V <br />~a <br />BYLAW COMMITTEE MINUTES #269 <br />~ t <br />C-) CD <br />March 16, 2004 Z, <br />-CD <br />7:30 p.m. Meeting called to order in the Berger Room of Town Hall.' ~C1'„ <br />tra <br />Members present: Phil Pacino, Maria Silvaggi, and Dolores Carroll. <br />Guests present: Town Manager Peter Heckenbliekner and Town Counsel M.Yvonne <br />Gonzalez joined the Committee to review the following articles in preparation of the <br />upcoming Town Meeting. : <br />Article 11: This proposed amendment to the General Bylaws would permit the Town, <br />through the Board of Selectmen and Fire Department, to register all fuel storage facilities. <br />Conditions for issuing permits would be established by the Fire Department, with <br />regulations set by the Selectmen. Permits would be issued for a period of 5 years, with <br />renewals for shorter periods of time at the discretion of the Selectmen. <br />The amendment was submitted to the Attorney General's office for approval, with the <br />recommendation that the following sentence be included at the end of the first paragraph of <br />Section 5.17.4: "If any provision of said regulations conflict with State law, the State law <br />shall control." <br />On motion of Dolores Carroll, seconded by Maria Silvaggi, the Bylaw Committee voted to <br />recommend the subject matter of Article 11 by a vote of 3-0-0. <br />Article 14: Adoption of Article 14 would authorize the Town to pay employees serving in <br />the military the difference between their base military pay and their base pay as employees <br />of the Town. <br />On motion of Dolores Carroll, seconded by Maria Silvaggi, the Bylaw Committee voted to <br />recommend the subject matter of Article 14 by a vote of 3-0-0. <br />Article 16: This bylaw amendment prevents any bow and arrow hunting..within the <br />Town. Presently the use of bow and arrow is permitted within Conservation land only. <br />Phil pointed out that the first sentence should refer to "Article 5" instead of Article 55. <br />Action Pending. <br />Article 18: Approval of this article would remove the Police Chiefs position from Civil <br />Service, enabling the Town to widen the search for future applicants by opening the search <br />to outside candidates as well as our own. Passage will also permit the Town Manager to <br />participate in the interviewing process which was previously not possible. <br />- On motion of Maria Silvaggi, seconded by Dolores Carroll, the Bylaw Committee voted to <br />recommend the subject matter of Article 14 by a vote of 3-0-0. <br />
