- r <br />2* H <br />TOWN OF READING l <br />ZONING BOARD OF APPEALS <br />MINUTES OF FEBRUARY 18, 1999 <br />MEMBERS PRESENT: CHRISTOPHER VACCARO, CHAIRMAN <br />JOHN COOTE, VICE CHAIRMAN <br />LAURA GREGORY <br />A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of <br />the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Mr. Vaccaro swore <br />in, under oath, those present that would be addressing the Board this evening. <br />Case #99-02, K. Krekorian, Trustee for Greenhouse Acres Condominiums, <br />Carnation Circle, Reading, MA. <br />Attorney Steven Singer was present for the petitioners. Attorney Cohen Town Counsel <br />was also present. The petitioners are seeking an official document from the ZBA <br />authorizing the town to establish rubbish collection at the property. Currently there is <br />private rubbish removal but as a result of Town Meeting changing the old bylaw that <br />townhouses provide their own trash pick up, the town will start rubbish collection. This <br />complex requires a document that would authorize the town to start collection. The town <br />manager advised the petitioner to get that authorization from the ZBA. Members felt this <br />matter was not within their jurisdiction but in an attempt to ratify the situation the <br />following motion was made. <br />A motion was made that the Commission modifies its special permit, issued under Case <br />#1987-08 and instructs the trustees of Greenhouse Acres Condominiums submit a plan to <br />the town for rubbish collection which modifies the earlier plan submitted following the <br />2/25/87 accord, Case #1997-8, such plan to be consistent with current town laws and such <br />plan to be submitted to the Board of Selectmen for their consideration. The motion was <br />withdrawn. <br />A motion was made and seconded that the Board modifies its special permit issued under <br />Case #1987-08 to instruct the trustees of Greenhouse Acres Condominium to submit a <br />plan to the town which modifies the earlier plan required under Item III,B,2b of the <br />decision of the Zoning Board of Appeals of February 25, 1987, concerning rubbish <br />collection, such plan to be consistent with current town laws and policies concerning <br />municipal rubbish collection, and such plan to be submitted to the Board of Selectmen for <br />their consideration. Voted: 3-0-0. Special permit so modified. <br />10 Sylvan Rd., Lot 21, belonging to James G. Lenox and Catherine M. Lenox. The <br />owners have installed a swimming pool on Lot 21. Members questioned whether a <br />f swimming pool would be classified an accessory use. It was felt that by installing the pool <br />
