BYLAW COMMITTEE MINUTES 9288 <br />Wednesday. October 7, 2009 <br />Meeting called to order at 7:40 p.m. in the Town Hall Conference Room to review th7'War-- <br />Na r-D <br />for the Subsequent Town Meeting to be held on November 9, 2009. ci FT <br />Members rp esent: Phil Pacino, George Theophanis, Jack Russell, Dolores Carroll and R6h3 c) <br />O'Keefe, Jr. n <br />Others Present: Town Manager Peter Heckenbleickner, Town Planner Jean Delios (for Article <br />15 and Town Counsel Ellen Callahan Doucette. <br />Article 15: Peter presented the amendment to Section 6.3.17 of the Zoning Bylaws which <br />would ensure that reconstruction, allowed by Special Permit, conforms to the area and <br />considers the concerns of the neighbors. <br />On motion of Ron O'Keefe, Jr., seconded by George Theophanis, the Committee voted action <br />pending on Article 15, by a vote of 5-0-0. <br />Article 11: Peter reviewed this article with the Committee and explained that acceptance <br />would impose a .75 % sales tax on restaurant meals currently subject to the State sales tax. <br />Both pros and cons were discussed. <br />On motion of Jack Russell, seconded by George Theophanis, the Committee voted to <br />recommend the subject matter of Article 11 by a vote of 3-2-0. <br />Article 12. Approval of this amendment to Article 5 of the General Bylaws would permit <br />licensed liquor establishments to serve alcohol outdoors. <br />On motion of Jack Russell, seconded by Dolores Carroll, the Committee voted to recommend <br />the subject matter of Article 12 by a vote of 5-0. <br />Article 13: This article would amend Section 4.5 of the General Laws by replacing the "junk" <br />section with one that requires each person collecting/selling junk, precious metals, as well as <br />secondhand articles, to be licensed. Complete records would be kept of each purchase, along <br />with photo identification of the seller <br />Jack recommended that the words "and or" be inserted between the words "junk, old", so <br />that it reads "junk and or old" throughout. <br />On motion of Ron O.'Keefe, Jr., seconded by Dolores Carroll, the Committee voted to <br />recommend Article 13, as amended, by a vote of 3-2-0. <br />
