v <br />Board of Health Meeting <br />Minutes <br />October 12, 2006 <br />RECEIVED <br />7CV4NCLERK <br />READI G, 1 tt SS' <br />2q1 JAN -2 P 2` 41 <br />The Board of Health meeting was called to order on October 12, 2006 by Chairmen. <br />Barbara Meade at 6:00 pm at the Town Hall, Berger Room. Those present at the meeting <br />were Colleen Seferian, David Singer and staff liaison Jane Fiore. <br />Business: <br />• Minutes of September 14, 2006 were accepted as read 2:0:0. <br />• Next order of business <br />• Review of Board of Health Regulation publication for Library, Town Clerk and <br />Community Services for public review and use. <br />• Board comment letter to Board of Selectmen on Atlantic Food Mart plan for <br />display and sale of alcoholic beverages was sent but no comment received from <br />BOS. <br />• Mosquito Control report issued to BOH by administrator: 2nd treatment of storm <br />drains completed, dead bird collection fro tracking of WNV ended by MDPH on <br />September 24, 2006. No reported human cases in Reading of WNV, EEE. Work <br />with recreation division and school athletic department on prevention was very <br />positive. Coaches and parents responded well to all mailing and educational <br />presentations by Health Division <br />Next Order of Business appeal by Owner of Venetian Moon administrative hearing <br />before the Board regarding $25 fine against 105 CMR 590.009 (E) <br />Carmen Cavallo and Joshua Latham, Esq. presented to the Board. Mr. Latham's client <br />refuses to pay fine stating he did have his staff take Choke Saver in September. The <br />documentation was not received by the Health Division by September 30, 2006. As <br />noted in the initial certified letter documentation must be filed with the BOH before 5 <br />pm on the first day of the next month. The attorney noted the course was taken but the <br />documentation was not received by the BOH. It was requested the Board forgive the <br />fine. The Health Administrator had called the restaurant partner and he noted the <br />verification and payment of the fine would be done by 5 pm on October 2, 2006. This <br />was not carried out. The Health Division received the documentation on October 6, <br />2006 after the owner noted he was taking the BOH to court. The Board took the issue <br />under advisement and would notify the owner by certified mail what their decision <br />would be. The chairman noted the goal of the BOH to protect the community's health. <br />Colleen Seferian moved to keep the fine in place the motion was seconded by David <br />Singer The Board voted 3:0:0 to leave the fine standing with the response this has <br />been used with a variety of restaurants to insure compliance with the state and federal <br />
