners! <br />arguments for adopting the article. Mr. Mayberry represented a group of <br />nieghbors on Chapin Ave who want to rezone the future use of a piece of property <br />on the street. Leonard Polonski, the owner of the property,then presented his <br />opinions and arguments for not adopting the article. Several citizens attending <br />the meeting also spoke in favor oIr against the article. <br />The question was asked of the CPDC how their support of Article 31 squared with <br />the proposed master plan the CPDC was presently undertaking. <br />After much discussion it was suggested that the property owner and the CPDC <br />get together to do a site pla on the presen~r:''This would give the nieghbors <br />input into the use of the property and may ene their averse postions on it use. <br />Jonathan Edwards agreed to contact Ted Cohen to see what could be done in this <br />area. Mr. Polonski and the nieghbors tentatively agreed to persue the matter. <br />Minutes #138 were approved by a vote of 3-0-2 <br />On a motion of Nils Nordberg and seconded by Phil Pacino the committee voted <br />to recommend Article 18 to a vote of 5-0 <br />
