BYLAW COMMITTEE MINUTES #282 <br />October 18, 2007 <br />Meeting called to order at 8:00 p.m. in the Arnold Berger Room of Town Hall. <br />Members present: Phil Pacino, George Theophanis, Dolores Carroll and Ron O'Keefe, Jr. <br />Guests resent: Town Manager Peter Heckenbleickner and several residents of the Community; <br />present to enlighten the Committee on the background of Article 14 of the upcoming Subsequent <br />Town Meeting. <br />Article 14: The two residents present reviewed a 30 year conservation restriction placed on land <br />by the Zoning Board of Appeals in 1982, limiting future development. This restriction expires in <br />2012. Owners of Peter Sanborn Place would like the restriction released to enable the <br />development of additional housing, while some residents feel it would negatively impact <br />conservation and the neighborhood. <br />On motion of George Theophanis, seconded by Ron O'Keefe, Jr., the Bylaw Committee voted <br />4-0-0 to take no position on the substance of the article, but have no objection to the form of the <br />article. <br />Article 12: Approval of the Community Preservation Act places a surcharge on property which <br />could be used to preserve open space, historic sites, and fund affordable housing. <br />On motion of Dolores Carroll, seconded by George Theophanis, the Bylaw Committee voted not <br />to recommend the subject matter of Article 13, by a vote of 3 1 <br />Article 13: Following a review of Article 13 with Peter Hechenbleikner, the Committee felt that <br />the proposed additions to the Zoning Bylaws need further clarification. <br />Phil Pacino noted that the word "ten" should be inserted before the number "10" in Section <br />2.2.1.1.1, line 6, and in Section 2.2.13.1, line 4, so that they read "ten (10)", and are <br />consistent with the Zoning Bylaws. <br />On motion of Ron O'Keefe, Jr., seconded by George Theopohanis, the Committee voted to <br />recommend the subject matter of Article 13, as amended, by a vote of 4-0-0. <br />Minutes #281: On motion of George Theophanis, seconded by Ron O'Keefe, Jr., the <br />Committee voted to accept Minutes #281, by a vote of 4-0-0. <br />Meeting adjourned at 8:55 p.m. <br />Respectfully submitted, <br />Dolores S.
