BYLAW COMMITTEE MINUTES #150 <br />April 5, 1989 <br />Members present: Ed Murphy, George Theophanis, Nils Nordberg and <br />Dolores Carroll. <br />7:40 Chairman Murphy called the meeting to order in Room 16 of Town <br />Hall. <br />Minutes of meeting #149 were read and accepted by a vote of <br />4-0-0. <br />Chairman Murphy opened the meeting with an overview of the CPDC <br />meeting he had attended on April 3rd, where petitioner <br />Nancy Blanchard and residents were present to discuss Article <br />35 which, if accepted, would change the zoning of the Blanchard <br />property from residential to industrial. Chairman Murphy <br />explained that while this property is the only property <br />residentially zoned on that side of Lakeview Avenue, residents <br />of the area are very much against changing the zoning. They do <br />not want the traffic that industrial property would bring. <br />Although Richard Howard, a member of the CPDC was in attendance <br />to discuss several articles for the upcoming Special Town <br />Meeting, he pointed to a map showing the Blanchard property, <br />which abuts the Homart land and informed the committee that the <br />Homart land was not going to be developed. He commented on the <br />fact that property in the area will be enhanced since the dump <br />is no longer there. Members of the CPDC voted not to recommend <br />this article by a vote of 4-0-0. <br />Following further discussion by the committee, it was decided <br />that since there was no evidence of what the land would be used <br />for, on motion of Nils Nordberg, seconded by George Theophanis, <br />it was voted not to recommend Article 35 by a vote of 4-0-0. <br />Mr. Howard then briefly discussed several of the articles which <br />were on the warrant for the Special Town Meeting of April 24th. <br />Article 13 would amend the zoning map to include Bear Hill in <br />the PRD. <br />Article 16, (car wash) which had previously been passed at Town <br />Meeting, was declared illegal by the Attorney General's office <br />for CPDC's failure to advertise in the newspaper for two <br />consecutive weeks. <br />There being no further questions, Mr. Howard departed the <br />meeting. <br />Committee members reviewed several definitions including <br />"inhabitant" and "official body." It was decided that before a <br />final decision could be reached, we should find out where and <br />how "inhabitant" is used in the bylaws and whether town meeting <br />members should be included in the term "officer" (which is part <br />of official body). <br />
