J . 1QED C?ERK LiiG, MASS. Board of Health Meeting 2"59 3 F` 18 A OF 2 2 Minutes January 9, 2003 The meeting was called to order at 6:04 P.M. Reading Town Hall, Berger Room, 16 Lowell Street, Reading, Massachusetts, by James J. Nugent, Jr., Chairman, Colleen Seferian, Vice Chair and Barbara Meade, secretary and staff liaison Jane Fiore, Health Services Administrator were present. The minutes of the December 12, 2002 were accepted as read 3:0:0. Next order of business: Administrative hearing regarding Youth Access compliance check of 12/21 at Getty Gas Station, 306 Main Street, Reading. Those present: Ron Beaureguard, Tobacco Control Director for Healthy Communities, Nancy Smith, compliance officer for Healthy Communities, Madal Awad, owner and manager of Getty Gas Station at 306 Main Street, Reading, MA 01867 and Sargent David Stamatis Reading Police Department. An explanation of procedures for compliance checks was given to the Board. Nancy Smith read into the minutes the events of 12/21 at 306 Main Street from her report (attached). Mr. Awad was addressed by the chairman of the Board to offer his side of the afternoon's compliance check. He was asked if he asked for and identification. He did say he did not ask for identification and had made a mistake. He said he did call the police and tried to detain the car of the compliance officer and student. The Chairman thanked everyone for their input and the Board would take the matter under advisement. Mr. Awad would hear from the Board. • Administrative hearing regarding Dangerous Dog: owner James Murphy, 22 Willow Street: animal mixed breed. Those present regarding the case, owner, James Murphy, ACO Andrew Nichols. The dog has been picked up by the AOC numerous times. The Board listened to the owner and the AOC. By a vote of 3:0:0 the Murphy animal will be leached, or on a run. There will be an 8 foot fence installed on the property to enclose the animal when out on the owner's property by April 15. The Health Administrator will send an order letter to Mr. Murphy regarding BOH decisions. AOC will continue to follow complaints and progress of care for the animal. • Administrative Hearing dangerous dog: 96 Washington Street, owner George Dinan, dog mixed rotweiler. Multiple complaints to ACO regarding attacks by animals, when unleashed. No bites reported although two girls with puppies were attached and police officer pulled animal off puppies. Those present for the administrative hearing, owner George Dinan, ACO Andrew Nichols, neighbors Mr. And Mrs. MacLeod of 38 Mineral Street owners of the puppies. Board of Health voted 3:0:0 to order the owner to leash the animal, have the animal on a run in the yard, take the
