"'U <br />`r R' <br />Board of Health Meeting p , r c <br />Minutes <br />June 12, 2003, 10 <br />The meeting was called to order at 6:05 P.M. Reading Town Hall, Berger Room, 16 <br />Lowell Street, Reading, Massachusetts, by Colleen Seferian, Vice Chair. Barbara Meade, <br />secretary staff liaison Jane Fiore, Health Services Administrator were present. <br />The minutes of the May 8, 2003 were accepted as read 2:0:0. <br />Next order of business: <br />• Tobacco program discussed. The state has cut the entire budget. The program will be <br />ended June 30, 2003. <br />• Cumber land Farms representatives requested the opportunity to speak before the <br />Board to request the reduction of the tobacco ticket. Barbara Meade asked the Mr. <br />Kent the manager of the Cumberland Farms to report his version. The first ticket in <br />March 2003 was issued to an individual and to the store. the individual and his father <br />paid cash for the ticket and the store ticket without informing the store. In May when <br />the next compliance check took place another sale was made. The cost of the sale in <br />fines doubled this raised the awareness of the management. They reviewed the <br />Tobacco Control records and fired the first offender. They request of the Board a <br />reduction from second offense to first offense because of the failure of the individual <br />to disclose. The Board reserved the right to review the issue prior to the adjournment <br />of the meeting. <br />• The next issue was Cestview /Mart on South Main Street has only had one sale of <br />tobacco to a minor in the last three years their fine should have been $100 a first <br />offense not a second offense at $200. The Sale clerk should have rec'd a ticket for <br />a$50 and did not receive any. The request is to reduce the fine to the appropriate fine <br />of $100 and to forgive the $50 fine. Barbara Meade made the positive motion to <br />forgive the fine and to reduce the fine. Colleen Seferian seconded. Vote 2:0:0. <br />• Next order of business is the discussion of the demolition of 4 West Street and the <br />removal of the entire septic system. The Board was informed of the witnessing of the <br />excavation of the septic system and the removal and filing of the system at 4 West <br />Street. Continuing discussion of the filed preliminary plays. The board voted 2:0:0 <br />the grease trap will be 1000 gallons on the exterior then the coffee shop will come to <br />the Health Administrator as the construction time for the interior draws closer. <br />• 36 Pilgrim Road complex case 2.6 years ago was issued a letter of failure the property <br />was sold. The now existing homeowner has had the property septic re-inspected and <br />the inspector has failed the property. Multiple discussions have occurred between the <br />homeowner the inspector, myself and the attorney for the seller (Latham and Latham) <br />in 2001. The file is all public record the board recommends a written letter to Shelia <br />Richards, Esq. the Latham and Latham attorney involved in the sale of 2001. This <br />document is to explain Title 5 and the Board of Health responsibility. <br />• The Board returned to the Cumberland Farm tobacco sale to minors issue and voted <br />to reduce the complaint to the first thereby reducing the amount of the fine from $200 <br />to $100. The company is also to forward the sign off sheet from all workers once they <br />have completed the training and retraining to check for the age of customers <br />
